Clerk of the Board Fd Green (absent)County Maaager when the fo[owing proceedings, among others were had and done, to-wit: RESOLUTION NO.r8- /Ja A RESOLU-TION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT FOR A "TWO-FAMILY DWELLING UMT" ON A PROPERTY OWNED BY 23 PONDEROSA CIRCLE, LLC DESCRIBED AS LOT 2, BLOCK 1, WESTERI{ HILLS suBDfyISION, GARFTELD COUNTY PARCEL NO# 2 I I 9-3 $-A t -002 Recitals A. The Board of County Commissioners of Garfield County, Colorado, received a Special Use Permit request for a "Two-Family Dwelling Unit" on a property owned by 23 Ponderosa Circle, LLC, Garfield County. B. The Two-Family Dwelling Unit is described asl-ol2, Block l, Western Hills Subdivision and located at 23 Ponderosa Drive in West Glenwood Springs, CO. C. The subject properly is zoned Residential Limited Urban Density CR./I/[ID) where such use is pennitted as a Special Use. D. The Board of County Commissioners opened a public hearing on the 20t day of October, 2008 upon the question ofwhether the above-described SLIP should be granted or denied, during which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said SUP. The Board of county commissioners closed the public hearing on the 206 day of october' 2008 to make a final decision' F. The Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determinations of fact: I . hoper posting and public notice were provided as required for the meeting before the Board of CountY Commissioners' 2.ThemeetingbeforetheBoardofCountyCommissionerswztsextensiveand complete, that all pertinent facts, matters and iszues were submitted and that all interested parties were heard at that meeting' 3. Bl B3'AE8',EL, couNry co Prior to issuance of the Special Use Permit the applicant shall provide documentation sufticient to the Building and Planning Departrrent regarding shared maintenance of the rear access and shall install a stop sigrr at the intersection parking area access and Donegan Road (CR 130) per Road and Bridge recommendations' Prior to issuance of the Special Use Permit the applicant shall gravel the parking area. Maximurn occupancy for each unit is limited to two (2) residents per bedroom. This Special Use Permit shall be valid for the property only during the time the properly is owned by 23 Ponderosa Circle, LLC and said permit shall not be transferred with ownership of the property.
