Zone District: Agricultural/Industrial-Size of Property: 160 acres, but will only be using 10 acres. Application Requirements: These items must be submitted with the application 1.) Plans and specifications for the proposed use including the hours of operation, the amount of vehicles accessing the site on a daily, weekly and/or monthly basis, and the size of any existing or proposed structures that will be utilized in conjunction with the proposed use.. Please submit this information in narrative form and be specific. Plans and Specifications for Proposed Use. Down Valley Septic & Drain, Inc. has occupied the existing site since 1998 for the purpose of storage. The business operates on a land lease from Don Scott, DS Enterprise. Down Valley Septic & Drain, Inc. would like to obtain a special use permit from Garfield County. This application is a request to allow of the existing business activities described below. Hours of operation. Down Valley Septic & Drain, Inc. operates between the hours of 8:00 AM and 5:00 PM Monday thru Friday and emergencies on Saturday and Sunday. Vehicles Accessing the Site. Employee vehicle access the site on a daily basis. There are 6 employees, there will be 3 employee vehicles on site. There are 2 service vans, 2 porta potty pickups, 2 pumper trucks (they hold about 2000 gallons each), 1 jetter trailer, and 2 small flat bed trailers accessing the site on a monthly basis . These trucks are utilized to pump septic tanks, haul equipment to unclog drains, and haul porta jons. These trucks access the site on a daily basis. Other intermittent vehicle trips consist of UPS/Federal Express deliveries, These trips average 4 to 5 per month. Page 1 Down Valley Septic & , .n, Inc. Existing structures on site: Includes a 4500 square foot barn with concrete floors (8 inches of concrete with 5 gauge rebar) for storage, 500 square foot smaller room for storage. This building is enclosed with 4 bay doors, and 1 walk in door. The nature of the business is to store Porta Johns, trucks, and small equipment (Rooter machines, Jetter machines, mainline cameras). The site plan shows the areas of storage. The applicant does not intent to build any additional buildings. See attached building inspection. 2.) If you will be using water or will be treating wastewater in conjunction with the proposed use, please detail the amount of water that would be used and the type of wastewater treatment. If you will be utilizing well water, please attach a copy of the appropriate well permit and any other legal water supply information, including water allotment contract or an approved water augmentation plan. Water/Wastewater Service: The existing business operation utilizes bottled water for potable purposes. 3.) A map drawn to scale portraying your property, all structures on the property, and the County or State roadways within one (1) mile of your property. If you are proposing a new or expanded access onto a County or State roadway, submit a driveway or highway access permit. Site Plan: See attached site plan Exhibit — Al & A2. 4.) A vicinity map, showing slope of your property, for which a U.S.G.S. 1:24,000 scale quadrangle map will suffice. See attached Exhibit — B. 5.) A copy of the appropriate portion of a Garfield County Assessor's Map showing all public and private landowners adjacent to your property. Include a list of all property owners and their addresses. See attached Exhibit —C1 & C2. 6.) Attach a copy of the deed and a legal description of the property. If you are acting as an agent for the property owner, you must attach an acknowledgement form the property owner that you may act in his/her behalf. See attached Exhibit — D1 & D2. 7.) You must submit an impact statement consistent with the requirements of Section 5.03, paragraph 1 thru 3. (on industrial type use applications section 5.03.07 and 5.08.08 will be necessary to address). Impact Statement: Existing lawful use of water through depletion or pollution of surface run-off, stream flow or ground water. Page 2 Down Valley Septic & Drain, In. Well permit has been applied for from the Colorado Division of Water Resources. See attached copy of application (behind exhibit D2) Impacts on adjacent land from the generation of vapor, dust, smoke, noise, glare or vibration, or other emanations. The existing and proposed use on the property does not and will not result in the generation of vapor, smoke, glare, vibration or other emanations that impact adjacent land. A limited amount of dust and noise are associated with vehicle movement on the site. These emanations are limited to the immediate vicinity of the activity and are not perceptible at the property boundary. All machinery is equipped with adequate noise muffling devices. The physical configuration of the property also serves to limit and minimize any impacts to adjacent land. West, North, & East of the site is substantial vegetation. South of the site is the drive way of 200 feet and after that the State frontage road. Impacts on wildlife and domestic animals through the creation of hazardous attractions, alternation of existing native vegetation, blockade of migration routes, use patterns or other disruptions. The existing and proposed use will not result in adverse impacts wildlife or domestic animals through creation of hazardous attractions, alternation of existing native vegetation, blockade of migration routes, use patterns or other disruptions. The activities of the site do not result in generation of products or waste products that will attract wildlife or domestic animals. Any domestic waste produced at the site is disposed of regularly at the landfill. See attached letter. (behind exhibit D2) Impact of truck and automobile traffic to and from such uses and their impacts to areas in the County. The property has been actively used for 5 years for the storage of trucks & equipment without adverse impacts resulting from vehicle traffic to or from site. The 20 mile per hour speed limit on the State frontage road adjacent to the access provides for lower road traffic speed that are compatible with the existing and proposed site access. The applicant is not aware of traffic complaints or accidents resulting form the existing access configuration of the State frontage road. Included in this application is a copy of the access permit by the Colorado Department of Transportation. CDOT has also came to the site and has examined the road and has given the okay for us to use the road. They have also talked with Mark Beam regarding this matter. Sufficient distance separates such use from abutting property, which might otherwise be damaged by operations of the proposed use. Sufficient distances topographic/vegetation features and physical separation exist to protect abutting property from damage or adverse impact associated with the existing and proposed use. As was mentioned previously, generation of emanations form the site will not be perceptible at the property boundary and noise generation will be minimal at the property boundary. Page 3 Down Valley Septic & Drain, Int. Storage of flammable or explosive solids or gases on the property. There is no storage of flammable, explosive solids, gases or waste on the property. Outdoor storage. The applicant will maintain outdoor storage in a condition adequate to conceal from Highway. Generation of waste products. No materials or waste shall be deposited upon the property. Heavy equipment storage. There is no heavy equipment stored at this site. The equipment storage area will not be any closer than 500 feet from any existing residential dwelling. Minimum site acreage for special use. The total acreage of the proposed site is 10 acres and driveway and ceeds the mini m lot size of five (5) acres. The property is not in a platted subdivision. Repair and maintenance activity. 2 Repair and maintenance activity requiring the use of equipment will not generate noise, odors or glare beyond the property boundaries. Any repair and maintenance activity that will result in the generation of noise, odors, or glare beyond the property boundaries will be conducted within a building or outdoors during the hours of 8:00 a.m. to 6:00 p.m., Monday through Friday. Loading and unloading of vehicles. All loading and unloading of vehicles shall be conducted on the site and on private property and will not be conducted on any public right -a -way. Storage areas for uses not associated with natural resources. Storage areas for uses not associated with natural resources will not exceed ten (10) acres in size. Lighting. All site lighting will be minimized and will be pointed downward and inward to the property center. All light fixtures will be designed and placed to prevent direct reflection on adjacent property. Site rehabilitation. Site rehabilitation in the event that all permitted operations are permanently terminated on the property will consist of removal of all vehicles and equipment. The reason for the applications for water is that there is an existing toilet and we were informed that because of the toilet being in the structure that we had to apply for more water, so indeed we have been approved for more water. The application for well location is that on the first application there was some wrong information it stated south when indeed it was north and that has been corrected.
