HomeMy WebLinkAbout5.0 Resolution 2003-37111111 VIII 111111 1111 1111111 11111 11111 1111 1111 28469 06/02/2003 03 57P 61475 P667 M ALSDORF of 4 R 0.00 D 0.00 GARFIELD COUNTY CO STATE OF COLORADO )ss County of Garfield At a regularly scheduled meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on, Monday, the 19ih day of May A.D. 2003, there were present: John Martin Larry McCown Tresi Houpt Don DeFord Mildred Alsdorf Ed Green , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board , County Manager when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 2003-37 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION FOR THE STORAGE OF APPROXIMATELY 50 PORT POTTIES, 2 REGULAR SIZE PICKUPS, 2 CARGO VANS, 2 PUMPER TRUCKS, 2 JETTER TRAILERS, AND 2 SMALL FLAT BED TRAILERS FOR DON SCOTT WHEREAS, the Board of County Commissioners arfield County, Colorado ("Board"), has received an application from Down Valley Septic and Drain, on behalf of Don Scott, for a special use permit ("SUP") to allow for approval for the continued storage of approximately 50 porta potties, 2 regular size pickups, 2 cargo vans, 2 pumper trucks, 2 Jetter trailers, and 2 small flat bed trailers within the A/I (Agricultural / Industrial) zone district; and WHEREAS, the Board held a public hearing on the 19th day of May, 2003, upon the question of whether the above described SUP should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions concerning the approval of said special use permit, and WHEREAS, it was established that the SUP runs with the land and is issued to the property owner, Don Scott, for the specified 10 acres of leased area by Down Valley Septic and Drain on the subject property; 1 II111111111111111111111111111111111111111 III 11111111 128469 06/02/2003 03 57P B1475 P668 M ALSDORF ! of 4 R 0.00 D 0.00 GARFIELD COUNTY CO WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact as listed below: 1. Proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 2. The meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. The above stated and other reasons, the proposed special use permit has been determined to be in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. The application has met the requirements of Special Use (Sections 5:03, 5:03:07, 5:03.08 and 9:03) the Garfield County Zoning Resolution of 1978. NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that Scott Special Use Permit is hereby approved, subject to compliance withall of the following specific conditions: 1. All representations of the Applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval, unless specifically altered by the Board. 2. The Special Use Permit shall run with the subject property and the property owner. 3. The Applicant shall comply with all applicable requirements of the Garfield County Zoning Resolution of 1978, as amended. 4. The Applicant shall comply with all applicable standards of the Colorado Department of Public Health and Environment. 5. The Applicant shall comply with all State and Federal regulations and standards, such as Noise Abatement, Water and Air Quality. 6. As per the State Highway Access Permit issued by the Colorado Department of Transportation on May 16, 2003, the total number of average daily trips ("ADT") associated with the storage of porta-potties, shall not exceed 100 ADT. 7. All new lighting fixtures shall be designed and placed to prevent direct reflection on adjacent properties. 2 111111 11111 111111 1111 1111111 11111 11111 111 ..SII 11111111 28469 06/02/2003 03 57P B1475 P669 M RLSDORF of 4 R 0.00 D 0.00 GARFIELD COUNTY CO 8. Vibration, emission of smoke and particulate matter, and the emission of heat or radiation shall comply with applicable Federal, State, and County laws, regulations and standards. 9. All garbage generated shall be stored within standard garbage receptacles and removed regularly. 10. The storage of porta-potties and associated vehicles shall be located in the area as represented in the application material dated February 28, 2003. Any uses, other than the storage of porta-potties and associated vans, trucks and trailers, shall obtain the appropriate special use or conditional use permit, if applicable. 11. The property owner shall meet the appropriate noise standards pursuant to Colorado State Statue 25-12-130. 12. Upon the termination of the use, rehabilitation of the site shall include the removal of all porta-potties and associated vehicles and equipment. 13. Prior to the issuance of the actual Special Use Permit, the Applicant shall: a. Due to a change in use of the 4,500 square foot building, it can no longer be classified as an agricultural structure, and the Applicant shall submit and obtain a building permit from the Garfield County Building Department for the structure. The structure shall comply with the standards of the 1997 Uniform Building Code and the County's requirement for snow -loads and frost protection. b. The Applicant shall inventory and map the subject property for County listed noxious weeds, as Russian knapweed may be in the area. c. The Applicant shall provide a weed management plan for the inventoried noxious weeds. d. The area of the storage of the porta potties shall be screened with 6 feet fencing with privacy slats that comply with county regulations.
