HomeMy WebLinkAbout5.0 Resolution 2005-88r1ilil ilil lllllil ]lll il]ll]t l[] ilt ilil ilt lilt 686072 71/08/2@@5 7lz25fl 8t743 Pg16 I't ALSD0RF 1 of 5 R O.OO D @.O@ GRRFIELD COUNTY c0 STATE OF COLORADO County of Garfield At a regular meeting of the Board of County Commissioners for Garireld County, Colorado, held in the Commissioners'Meeting Room, Garfield County Plaza Building, in Glenwood Springs on Monday, the 19fi day of September,2OO5, there were present: John Martin Commissioner Chairman Larrv McCown , Commissioner Trdsi Houpt , Commissioner Don DeFord , County Attorney Mildred Alsdorf _, Clerk of the Board Ed Green , County Manager when the following proceedings, among others were had and done, to-wit: RESOLUTIONNO. 2005-BB A RESOLUTION CONCERNED WITH T}IE APPROVAL OF A SPECIAL USE PERMIT FOR "PROCESSING AND MATERIAL HANDLING OF NATURAL RESOURCES'' FOR T}IE OXY NATURAL GAS CONDITIONING AND COMPRESSOR STATION AT CONN CREEK WHEREAS, the Board of County Commissioners of Garfield County, Colorado, received a Special Use Permit (SUP) request for "Processing and Material Handling of Naturat Resources" submitted by Oxy USA WLP LP to construct a nafural gas conditioning and compressor station (hereinafter "Comptessor") ; and WHEREAS, the Compressor is located on 5-acre portion of a properly containing approximately 13,918 acres located near the end of CR 312 (Conn Creek Road) in SW 7a of the SW % of Section 32, Township 6 South, Range 97W approximately 14 miles northwest of DeBeque; and WFIERERAS, the subject property is zoned Resource Lands (Gentle Slopes & Lower Valley Floor) where such use is permitted as a Special Use; and WIIEREAS, the Compressor is intended to condition and compress natural gas gathered in Oxy's Conn Creek Gas Gathering System to prepare it for delivery to market in the Trans-Colorado pipeiine; and ) )ss ) q4? .U ililil illl lllllll lllll ll llllllll lllll lll llll!uul se{ei1[lttaansss 17:25A 81743 P918 I'l RLSDoRF 3 of 5 R O.OO D O.OO GARFIELD COUNTY C0 a. The Applicant shall map and inventory the property for the County Listed Noxious Weeds. b. The Applicant shall provide a Weed Management Plan for the inventoried noxious weeds. c. The Applicant shall augment the site reclamation pian by providing a plant material list and planting schedule for the reclamation' 5. Volume of sound generated shall comply with the standards set forth in the Colorado Revised Statutes. Vibration generated: the facility shall be so operated that the ground vibration inherently and recurrently generated is not perceptible, without instruments, at any point of any boundary line of the property on which the use is located. Emissions of smoke and particulate matter: the faciiity shall be so operated so as to comply with all Federal, State and County air quality laws, regulations and standards. Emission of heat, glare, radiation and fumes: the facility shall be so operated that it does not emit heat, glare, radiation or fumes which substantially interfere with the existing use of adjoining property or which constitutes a public nuisance or hazard.. Flaring of gases, aircraft warning signais, reflective painting of storage tanks, or other such operations which may be required by law as safety or air pollution control measures shall be exempted from this provision. Any storage area for uses not associated with natural resources shall not exceed ten (10) acres in size. Any 1ighting of storage area sha1l be pointed downward and inward to the property center and shaded to prevent direct reflection on adjacent property. Water poltution: in a case in which potential hazards exist, it shall be necessary to insiatt safeguards designed to comply with the Regulations of the Environmental Protection Agency before operation of the facilities may begin' All percolation tests or ground water resource tests aS may be required by local or Siate Health Officers must be met before operation of the facilities may begin. The Applicant shall provide a copy of the appropriate bond supplied to the Colorado Oil and Gas Conservation Commission (COGCC) intended to guarantee reclamation of the facility site once the life of the facility has ended prior to the issuance of a Special Use Permit.
