1. Narrative
Proposal for MBC Grand Broadcasting, Inc. to erect a seventy eight -foot broadcasting
antenna.
MBC Grand Broadcasting Inc. requests a special use permit for the erection of a seventy eight -
foot broadcasting antenna on an 8.9 acre parcel of land owned by Stephen and Susanne Self,
described as tract 13 in Section 3, Township 6 South, Range 92 West of the 6th P.M. as shown by
Plat #1 of Antlers Orchard Development Co., filed for record with the Clerk and Recorder of
Garfield County; except that portion conveyed by instrument recorded in Book 429 at Page 258 of
said Garfield County Clerk and Recorder's Records.
The purpose of the proposed antenna is the broadcast of a 1490 AM frequency to the Town of
Silt and outlying areas from an undetermined location within the immediate area.
A 2.7' tall valcosphere, a 72.3' foot fiberglass antenna and a 3' base to which the antenna mounts
will comprise the total height of seventy eight -feet. The antenna is freestanding with no guy wires
and will be painted a color, which minimizes a visual impact. The proposed operation will use a
buried radial ground system with 120 copper radials 160.75' in length around the base of the
antenna. The radials are #10 gauge in diameter and will be buried 2-4' underground, Antenna
specifications are included in the appendix.
The antenna height is less than the two hundred -foot height restriction of the Federal Aviation
Administration therefore will not be lighted or marked.
A wood or plastic fence six-foot in height will surround the antenna a minimum of 10 feet from
the base protecting it from wildlife, livestock and human intrusion. Plastic or wood is
recommended over a steel wire fence to avoid antenna system de -tuning effects. Additionally,
wooden or plastic fences avoid the possibility of RF energy induction into the fence itself, which
may create an electrical hazard.
An underground electric line serviced by Excel Energy will provide electricity and a phone line will
be provided by Qwest Communications to the facility.
The site will be used only as an unmanned communications facility, visited approximately once a
month by passenger vehicle.
An FAA Notice of Proposed Construction or Alteration (Form 7460-01) was submitted
electronically to the Federal Aviation Administration on June 26, 2008 and will be provided before
time of construction.
2. Water/Waste Water
The site does not require water or generate wastewater and there are not plans to provide water
or sanitary sewer services to the site.

Attached is a site plan, drawn to scale, depicting the property boundaries, the proposed location
for the antenna, the existing structures, and all roads within one -mile of the site.

A vicinity map based on a U.S.G.S. quadrangle map, at a scale of 1:24,000, is attached to this
submittal package and shows topography.

Gamba & Associates, Inc. (G&A) is submitting this special use application package on behalf of
the antenna owners, MBC Grand Broadcasting, Inc., and the real property owners, Stephen and
Susanne Self. A letter acknowledging this is attached to this submittal.
8. Zoning Response
(1) The utilities required for the operation of the antenna is electric power and a phone
service line. Excel Energy and Qwest Communications have agreed to provide services to
the project upon completion of appropriate contractual agreements. "Will serve" letters
are attached to this submittal.

(2) Street improvements will not be required as the site will be infrequently visited and the
resultant vehicle trips will have a negligible impact on existing roadways.
(3) The antenna is inherently small of profile and will be painted a neutral gray color to blend
in with the nature landscape. The Federal Aviation Administration does not require the
antenna to be lighted eliminating visual impact in low light periods.
9. Additional Review Standards
A review of county zoning regulations indicates that Section 5.03.13 Broadcasting Studio and/or
Communication Facility: is an applicable additional review standard.
1. The facility shall comply with the radio frequency emission requirements of the
Federal Communications Commission as demonstrated by Facility Id: 160492 and
Permit File Number BNP-20070926A0N.
2. The physics of AM frequency radio waves makes co -location unfeasible.
3. The facility includes a freestanding antenna tower.
(a) To make the antenna less visible it will be painted to blend with the surrounding
landscape.
(b) The antenna tapers from 17.5" at the base to 3.75" at the tip and is capped with a
2.7' high by 3.75' wide valcoshere (see attached tower information).
(c) There are no existing communication facilities on the site.
10. Base Fee
A check in the amount of $400.00 is included with this application submittal. A signed
"Agreement for Payment" is attached to this submittal.
11. Submittal
Two copies of this submittal, including the completed application, are to be submitted to the
Building and Planning Department.

APPLICATION SUBMITTAL REQUIREMENTS
As a minimum, specifically respond to all the following items below and attach any additional information to
be submitted with this application:
1. Please submit, in narrative form, the nature and character of the Special Use requested.
Submit plans and supporting information (i.e. letters from responsible agencies). Include
specifications for the proposed use including, but not limited to, the hours of operation, the
number and type of vehicles accessing the site on a daily, weekly and/or monthly basis, and
the size and location of any existing and/or proposed structures that will be used in conjunction
with the proposed use, and provisions for electric power service and any other proposed utility
improvements. Be specific.
2. If you will be using water or will be treating wastewater in conjunction with the proposed use,
please detail the amount of water that would be used and the type of wastewater treatment. If
you will be utilizing well water, please attach a copy of the appropriate well permit and any
other legal water supply information, including a water allotment contract or an approved water
augmentation plan to demonstrate that you have legal and adequate water for the proposed
use.
3. Submit a site plan /map drawn to scale that portrays the boundaries of the subject property, all
existing and proposed structures on the property, and the County or State roadways within one
(1) mile of your property. If you are proposing a new or expanded access onto a County or
State roadway, submit a driveway or highway access permit.
4. Submit a vicinity map showing slope / topography of your property, for which a U.S.G.S.
1:24,000 scale quadrangle map will suffice.
5. Submit a copy of the appropriate portion of a Garfield County Assessor's Map showing the
subject property and all public and private landowners adjacent to your property (which should
be delineated). In addition, submit a list of all property owners, private and public, and their
addresses adjacent to or within 200 ft. of the site. This information can be obtained from the
County Assessor's Office. You will also need the names (if applicable) of all mineral interest
owners of the subject property, identified in the County Clerk and Recorder's records in
accordance with §24-65.5-101, et seq. (That information may be found in your title policy
under Exceptions to Title).
6. Submit a copy of the deed and a legal description of the subject property.
7. If you are acting as an agent for the property owner, you must attach an acknowledgement
from the property owner that you may act in his/her behalf.
8. Submit a statement that specifically responds to each of the following criteria from Section 5.03
of the Zoning Regulations:
(1) Utilities adequate to provide water and sanitation service based on accepted
engineering standards and approved by the Board of County Commissioners shall either
be in place or shall be constructed in conjunction with the proposed use.
(2) Street improvements adequate to accommodate traffic volume generated by the
proposed use and to provide safe, convenient access to the use shall either be in place or
shall be constructed in conjunction with the proposed use;
(3) Design of the proposed use is organized to minimize impact on and from adjacent
uses of land through installation of screen fences or landscape materials on the periphery
of the lot and by location of intensively utilized areas, access points, lighting and signs in
such a manner as to protect established neighborhood character;
9. Depending on the type of Special Use Permit requested, you may need to respond to
additional review standards in the Garfield County Zoning Resolution Section 5.00
[Supplementary Regulations]. This may include uses such industrial uses [section 5.03.07 &
5.03.08], Accessory Dwelling Units [section 5.03.21], Utility line/Utility Substations, etc. Specific
sections of the Zoning Resolution which can be located on the Garfield County web site at
http://www.garfield-countv.com/building and planning/index.htm, or information can be
obtained from this office
10. A $400.00 Base Fee: Applicant shall sign the "Agreement for Payment" form and provide the
fee with the application.
11. Submit 2 copies of this completed application form and all the required submittal materials to
the Building and Planning Department. Staff will request additional copies once the Special
Use Permit application has been deemed technically complete.
II. PROCEDURAL REQUIREMENTS
(The following steps outline how the Special Use Permit Application review process works in
Garfield County.)
1. Submit this completed application form, base fee, and all supplemental information to the
Garfield County Planning Department. It will be received and given to a Staff Planner who
will review the application for technical completeness.
2. Once the application is deemed technically complete, the Staff Planner will send you a
letter indicating the application is complete. In addition, Staff will also send you a "Public
Notice Form(s)" indicating the time and date of your hearing before the Board of County
Commissioners. Prior to the public hearing, Staff will provide you with a Staff Memorandum
regarding your requested Special Use. (If Staff determines you application to be deficient,
a letter will be sent to you indicating that additional information is needed to deem your
application complete.)
3. It is solely the Applicant's responsibility to ensure proper noticing occurs regarding the
requested Special Use and the public hearing. If proper notice has not occurred, the
public hearing will not occur. Notice requirements are as follows:
a. Notice by publication, including the name of the applicant, description of the subject
lot, a description of the proposed special use and nature of the hearing, and the
date, time and place for the hearing shall be given once in a newspaper of general
circulation in that portion of the County in which the subject property is located at
least thirty (30) but not more than sixty (60) days prior to the date of such hearing,
and proof of publication shall be presented at hearing by the applicant.
b. Notice by mail, containing information as described in the paragraph above, shall
be mailed to all owners of record as shown in the County Assessor's Office of lots
within two hundred feet (200') of the subject lot and to all owners of mineral interest
in the subject property at least thirty (30) but not more than sixty (60) days prior to

such hearing time by certified return receipt mail, and receipts small be presented at

GARFIELD COUNTY BUILDING AND PLANNING DEPARTMENT
FEE SCHEDULE
Garfield County, pursuant to Board of County Commissioners ("Board") Resolution No. 98-09, has established
a fee structure ("Base Fee") for the processing of each type of subdivision and land use applications.
The Base Fee is an estimate of the average number of hours of staff time devoted to an application, multiplied
by an hourly rate for the personnel involved. The Board recognized that the subdivision and land use
application processing time will vary and that an applicant should pay for the total cost of the review which
may require additional billing. Hourly rates based on the hourly salary, and fringe benefits costs of the
respective positions combined with an hourly overhead cost for the office will be used to establish the actual
cost of County staff time devoted to the review of a particular project.
Actual staff time spent will be charged against the Base Fee. After the Base Fee has been expended, the
applicant will be billed based on actual staff hours accrued. Any billing shall be paid in full prior to final
consideration of any land use permit, zoning amendment or subdivision plan. If an applicant has previously
failed to pay application fees as required, no new or additional applications will be accepted for processing until
the outstanding fees are paid.
Checks, including the appropriate Base Fee set forth below, must be submitted with each land use application,
and made payable to the Garfield County Treasurer. Applications will not be accepted without the required
application fee. Base Fees are non-refundable in full, unless a written request for withdraw from the applicant
is submitted prior the initial review of the application materials.
Applications must include an Agreement for Payment Form ("Agreement") set forth below. The Agreement
establishes the applicant as being responsible for payment of all costs associated with processing the
application. The Agreement must be signed by the party responsible for payment and submitted with the
application in order for it to be accepted.
The complete fee schedule for subdivision and land use applications is attached.

The following guidelines shall be used for the administration of the fee structure set forth above:
1. All applications shall be submitted with a signed Agreement for Payment form set forth below.
2. County staff shall keep accurate record of actual time required for the processing of each land use
application, zoning amendment, or subdivision application. Any additional billing will occur commensurate
with the additional costs incurred by the County as a result of having to take more time that that covered by
the base fee.
3. Any billings shall be paid prior to final consideration of any land use permit, zoning amendment, or
subdivision plan. All additional costs shall be paid to the execution of the written resolution confirming
action on the application.
4. Final Plats, Amended or Corrected Plats, Exemption Plats or Permits will not be recorded or issued until all
fees have been paid.
5. In the event that the Board determines that special expertise is needed to assist them in the review of a land
use permit, zoning amendment, or subdivision application, such costs will be borne by the applicant and
paid prior to the final consideration of the application. All additional costs shall be paid prior to the
execution of the written resolution confirming action on the application.
6. If an application involves multiple reviews, the Applicant shall be charged the highest Base Fee listed
above.
7. Types of "Procedures" not listed in the above chart will be charged at an hourly rate based on the pertinent
planning staff rate listed above.
8. The Planning Director shall establish appropriate guidelines for the collection of Additional Billings as
required.
9. This fee structure shall be revised annually as part of the County budget hearing process.

project, it is not possible at this time to ascertain the full extent of the costs involved in processing the
application. APPLICANT agrees to make payment of the Base Fee, established for the PROJECT, and to
thereafter permit additional costs to be billed to APPLICANT. APPLICANT agrees to make additional
payments upon notification by the COUNTY when they are necessary as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of County Commissioners for the consideration of an
application or additional COUNTY staff time or expense not covered by the Base Fee. If actual recorded costs
exceed the initial Base Fee, APPLICANT shall pay additional billings to COUNTY to reimburse the COUNTY
for the processing of the PROJECT mentioned above. APPLICANT acknowledges that all billing shall be paid
prior to the final consideration by the COUNTY of any land use permit, zoning amendment, or subdivision
plan.

Special operating conditions or restrictions:
1 The permittee/licensee must reduce power or cease operation as
necessary to protect persons having access to the site, tower or
antenna from radiofrequency electromagnetic fields in excess of FCC
guidelines.
2 Permittee shall install a type accepted transmitter, or submit
application (FCC Form 301) along with data prescribed in Section
73.1660(b) should non -type accepted transmitter be proposed.
3 Permittee/Licensee shall accept such interference as may be imposed by
other existing 250 watt Class C stations in the event that they are
subsequently authorized to increase power to 1000 watts.
4 A license application (FCC Form 302) to cover this construction permit
must be filed with the Commission pursuant to Section 73.3536 of the
Rules before the permit expires.
5 Before program test authority is authorized by the Commission:
sufficient radiofrequency (RF) electromagnetic field measurements
taken at the tower fence shall be submitted to show that the new power
level RF radiation is in compliance with the American National
Standards Institute Guidelines (OET Bulletin No. 65. August 1997); or
a fence must be erected at such distances and in such a manner as to
prevent the exposure human exposure to radiofrequency electromagnetic
fields in excess of the FCC Guidelines (OET Bulletin No. 65. Edition
97-01, August 1997). The fence must be of a type which will preclude
casual or inadvertent access, and must include warning signs at
appropriate intervals which describe the nature of the hazard.
Permittee shall submit documentation of compliance with this special
operating condition along with the Form 302, application for license
and the request for program test authority.
6 Licensee shall be responsible for satisfying all reasonable complaints
of blanketing interference within the 1 V/m contour as required by
Section 73.88 of the Commission's rules.

MEDIA BUREAU ADOPTS SIMPLIFIED APPLICATION PROCEDURES
FOR AM NONDIRECTIONAL VALCOM ANTENNAS
By this Public Notice, the Media Bureau ("Bureau") announces simplified procedures for AM station
construction permit applications which specify Valcom antennas, Based on its review of the Valcom field
tests and intemal reports submitted to the Commission for evaluation, the Bureau announces that it will
not routinely require the submission of a proof of performance, current distribution measurements, or a
formula for the vertical plane radiation characteristic for nondirectional AM facilities which utilize these
antennas.
The Valcom antenna, manufactured by Valcom Manufacturing Group Inc., is a self-supporting whip
antenna which is shorter and more streamlined than the one-quarter wavelength lattice tower typically
used by AM stations. The Valcom antenna includes a "Valcosphere," or a wire -framed sphere, mounted
at the top of the whip antenna. A top -loading coil is mounted approximately one-third of the total height
above the antenna base. The Valcom antenna requires use of a 120 -radial buried ground system.
Attachment A to this Public Notice is a January 2007 report submitted by Valcom describing the
construction, modeling, and field testing of the Valcom antenna. Based on field tests submitted by the
manufacturer, two models of the Valcom antenna are approved for routine use at higher AM frequencies.
The 85 -foot Valcom antenna may be used at frequencies ranging from 1200 to 1700 kHz; the 75 -foot
Valcom antenna may be used at frequencies from 1390 to 1700 kHz. The low -profile Valcom antenna
affords AM licensees the flexibility to place antennas in areas where taller towers may be unacceptable,
and niay be more economical to build and maintain than a standard antenna. Applicants may only specify
the Valcdin antenna for nondirectional use. The Bureau will consider authorizing the use of directional
Valcom arrays when more information is available.
The January 2007 field test report included in Attachment A establishes radiation efficiency values for the
75- and 85 -foot Valcom antennas within specified frequency ranges. Figure 9 in Attachment A shows the
calculated efficiencies, all of which meet or exceed the minimum efficiency for Class B, C, and D AM
stations.: The Figure 9 efficiency values are reproduced in Attachment B for ease of reference. The field
tests on which the calculated efficiency figures are based were performed with the Valcom antenna
mounted above a ground system consisting of 120 buried radials, each 120 feet in length. Applicants
specifying a Valcom antenna shall use the antenna efficiency values set forth in Attachment B, provided
that both the antenna and the ground system are the same as those described in Attachment A.2 Use of

any ground system other than one consisting of 120 radials, each 120 feet long with the Valcom antenna
requires submission of a proof of performance as set forth in Section 73.186.
Previous studies on the Valcom antennas demonstrated that the antenna elevation pattern for each can be
represented by the formula for a simple vertical radiator in Section 73.160(b)(1) of the Commission's
rules. A 2003 memo from the Office of Engineering and Technology concluded, based on antenna
modeling studies, that the elevation pattern for a short vertical monopole such as the Valcom antenna is
virtually independent of the current distribution along the radiating element.3 Consequently, the staff has
eliminated the requirement for current distribution measurements that is normally applied to non-standard
antennas. Applicants proposing to use Valcom antennas shall use the formula in Section 73.160(b)(1),
based on the physical height of the radiator, in computing the vertical form factor commonly referred to
as f(0).

This aeronautical study revealed that the structure does not exceed obstruction standards and would not be a
hazard to air navigation provided the following condition(s), if any, is(are) met:
Based on this evaluation, marking and lighting are not necessary for aviation safety. However, if marking
and/or lighting are accomplished on a voluntary basis, we recommend it be installed and maintained in
accordance with FAA Advisory circular 70/7460-1 K Change 2.
This determination is based, in part, on the foregoing description which includes specific coordinates, heights,
frequency(ies) and power. Any changes in coordinates, heights, and frequencies or use of greater power will
void this determination. Any future construction or alteration, including increase to heights, power, or the
addition of other transmitters, requires separate notice to the FAA.
This determination does include temporary construction equipment such as cranes, derricks, etc., which may be
used during actual construction of the structure. However, this equipment shall not exceed the overall heights as
indicated above. Equipment which has a height greater than the studied structure requires separate notice to the
FAA.
This determination concerns the effect of this structure on the safe and efficient use of navigable airspace
by aircraft and does not relieve the sponsor of compliance responsibilities relating to any law, ordinance, or
regulation of any Federal, State, or local government body.
A copy of this determination will be forwarded to the Federal Communications Commission if the structure is
subject to their licensing authority.
