I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The proposed pipeline will pass through the following districts as
designated on the Garfield County Comprehensive Plans Management
Districts Map: Public Lands, District C, D, & F, Rural Areas with
Minor through Severe Environmental Constraints, Parachute Urban Area
of Influence, and Subdivisions and Rural Serviceable Areas.
II. DESCRIPTION OF THE PROPOSAL
A. Site Description: The pipeline is proposed in rural areas
characterized by ranching and open space, along County Road and
State Highway right-of-ways, and in the vicinity of Parachute
with more residential and industrial types of land use.
B. Project Description: The applicant proposes to construct
approximately 23 1/2 miles of transmission and gathering pipeline
between 8" and 2" in size with operating pressures of up to 1000
PSIG. Construction is proposed to begin in November, 1985,
continuing through January, 1986, employing a maximum of 50.
Restoration is proposed to begin immediately following
construction in accordance with individual landowners
specifications.
III.MAJOR ISSUES AND CONCERNS
1. The applicant is required to construct and operate the pipeline
in accordance with Federal Department of Transportation Pipeline
Safety Regulations.
2. The applicant must submit documentation of agreements with all
property owners authorizing the construction of the pipeline.
The authorization may take the form of lease agreements,
right-of-ways, or easements, and should formally address
restoration plans. These agreements must be completed prior to
any Resolution of Approval.
3. The proposed pipeline is not authorized by the P.U.C., (Public
Utilities Commission) and therefore has no rights of
condemnation.
4. The applicant must submit all approvals and permits from the Army
Corps of Engineers authorizing the proposed river crossing by the
gathering line in Section 4, T7S, R95 and Section 33, T6S, R95W.
5. The applicant must apply for all required road cut permits from
the Garfield County Road and Bridge Department and building and
septic permits from the Garfield County Building and Sanitation
Department.
6. The proposed pipeline route passes through the Town limits of
Parachute briefly on the north side of town. Parachute has been
notified of this application and is unable to comment beyond
registering general safety concerns at this time due to the
scheduling of their next Town Council Meeting. Any County action
should be conditional on the applicant receiving all appropriate
approvals from the town.
IV. SUGGESTED FINDINGS
1. That proper publication and public notice was provided as
required for the hearing before the Board of County
Commissioners.
2. That the hearing before the Board of County Commissioners was
extensive and complete, that all pertinent facts, matters and
issues were submitted and that all interested parties were heard
at that hearing.
3. That for the above stated and other reasons, the proposed use is
in the best interest of the health, safety, morals, convenience,
order, prosperity and welfare of the citizens of Garfield County.
V. RECOMMENDATION
APPROVAL, with the following conditions:
1. All proposals of the applicant shall be considered conditions of
approval unless stated otherwise by the Board.
2. The applicant and r shall notify the County Clerk's office
and the Assessor's office to ensure proper licensing and
assessment of equipment and vehicles based in the operation,
prior to final approval.
3. The applicants shall comply with all regulations of Garfield
County relating to industrial operations in the zone districts in
which the properties are located, and shall construct and operate
the pipeline in accordance with all applicable State and Federal
Regulation, including but limited to the Department of
Transportation Safety Regulations.
4. The applicant shall apply for and receive any road cut permits,
access permits, building permits and septic permits, as required
by the County Road and Bridge Supervisor & Chief Building
Official.
5. The applicant shall submit agreements with all property owners
including the BLM authorizing the construction of the pipeline
and addressing restoration of the site. All agreements shall be
submitted prior to any Resolution of Conditional Approval.
6. The applicant shall submit documentation of approval from the
Army Corps of Engineers authorizing the proposed Colorado River
crossing by the pipeline in Section 4, T7S, R95W and Section 33,
T6S, R95W.
7. The applicant shall submit proof of compliance with all
applicable regulations of the Town of Parachute.
8. A single mobile home, for use as office space, shall be allowed
on the site adjacent to tne Compressor site. The lease agreement
for the mobile home site shall authorize the placement of the
mobile home or written confirmation from the property owner must
be submitted.
9. The applicants shall have 120 days from the date of the
Resolution of Conditional Approval to meet all conditions set
forth in tne Resolution. The Special Use permit shall be issued
when all conditions are met and shall be valid for a period of
120 days from the date of issuance, and shall expire, unless
construction or use has commenced witnin tnis period.
