At a regular meeting of the Board of county Commissioners for Garfield county, colorado, held
in the Commissioners' Meettg Room, Garfield County Courthouse, in Glenwood Springs on- Monday , the
2nd day of October, A.D. 2000' there were present:

when the following proceedings, among others were had and done, to-wit:
RESOLUTION NO. 2OOO-79
A RESOLUTION CONCERNED WITH TTM, APPROVAL OF A SPECIAL USE PERMIT
UTILITY WATER STORAGE TANK, FOR CRYSTAL RTVERAPPLICATION FOR A PUBLIC
LIMTED PARTNERSHIP.
WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received
application from crystal River Limited Partnership concerned with a Special use Permit to allow for a
p.rUti" utilitY water storage tank;
WHEREAS, the Board held a public hearing on the I lth day of September, 2000, upon the question
of whether the above-described Special Use Permit should be granted or denied, at which hearing the public
and interested persons were given the opportunity to express their opinions regarding the issuance of said
Special Use Permit; and
WHEREAS, the Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determination of fact:
l. That proper publication and public notice was provided as required by law for the hearing
before the Board of County Commissioners'
Z. That the hearing before the Board of County Commissioners was extensive and complete,
that all pertineni facts, matters and issues were submitted and that all interested parties were
heard at that hearing.

That the application is in compliance with the Garfield County Zoning Resolution of 197g,
as amended.
For the above stated and other reasons, the proposed use is in the best interest of ttre health,
safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County.

NOW, TIIEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that the Special Use Permit be and hereby is approved to allow for a public utility water
storage tank, upon the following specific conditions:
l. That all representations ofthe applicant, both in the application and verbally at the hearing,
shall be considered conditions of approval, unless approved otherwise by the Board.
Any seed used for revegetation, shall be certified wee free seed and the appliarrt shall be
responsible for maintaining the site in a wee free manner.
Any damage done to the roads as a result of drainage from the tank, will be the repaired by
the applicant.
