I. DESCRIPTION OF THB PROPOSAL
The County received a Special Use Permit application from Oxy USA WLP LP for "Processing and
Material Handling of Natural Resources" for the Conn Creek Natural Gas Compression and
Conditioning Facility. The location of the proposed facility is illustrated in the map on page 2
indicated by the black box but more practically described as being located on Conn Creek
approximately 14 miles north of the Town of DeBeque.
The Applicant proposes to construct a natural gas conditioning and compressor facility intended to
treat natural gas gathered in Oxy's Conn Creek Gas @fhring S:Slenq to meet the gas quality
specifications of the pipeline companies taking delivery of residue gas from the facility. A 20 x 30
UuitOing will house the MCC and process control equipment and provide limited storage for
instruments and tools. An insulated building will also be constructed to house theJ colgpresggrs for
the project. Natural gas will be delivered to the facility from flow lines from the well sites north of
the facility. Once the gas has undergone its first level of compression, it is conditioned, and then
compressed funher so that it can be piped approximately 400linear feet across Conn Creek to the
sales metering device at the end of the existing Trans-Colorado Pipeline to be then sent to market.
Treatment includes de-hydration, removal of CO2,water, and liquefiable hydrocarbons. Please refer
to the Impact Statement attached to this memo.
I BACKGROUND
On August 15, 2005, the Staff referred the proposal to the Board so that the Board could determine if
the application should be referred to the Planning Commission for comment. As a result, the Board

did not refer the matter to the Planning Commission due to 1) the limited nature of potential impacts
to surrounding properties and 2) the extreme remote location of the facility in Garfield County
having little to no visual or audible impact to surrounding properties.
III. GENERAL SITE DESCRIPIION
The property is located in a very remote area of the County northwest of Parachute in the Conn
Creek basin near the end of CR 2I3.T1T project site consists of a 5-acre portion of the larger 13,918
acre property owned by Oxy USA WLP LP. The site rests in the valley floor area where Conn Creek
runs along the eastem border supported by significant riparian vegetation consisting of mature
cottonwoods along its banks. The areas surrounding the site consist of extremely steep hillsides. The
nearest residence is located approximately 7a miles away.
IV. AUTHORITY & APPLICABILITY
Pursuant to Section 9.03.04 of the ZnningResolution, an application for a Special Use Permit shall
be approved or denied by the Board of County Commissioners after holding a public hearing thereon
in conformance with all provisions of the Zoning Resolution.
V. REVIEW AGENCY AND OTHER COMMENTS
Comments have been received from the following agencies / community groups and are integrated
throughout this memorandum as applicable.
1. Town of Parachute: No Comments received.
2. Garfield County Road and Bridge Department: All vehicles transporting materials and
equipment used in the construction and operation of this facility shall abide by Garfield
County Road & Bridge Dept. oversize/overweight regulations. The weight limit for CR 204
and CR 213 are 80,0001bs. for 5-axel and 45,000lbs. for 3-axel vehicles. Dust control shall
be required at all times on CR 213 either by applying Mag. Chloride or continuous watering
of the road. Mag Chloride application will be applied by County provider and back charged
to Occidental Oil & Gas Corp. Garfield County Road & Bridge Dept. foresees no significant
increase in traffic caused by the operation of this facility after the construction period and the
facility is in operation. (See Exhibit G)
3. Garfield County Vegetation Management: No Comments Provided
4. Garfield Count), Oil and Gas Auditor: Provided the following comments (See Exhibit F)
a. Although the application discusses that the access road to this facility will be
constructed and maintained to ensure access during construction and operation, I
would recommend that the applicant also ensure that this road be designed,
constructed, and maintained to ensure that emergency response equipment can easily
access the facility.

I am aware that Oxy has an emergency response plan applicable to their drilling and
production operations, however, I don't think the existing plan addresses the
operation of a facility such as that proposed. I would recommend that Oxy be
required to either develop an emergency response plan for this facility or modify their
existing plan as necessary and submit the plan to the County.
The applicants response to the issues raised during your review of the application
indicate a small number of trucks will be required on a daily basis to transport
produced liquids from the site. I would recommend that the applicant also address
the number of trucks that will be required to deliver deionized water and other feed
materials to the facility. In addition, although CR 2l I does not currently have much
private usage, as stated in the application, the applicant should note that traffic to this
facility will also travel on CR 2M which has more private vehicle traffic.

REYIEW cRrrERH FoR SPECTAL usB PERMITS (SECTION 5:03)
Pursuant to Section 5.03, as listed under the Zone District Regulations, special uses shall conform to
all requirements listed thereunder and elsewhere in theZrlningResolution, as well as the following
standards:

Response
The facility will be a completely unmanned facility and monitored remotely. As such, there is not
need or plans for water or sanitation services at the property. Should the needs of the facilitychange;
the Board of County Commissioners will be notified of any such changes and will be approved
through the appropriate approval process.
(2) Street improvements adequate to accornrnodate traffic volume generated by the
proposed use and to provide safe, convenient access to the use shall either he in place or
shall be constructed in conjunction with the proposed use;
Response
Once the facility is completed, the applicant anticipates two to three truck trips per day will result
from the operation of the proposed facility for transportation of produced fluids. The impacted
County road (CR 2M and'213) are primarily used for oil and gas industry purposes with minimal

private usage; therefore no immediate street improvements should be required other than general
maintenance and dust control.
The County Road and Bridge Department provide the following cornrnents:

conditions of approval.
(3) Design of the proposed use is organized to minimize impact on andfrom adjacent
uses of lnnd through installation of screenfences or landscapi materials oi the peiphery
of the lot and by location of intensively atilized areas, access points, lighting and signs in
such a tnanner as to protect established neighborhood character;
Response
The facility is located approximately 14 miles north of the Town of DeBeque, in a very remote area,
surrounded on three sides by steep mountainous terrain; therefore limiting potential visual impacts.
The site itself is located in such a location that the natural terrain and exisiing trees limit the view
from passing traffic. The facility is planned to be "remote operated" from an offsite location therebylimiting the need for additional lighting. The mature cottonwood vegetation along Conn Creek serves
as adequate visual mitigation.
Industrial Oreratiq^ns.: Indastrial Operations, including extraction, processing, fabrication,industrial sapportfacilities, mineralwaste disposal, stora[e, sanitary UnapA, satvigiyard, accessroutes and utility lines, shall be permitted, provided:
(1) The applicantfor a permitfor industrial operations shall prepare and submit to the plnnning
Director ten (10) copies of an impact statement on the proposed use describing its locatioi,
scope, design and construction schedule, including ai explanation of iti operational
characteristics. ,One (I) copy of the impact statement stritt be filed-with tie County
Cotnmissioners by the Planning Director. The impact statement shall address thefollowinj:
(A) Existing lawful use of water through depletion or pollution of surface run-off, strearn
flow or ground waterl
Response
The application sates that the proposed facility will not require the use of surface water foroperational purposes. Only de-ionized water, which will be hauled in from off-site, is required for the
gas conditioning process. The site grading plan insures compliance with the approved Storm Water
Management Plan as stipulated by the permit issued uy cbrun. No run off of storm water into
adjacent streams or ground water is anticipated from the site.
(B) Impacts on adiacent landfrom the generation of vapor, dust, smoke, noise, glare orvibration, or other emanations;

The application states that air emissions permits have been obtained from the Air pollution Control

Division of the CDPHE. All actual emissions will meet or be below the State requirements. All
vibratory equipment will be set on concrete foundations and will be housed within metal buildings tominimize any impacts due to vibration and noise. All equipment, buildings and piping will be
painted a desert tan color to aid in the minimization of glare and to insure that the faciiity ALnds into
the surrounding terrain as much as possible
(C) Impacts on wildffi and domestic animals through the creation of hazardous
altractions, alteration of existing native vegetation, blockade of migration routes, use
patterns or other disruptions;
The facility will have a six foot fence surrounding the perimeter of the site to prevent the entrance ofwildlife. All disturbed areas, outside the fenced facility will be revegetated as iequired. The facility is
not otherwise expected to result in any change of wildlife use patterns or other disruptions to wildiifewithin the area' The only anticipated affect to wildlife from the proposed facility is the exclusion
from the approximately 5 acre site. Staff referred the application to the Division of Wildlife which
indicated cornments would be forthcoming. Staff intenOs to submit these comments at the hearing
before the Board.
(D) Affirmatively show the impacts of truckand automobile traffic to andfrom such uses
and their impacts to areas in the County;
As noted earlier, the facility is anticipated to be an unmanned facility which will be remotely
operated and monitored. As a result, pickup visits to the site will be limited to an as needed basis.
Transportation of produced liquids is anticipated to result in two to three trucks per day into andexiting the facility. These truck trips are anticipated to have minimal impact to th; ou".ull County
Road traffic levels.

Response
The site is located in an extremely remote location where the nearest adjoining property is located
approximately % miles south of the proposed facility. Operation of the facility is not expected to
produce noticeable effects on this property. The Application states that the owner of the adjoining
property is fully aware of the proposed facility and has no problems with its operations so long as
their livestock are protected.
(F) Mitigation rneasures proposedfor all of theforegoing impacts identified andfor the
standards identified in Section 5.03.08 of this Resolution
(2) Permitsmaybegrantedforthoseuseswithprovisionstlnlprovideadequatemifigationforthe
following:
(A) A planfor site rehabilitation mast be approved by the County Commissionen before a
pennit for conditional or special use will be issued;
Response
The application states that the proposed life of the facility is 20 years. After the proposed facility is
no longer needed, the area will be reclaimed. Reclamation will consist of the removal of all surface
equipment, restoration of grade to approximate original contours, replacing stockpiled topsoil,
revegetation, and complying with all prevailing COGCC and Garfield County regulations governing
final reclamation. The Application contains a reclamation plan for the facility.
(B) The County Commissioners may require securtty before a permit for special or
conditional use is issued, if required The applicant shallfumish evidence of a bank
commitment of credit, bond, certified check or other securigtdeemedaeceptable by the
County Commissianers in the amount calculated by the County Commissionen to
secare the execution of the site rehabilitation plan in workmanlike manner and in
accordance with the speciftcations and construction schedule established or approved
by the County Commissionerc. Such commitments, bonds or check slrull be paya.ble to
and held by the County Commissionerc;
Response
The Application states that the applicant is willing to provide bonding as required by Garfield
County Board of Commissioners. The applicant has aheady posted a $50,000 bond with the COGCC
for this facility. It has been the practice of the Board to accept a copy of this bond as proof that the
facility will be reclaimed.

Section 5.03.08 Industrial Perfor.mance Standards
htdustrial Perfonnance Standards: All industrial operations in the County shall compty with
applicable County, State, and Federal regulations regulating water, air and noise pollution and
slull not be conducted in a manner constituting a public nuisance or luztrd Operations shall be
con"dacted in such a tnanner as to minimize heat, dust, smoke, vibration, glare and odor and all
other undesirable environmental effects beyond the boundaries of the property in which such rnes
are located, in accord with thefollowing standards;
(1) Volume of sound generated shall comply with the standards setforth in the Colorado Revised
Statutes at the time any new application is made.
(2) Vibration generaled: every use shall be so operated that the ground vibration inherently and
recunently generated is not perceptible, without instruments, at any point of any boundary
line of the propefi on which the ase is located;
(3) Emissions of smoke and particulate matter: every use slull be operated so as to comply with
all Federal, state and county air quality laws, regulations and standards;
(4) Emission of heat, glare, radiation andfumes: every ase shall be so operated that it does not
ernit heat, glare, radiation or fumes which sabstantially intedere with the existing use of
adioining propefly or which conslitutes a public nuisance or hazard. Flaring of gases,
aircrafi warning signals, reflective painting of storage tanks, or other such operations which
may be required by law as safety or air pollution control measures slull be exemptedfiom this
provision;
Response
The operation of the facility shall be required to continuously adhere to these standards. The
application states that operation of the facility will meet the standards set for by the Colorado
Department of Public Health & Environment (CDPfm). Vibration from the facility will be minimal
due to the construction of concrete foundations and buildings to house vibratory equipment.
Emission levels will meet standards set for by the CDPIIE. All emission levels will meet CDPTIE
regulations. The painting of buildings, equipment, tanks and piping of a color to match the
surrounding terrain should mitigate any potential public nuisance due to visual impacts. Should the
Board approve the proposed facility, Staff suggests these industrial performance standards be
included as conditions of approval for the life of the facility.
(5) Storage area, salvage yard, sanitary landfill and mineral woste disposal areas:(A97-It2)

(E) Any storage areafor uses not associated with natural resources shall not exceed ten(10) acres in size.

Response
The applicant states that the storage of flammable liquids will reside in steel tanks and containedwithin approved berms or other containment devises in order to meet the Storm Water Management
Plan and fire protection regulations. The application contains a fire protection plan that specffically
outlines measures to be taken regarding welding and hot work operatiorr, "o*unicationi, and whatto do in the event of a fire. No waste materials will be allowed to discharge outside the facility. Noheavyequipment will be stored within the facility. No offsite storage areas are anticipated. Lightingwill be installed for maintenance purposes; however, full time usage of the lighting is not anticilateOl
(6) Water pollution: in a case in which potential haznrds exist, it stutl be necessary to install
safeguards designed to comply with the, Regulations of the Environmental protecion Agcncy

Response
The applicant states that a Storm water Management Plan (swMp) has been submitted with thecolorado Department of Public Health and Eniironment (cDpI{E). Further, NDpEs permits havebeen obtained which are Surface Discharge Permits intended to handle the discharge of water used tohydrostatically test pipelines to the ground surface. me controt ;i,l*;;;irllgrr","o through theSWMP.
The Ap-plicant is presently obtaining a permit from the US Army corps of Engineers for the conncreek crossing of the pipeline rrom ttre facility to the Trans-colorado sales meter station. Staffunderstands this permit will be issued; however, should the Board approve the Special Use permitapplication, staff suggests this permit be filed with the county as a condition olany approval.
Pursuant to section 9.03.05 of the ZnningResolution:

VII. RECOMMENDEDFINDINGS

Any storage area for uses not associated with natural resources shall not exceed ten (10)
acres in size.
Any lighting of storage area shall be pointed downward and inward to the property center
and shaded to prevent direct reflection on adjacent property.
Water pollution: in a case in which potential hazards exist, it shall be necessary to install
safeguards designed to comply with the Regulations of the Environmental Protection
Agency before operation of the facilities may begin. All percolation tests or ground water
resource tests as may be required by local or State Health Officers must be met before
operation of the facilities may begin.
The Applicant shall provide a copy of the appropriate bond supplied to the Colorado Oil and
Gas Conservation Commission (COGCC) intended to guarantee reclamation of the facility
site once the life of the facility has ended prior to the issuance of a Special Use Permit.
That all proper building permits are obtained for the structures associated with the operation
of the Compressor prior to the issuance of a Special Use permit.
That the Applicant shall comply with the following requirements of the County Road and
Bridge Department:
a. All vehicles transporting materials and equipment used in the construction and
operation of this facility shall abide by Garfield County Road & Bridge Dept.
oversize/overweight regulations. The weight limit for CR 2M andcR 213 are 80,000
lbs. for S-axel and 45,000Ibs. for 3-axel vehicles.
b. Dust control shall be required at all times on CR 213 either by applying Mag.
Chloride or continuous watering of the road. Mag Chloride application will be

applied by County provider and back charged to Occidental Oil & Gas Corp.
15. The Applicant shall provide a copy of the approved permit from the US Army Corps of
Engineers for the Conn Creek crossing ofthe pipeline from the facility to the Trans-
Colorado sales meter station prior to the operation of the facility and approval of a Special
Use Permit.
No more than 5 vehicles per day shall be allowed to access the facility.
The Applicant shall develop and submit an emergency response plan for this facility or
modify their existing plan as necessary and submit the plan to the County prior to the
issuance of any Special Use Permit.
The access road to the facility from CR 213 shall be designed, constructed, and maintained
to ensure that emergency response equipment can easily access the facility. Proof that this
road has been constructed to address these concerns shall be provided to the County prior to
the issuance of any Special Use Permit.

The Landscaping and Reclamation Plan doesn't go into detail about future reseeding.
Seeding is mentioned in the Stonn Water Management Plan, and states in Section +.t.g ttrat the

"Processing and Material Handling of Natural Resources" for the Conn Creek Natural
Gas Treatment Facility. The location of the proposed facility is illustrated in the map
below indicated by the block box but more practically described as being located on

The Applicant proposes to construct a natural gas treatment and compressor facility
intended to treat natural gas gathered in Oxy's Conn Creek Gas Gatheiing System to
meet the gas quality specifications of the pipeline companies taking delivery of residue
gas from the facility. A 20 x 30 building will house the MCC inO process conrrol
equipment and provide limited storage for instruments and tools. Pleaie refer to the
Impact Statement attached to this memo.

M. REFERRAL AUTHORITY
Section 9.03.04 of the Zoning Resolution of 1978, as amended requires that Special Use
Permit applications be initially brought to the Board so that the Board may determine if a
recommendation from the Planning Commission is necessary.
rV. STAFFRECOMMENDATION
Staff recommends the Board not refer the matter to the Planning Commission due to the
limited nature of potential impacts to surrounding properties and the extreme remote
location of the facility in Garfield County having little to no visual or audibie impact to
surrounding properties.
Impact Statement
Site Location selection for Conn creek Treating Facility provides multiple benefits. The
{oPosed facility will be in a central location to curren"t and future natural gas wells in the area.The site is in a relatively remote area with the nearest residence being approximately % miles tothe south' Due to the remote location of the property, visual i-p# iri* tt" facility will belimited.
The facility will be in continuous use and operation 24-hours per day, year round.However, the majority of activity will occur dwing normal business hours.
Remote monitoring of the facility after completion of the construction phase will limit theneed for on-site personnel only during dayfight hours. The anticipated traffic impact to Garfieldcounty Road 213 will be approximateti oie pickup t ip p", day under normal conditions ofoperations' oXY gas conhol deparhnent wif have monitoring and control ability from theiroffice facility located in Grand Junction, Colorado.
Gas powered compressors are planned for the initial phase of the operation. Thesecompressors will not exceed the noise or vibration limits set forth by tfr. State of ColoradoRevised statute 25-12'103. Given the remote location of the rr"* furility, noise will not be anuisance to area residents. compressors will be located in insulated buildings and equipped withnew technology mufflers to reduce noise levels.
The facility site has been designed- to insure protection of ground water and nearbystreams through the development and implementation of a storm fuater Management plan,specific to the area. containment facilitils are designed into the facffi for any hazardousmaterial stored or used during operations. There will ie no sewage or solid waste generated onthe site.
The Conn Creek Treating Facility will occupy about 5 acres of the oxy owned l3,9lgacre parcel.
According to wildlife distribution maps from the colorado Division of wildlife, the siteis located on winter rangeland for mule dier and elk. This type of facility is by natureincompatible with continued wildlife access, therefore wildlife will G excluded by wildlife prooffencing' The limited size of the facility will not block wildlife migration routes. The waterstored at the site is not expected to be an attraction or threat to witerfowl, but a deterrencesystem will be installed if waterfowl usage does occur.
All equipment will be painted with a beige color to match the color of the surroundingarea' The expected life of the facility is_approximat ely 20+ years. A comprehensive reclamation

Thank you for the application you submitted to this office on July l, 2005 for the Special Use Permit
request for a o'Gas treatment Facility located at Conn Creek." I am writing this letter to inform you
the application is deemed technically Non-Compliant and the Garfield County Building and Planning
Department needs additional information in order to review the Special Use Permit application.
Your timeliness in providing this information will expedite our ability to place your application on
the public hearing agenda. Please address each of the following items individually:
t. Submit an statement that speciJically responds to each of thefollowing criteriafrom Section
5.03 of the Zoning Regulations:
(l) Utilities adequate to provide water and sanitation service based on accepted
engineering standards and approved by the Board of County Commissioners shall either
be in place or shall be constructed in conjunction with the proposed use.
(2) Street improvements adequate to accommodate traffic volume generated by the
proposed use and to provide safe, convenient access to the use shall either be in place or
shall be constructed in conjunction with the proposed use;
(3) Design of the proposed use is organized to minimize impact on andfrom adiacent
uses of land through installation of screenfences or landscape materials ontheperiphery
of the lot and by location of intensively utilized areas, access points,lighting and signs in
such a manner as to protect established neighborhood characterl

Industrial Operations: Industrial Operations, including ertraction, processing, fabrication,
industrial supportfacilities, mineral waste disposal, storage. sanitary landftll, salvage yard, access
routes and utility lines, shall be permitted, provided:
(1) The appllcantfor apermitfor industrial operations shallprepare and submit to the Planning
Director ten (10) copies of an impact statement on the proposed use describing its location,
scope, design and construction schedule, including an explanation of i8 operational
characteristics. One (1) copy of the impact statement shall be ftled with the Counly
Commissioners by the Planning Director. The impact statement shall address thefollowing:
(A) Existing lawful we of water through depletion or pollution of surface run-olf, strcamflow or
ground wate?;
(B) Impacts on adjacent landfromthe generation ofvapor, dust, smoke, noise, glare orvibration,
or other emanationsl
(C) Impacts on wildlife and domestic animak through the creation of haztrdous attactions,
alteration of existing native vegetation, blockade of migration roules, use pafrerns or other
disruptions;
@) Allirmatively show the impacts of truck and automobile traffrc to andfrom such uses and their
impacts to ateas in the Counly;
(E) That suffrcient distances shall separate such wefmm abwting propeny which might otherwise
be damaged by operations of the proposed use(s);
(D Mitisation measures proposedfor all of theforegoing impacts identifud andforthe standards
identifud in Section 5.03.08 of this Resolution
(2) Permits may be grantedfor those uses with provisions that provide adequate mitigationfor the
following:
(A) A planfor site rehabilitation must be approved by the County Commissionen before a permit
for conditional or special use will be issued;
(B) The County Commissioners may require security before a permitfor special or conditional rne
is issued, if required The applicant shall furnish evidence of a bank commitment of credit,
bond, certiJied check or other security deemed acceptablc by the County Commissionerc inthe
amount calculated by the County Commissioners to secure the exccnlion of the site
rehabilitation plan in workmanlike manner and in accordance with the specifrcations and
construction schedule established or approved by the County Commissioners. Such
commitments, bonds or check shall be payable to and held by the County Commissioners;
(C) Impacts set forth in the impact statement and compliance with the standards contained in

Industrial Performance Standards: All industrial operations in the County shall comply with
applicable County, State, and Federal regulatians regulafing water, air andnoise pollution and
shall not be conducted in a manner constituting a public nuisance or hazard Operatbns shall be
conducted in such a manner as to minimize heat, dust, smoke, vibration, glare and odor and all
other undesirable environmental elfects beyondthe boundarics of theproperty inwhich such rnes
are locatted, in accord with thefollowing standards;
(1) Volume of sound generated shatl comply with the standards setforth in the Colorado Revised
Statutes at the time any new application is made. (A. 93-061)
(2) Wbration generated: every use shall be so operated that the ground vibrafion inherently and
recurrently generated is not perceptible, without instruments, at any point of any boundary
line of the property on which the use is located;
(3) Emissions of smoke and particulate natter: every we shall be operated so as to comply with
all Federal, State and Coun$t air quality laws, regulations and standards;
(4) Emission of heat, glare, radiation andfumes: every use shall be so operated that it does not
emit heat, glare, radiation or fumes which substantially interfere with the existing use of
adjoining property or which constitutes a public nuisance or hazard Flaring of gases,
aircraft warning signals, reflective painting of storage tanks, or other such operations which
may be required by law as safety or air pollution control measures shall be exemptedfrom this
provision;
(5) Storage area, salvage yard, sanitary landlilt and mineral waste disposal areos:(A97'I12)
(A) Storage of Jlammable or explosive solids or gases shall be in accordance with accepted
standards and laws and shall comply with the national, state and local/ire codes and written
recommendations/comments from the appropriate"local protection district regarding
compliance with the approprfute codeg (A97'Il2)
(B) At the discretion of the County Commissionerc, all outdoor storagefacilities may be required to
be enclosed by fence, landscaping or wall adequate to conceal suchfacilitiesfrom adiacent

(C) No materials or wastes shall be deposited upon a propefi in suchform or manner that they
may be transfened olf the property by any ruasonably foreseeable natural causes or forces;

(D) Storage of Heavy Equipment witt only be allowed subject to (4 and (C) above and the
