Please submit this information in narrative form and be specific. 2] If you will be using water or will be treating wastewater in conjunction with the proposed use, please detail the amount of water that would be used and the type of wastewater treatment. If you will be utilizing well water, please attach a copy of the appropriate well permit and any other legal water supply information, including a water allotment contract or an approved water augmentation plan. 3] A map drawn to scale portraying your property, all structures on the property, and the County or State roadways within one (1) mile of your property. If you are proposing a new or expanded access onto a County or State roadway, submit a driveway or highway access permit. 4] A vicinity map, showing slope of your property, for which a U.S.G.S. 1:24,000 scale quadrangle map will suffice. 5] A copy of the appropriate portion of a Garfield County Assessor's Map showing all public and private landowners adjacent to your property. Include a list of all property owners and their addresses. 6] Attach a copy of the deed and a legal description of the property. If you are acting as an agent for the property owner, you must attach an acknowledgment from the property owner that you may act in his/her behalf. 7] For all applications pertaining to airports, the oil and gas industry, power generation and/or transmission industry, or any other classified industrial operation, you must submit an impact statement consistent with the requirements of Sections 5.03, paragraphs 1 thm 3; 5.03.07, inclusive; and 5.03.08, inclusive. The consideration of this proposed Special Use will require at least one (1) public hearing, for which public notice must be provided. The Planning Department will mail you information concerning this hearing(s), approximately 30 days prior to the scheduled hearing. You will then be required to notify, by certified return receipt mail, all adjacent landowners and publish the notice provided by the Planning Department, in a newspaper of general circulation. Both these notices must be mailed/published at least 15 days prior to the public hearing. The applicant shall bear the cost of mailing and publication and proof of mailing and publication must be submitted at the time of the public hearing. Ca I l- - 1 l,+ Spangler,s Auto Salvage Operations The hours at Spangler's Auto Salvage are 8 to 5 Monday - Friday and 8 to noon on Saturday and as necessary for emergencies. The number of vehicles accessing the site varies from day to day. I have never kept any kind of record of how many enter daily, weekly and/or monthly. In 1997 427 cars were brought in and so far in 1998 181 cars have been brought in. Only cars that are 1980 and newer are being put in the main yard. All others are stripped and then go straight to the crusher. We crush on a a regular basis. Last year we crushed at two separate times, during which crushing operations lasted about 1 week. Twenty eight large truck loads of crushed material were hauled from the premises. So far in 1998 we have crushed one time, and approximately 340 tons of crushed material has been removed from the property. See attached letter of support dated Aug. 7, 1998. From Valley Resource Management. The existing buildings and structures being used consist of the main building which is the office, shop and warehouse. The shop and office area is 50'x 80' and the warehouse area is 80'x 100'. There are 16 trailers and buses generally around the boundary of the property that are used for storage, and to which the outside fencing is attached. There are about 1600 cars in the storage area. In October of 1995 we lost the lease to a piece of property across highway 6 & 24 that we called the annex and had used several years prior for the storage area and the crushing area. When we lost the lease we tried to crush in the main yard, but found we did not have enough room to do it. At that time we moved the trailers in the west end on the south side of the yard to the fence line to line up with the other trailers. In July 1996 we got a permit from the Army Corps of Engineers to fill one acre of the vacant land. We filled and started using part of this one acre, but we have not yet filled the entire one acre. The local fire department uses the expanded area on the west as a training site and facility for emergency rescue procedures. The thought here is that it is unpredictable to determine when additional space is needed; and it is a more efficient use of human and financial res urces to address permitting for the entire acreage, in the pending application, instead of requiring piecemeal submittals. Of course, all other required permits must be in place, and other county regulations would apply, as expansion occurs. As per our telephone`conversation thisexpansion of the Salvage operation is not substantial enough tQ, require the entire facility to be brought up to current fire code requirements. After discussions with the owners, the District would make the following recommendations on`tmproving the fie safety of the facility; I. The emergency fire pump and fire hose shotild be placed somewhere where it is easily accessible and be kept free of heats that delay access lithe eginpment. 2. The current access foads'within the facility. are adequate for emergency vehicle access and efforts should be made to maintain this access in the future. 3. Although the.Distnct shares this same concern for the entire area, as stated above, the changes d this facility ate not substantial enough to require the extension of water mains to the area. In addition, it questionable if waterservice extension would be available at this time. In the mean time, Spangler's Auto Salvage appears to have recognized this problem and have made efforts to have the equipment available to uduixe the water from the irrigation ditch running through the property for fire protection rise. The owners are continuing to work with the District to improve the emergency response capabilities within their facility. EXHIBIT Co 7 Z 5.03 Conditional and Special Use: The special use shall conform to the following requirements: (1) Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the board of county commissioners shall either be in place or shall be constructed in conjunction with the proposed use. (A) Water Drinking water is provided by purchasing bottled water and dispensers. Sanitation water is obtained from an existing well located on the property. (B) Sewage Sewage is treated in an existing septic system which consists of a septic tank with a leach field. (2) Street improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe convenient access to the use shall either be in place or shall be constructed in conjunction with proposed use. Spangler's Auto Salvage is located approximately one and a half miles east of Rifle, Colorado on U.S. Highway 6 8 24. Access to the facility is directly from Highway 6 fi 24. No additional accesses are required or contemplated under the expanded existing use. (3) Design of the proposed use is organized to minimize impact on and from adjacent use of land through installation of screen fences or landscape materials on the periphery of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character. Auto Salvage operations have been in existence on this site since the late 1940's. See the attached Affidavit of Ownership and Use signed by a former owner/operator, Clarence O. Bates Jr. The entire property was purchased as a salvage yard by the present owner in 1987. The area purchased included the area upon which the present owner wants to expand operations. The area surrounding the property when the salvage operation began consisted of farm ground and grazing ( conversation with Casey Bates, December 1987 ). The area has gradually developed around this operation. Now the surrounding land uses include farming, high density residential, grazing, commercial and industrial. The salvage yard consists of a garage, office, single family residence, parking, crushing area and storage area. The storage area is fenced with either wooden or metal fences to screen the area from adjacent uses and the highway. The area to the east is farm ground. Past the farm ground are Gasamat gas station and S.F.I. portable toilets and storage area. The westerly portion of the subject site is vacant ground onto which the storage area is to be expanded. Further to the west is the access road to the Cottonwood Springs Trailer Park. This subdivision is north of the existing salvage storage area. When the park was built a six foot wooden fence was erected between the subdivision and the salvage yard. The sewage treatment facility for Cottonwood Springs is located just to the north of the area onto which the storage area is expanding. West of the access road to the trailer park is an area with commercial, industrial, and storage facilities. These storage facilities are known as Alpine Storage and are owned and operated by applicant. U. S. Highway 6 & 24 is located along the entire southern boundary of the property. Applicant is contemplating planting tree rows for screening along the west end and adjacent to the highway on a portion of the southern boundary of the property. - 5.03.07 Industrial Operations: Industrial Operations, including extraction, processing, fabrication, industrial support facilities, mineral waste disposal, storage, sanitary landfill, salvage yard, access routes and utility line shall be permitted, provided: (1) Spangler's Auto Salvage prepares and submits to the Planning Director ten copies of an impact statement on the proposed use prescribing its location, scope, design and construction schedule, including an explanation of its operational characteristics. The location of the special use is shown on the enclosed Vicinity Map,Attachment 4. The scope, design, construction schedule and operational characteristics are covered in the following discussion, and on Attachment 1. The existing operation is being expanded to the west on applicant's property. The vacant acreage is being filled to the elevation of the existing operation with dirt hauled to the premises. The expansion is occurring as the additional area is needed for current operation. As the area is filled, the fencing will be advanced on both the west and the south side of the property. Fencing has been recently added to accommodate current expansion. Once the storage area is extended to the property boundary, a wooden fence or other screening will be installed on the west end. A chain link fence will be used temperarly for security purposes. The wooden fence has been and will be constructed by placing 1 x 8 boards vertically along the property boundary. The minimum height will be eight feet. The fence will be supported by either treated wooden posts and by the use of trailers aligned end to end just inside the fence. The salvage yard buys or accepts cars which gave been abandoned or no longer run. They strip usable parts from the vehicle for resale, crush the remaining auto bodies and ship them to a recycling center. The salvage yard also takes in appliances, lawn mowers, bikes and any metal that can be crushed and recycled with the vehicles. On site crushing and shipping occurs at least twice a year. As demand and salvage activity increases, we may need to crush and ship more frequently. The impact statement shall address the following: (A) Existing lawful use of water through depletion or pollution of surface runoff, stream flow or ground water. The salvage yard expansion will not require any additional water or impact the ground water. The gas left in the vehicles is used in the salvage operation vehicles. Any oil products reclaimed from the vehicles are stored and shipped to a refinery for recycling. Spangler's has been issued all sort of permits already, including from the Army Corps of Engineers regarding reclaiming the West end land and putting it to use; for monitoring ground water under DMTRA; and from Colorado Department of Public Health and Environment for a stormwater discharge permit as an auto recycler. (B) Impacts on adjacent land from the generation of vapor, dust smoke, noise, glare or vibration, or other emanations. There have been no complaints regarding vapor, dust, smoke, noise, glare or vibration, or other emanations from Spangler's Auto Salvage. The proposed extension would not cause any increases in vapor, dust, smoke, noise, glare or vibrations or other emanations. (C) Impacts on wildlife and domestic animals through creation of hazardous attractions, alteration of existing native vegetation, blockage of migration routes, use patterns or other disruptions. Wildlife The wildlife in the expansion area consists of small mammals, mostly rodents, and birds, such as blackbirds and /or starlings. The expansion is occurring into irrigation -created swamp area uninhabited by wild foul or other wildlife. No large mammals are impacted by the expansion. Domestic Animals The area will be fenced to keep domestic animals from entering onto the property. �3 (D) Impacts of truck and automobile traffic to and from such use and their impacts to areas in the County. All truck and automobile traffic associated with the salvage operation will exit Highway 6 24 to the operation. The traffic is not expected to increase or decrease except as normal business operations increase or decrease. The traffic patterns will remain the same as the existing patterns once the expansion is completed. This traffic will not create hazards or be a nuisance to areas elsewhere in the county. (E) Sufficient distances shall separate such use from abutting property which might otherwise be damaged by operations of the proposed use. Distances between the existing salvage yard and abutting uses will not change with the expansion of the storage area. The area to the east is the existing salvage yard. The use directly north of the area to be expanded onto is the sewage treatment plant for the Cottonwood Trailer Park. To the west of the expansion area is the access road to Cottonwood trailer Park and to the south is Highway 6 5 24. (F) Mitigation measures proposed for all of the on going impacts identified above and in section 5.03.08. Mitigation measures are described in the narrative above and in the narrative section following, as it relates to each impact discussed. (2) Permits may be granted for those uses with provisions that provide adequate mitigation for the following: (A) A plan for site rehabilitation must be approved by the County Commissioners before a permit for special use will be issued. The entire land area of Spangler's Auto Salvage is planned as a salvage yard. Should unforeseen events occur, all the salvage items would be sold or shipped to a recycling center, the fence removed and all waste material appropriately disposed of and the area seeded with grasses to return the land to its pre-existing use as pasture land. a (B) The County Commissioners may require security before a permit for special use is issued. As applicant has been conducting his successful salvage yard business for more than 10 years from this site, where salvage operations began in the late 1940's; and since Applicant is gradually expanding his pre-existing salvage yard use, using applicant's own labor, equipment and supplies; Applicant requests that no security requirements be imposed in conjunction with issuance of the special use permit. s -a5 - 5.03.08 Industrial Performance Standards: All industrial operations in Garfield County shall comply with applicable County, State and Federal regulations regulating water, air and noise pollution and shall not be conducted in a manner constituting a public nuisance or hazard. Operations shall be conducted in such a manner as to minimize heat, dust, smoke, vibration, glare and odor and all other undesirable environmental effects beyond the boundaries of the property in which such uses are located, in accord with the following standards: (1) Volume of sound generated shall comply with standards set forth in Colorado Revised Statutes. Existing volume complies with these standards. No changes in the operation are planned as a result of the expansion which would change the amount of noise generated at the site. No complaints regarding noise have been received. (2) Vibration generated: every use shall be so operated that the ground vibration inherently and recurrently generated is not perceptible, without instruments, at any point of any boundary line of the property on which the use is located. Vibrations caused as a result of the salvage operation are negligible and are not felt on adjacent properties. (3) Emissions of smoke and particulate matter: every use shall be operated so as to comply with all Federal, State and County air quality laws, regulations and standards. Emissions of smoke and particulate matter ar negligible. No changes in the operation are planned which may cause smoke and particulate matter to be emitted. (4) Emission of heat, glare, radiation or fumes: every use shall be so operated that it does not emit heat, glare, radiation or fumes which substantially interfere with the existing use of adjoining property or which constitutes a public nuisance or hazard. Flaring of gases, aircraft warning signals, reflective painting of storage tanks, or other such operations which may be required by law as safety or air pollution control measures shall be exempted from this provision. There are no emissions of heat, radiation, fumes, or glare from the salvage yard. Any light reflection off the vehicles being stored on the site will be blocked by the wooden fence surrounding the storage area. The proposed expansion will not necessitate any changes in the operation. (5) Storage area, salvage yard, sanitary land -fill and mineral waste disposal areas: (A) Storage of flammable or explosive solids or gases, shall be in accordance with accepted standards and laws and shall comply with the National Fire Code. Flammable liquids, such as gasoline and oil, are stored in steel containers. The gasoline obtained from salvaged vehicles is burned and consumed in the salvage yard equipment. Any used oil from the salvaged vehicles is stored in steel barrels for shipment to a waste oil reclaiming center. To contain any oil spillage, Spangler's Auto Salvage have placed the steel barrels in a 2'x 6' round horse trough. The impoundment will have a volume large enough to hold the oil if a spill or leak were to occur. (B) At the discretion of the County Commissioners all outdoor storage facilities for fuel, raw materials and products shall be enclosed by a fence or wall adequate to conceal such facilities from adjacent property; Fuel is addressed in (A) above. There are no raw materials or on site manufactured products involved in the salvage operation. Outdoor storage facilities are enclosed by a 8 foot fence on the east and south side of the property and a 6 foot fence on the north side near Cottonwood Trailer Park. The west end of the property will be enclosed with a 8 foot fence or other appropriate screening when expansion is completed. (C) No materials or wastes shall be deposited upon a property in such form or manner that they may be transferred off the property by any reasonably foreseeable natural cause or force. All salvage materials are and will be contained within an area with a 8 foot fence around it. The 8 foot fence and the nature of the materials, prevent materials from being transferred off the property by any reasonably foreseeable natural cause or force. (D) Storage of heavy equipment will only be allowed subject to (A) and (C) above and the following standards: 1. The minimum lot size is (5) acres and is not in a platted subdivision. The lot size is nine (9) acres and is not in a platted subdivision. 2. The equipment storage area is not placed any closer than 300 ft. from any existing residential dwelling. Equipment used in the salvage operation on site is placed further than 300 feet from any existing residential dwelling, except (at times) as to applicant's dwelling. 3. All equipment storage will be enclosed in an area with screening at least eight (8) feet in height and obscured from view at the same elevation or lower. Screening may include berming, landscaping, sight obscuring fencing or a combination of any of these. Equipment used in the storage operations on site will be enclosed in compliance with the foregoing. 4. Any repair and maintenance activity requiring the use of equipment that will generate noise, odors or glare beyond the property boundaries will be conducted within a building or outdoors during the hours of 8 a.m. to 6 p.m. Monday thru Friday. Any such repair and maintenance activity will be conducted in compliance with the foregoing. 5. Loading and unloading of vehicles shall be conducted on private property and may not be conducted on any public right-of-way. (A.97-60) Loading and unloading of vehicles are conducted solely on site completely off of any public right -o£ -way. 6. Water pollution: in a case in which potential hazards exist, it shall be necessary to install safeguards designed to comply with Regulations of the Environmental Protection Agency before operation of the facilities may begin. The salvage yard and proposed expansion have not and are not expected to impact surface or ground water; nor do any other water pollution hazards exist. Spangler's has been issued permits for monitoring ground water under UMTRA; and from Colorado Department of Public Health and Environment for a stormwater discharge permit as a auto recycler. 5.03.10 Approval of Special Uses: Where uses are listed as Special Uses, they shall be permitted only: (1) Based on compliance with all requirements listed herein, and; (2) Approval by the County Commissioners, which Board may impose additional restrictions on the lot area, floor area, coverage, setback and height of proposed uses or require additional off- street parking, screening fences and landscaping, or any other restriction or provision it deems necessary to protect the health, safety and welfare of the population and uses of the neighborhood or zone district as a condition of granting the special use. Applicant has addressed all potential impacts and mitigation thereof resulting or anticipated to result from expanded salvage yard operations. No additional restrictions, requirements or provisions need to be imposed to protect the health, safety and welfare of neighborhood population or neighborhood uses as a condition of granting the special use. 5.03.11 Denial of Special Use: The County Commissioners may deny any request for special use based on the lack of physical separation in terms of distance from similar uses on the same or other lots, the impact on traffic volume and safety or on utilities or any impact of the special use which it deems injurious to the established character of the neighborhood or zone district in which such special use is proposed to be located. The expanded salvage yard operation is part of and merely a physical expansion of the same use now occurring on-site of the subject property. As mitigated, there are no negative impacts on traffic volume or safety, or on utilities, or in any other manner injurious to the established character of the neighborhood or zone district. Although property is zoned C/G (Commercial General) under BOCC resolution #92-031,many uses in the area are of an industrial and heavy commercial nature, including over-the-road trucking, rock crushing, concrete & asphalt batch plants, portable toilet facility, several gravel pits, and buiilding materials/supplies yard. Salvage yard operations were in place long before a county zoning resolution or other neighborhood uses. 5.03.12 Access Routes: All conditional uses and special uses must be provided with access routes of adequate design to accommodate traffic volume generated by the proposed use and to provide safe, convenient access for the use constructed in conjunction to the proposed use. The minimum design standards shall be the Garfield County Road Specifications. Access to the salvage yard is from U. S. Highway 6 & 24. No new accesses are required or planned. All accesses are in place for the existing operation and for any expansion for the existing operations. The current access roads within the facility are adequate for emergency vehicle access and efforts should be 'inade to maintain this access in the future. 3. Excess fluids froom salvaged vehicles should continue to be disposed of in a safe manner. It appears that the County's primary concern is in regards to the availability o(.water for fire protection. Although the District shares this same concern for the entire area, as stated above, the changes at this facility, are not substantial enough to require the extension of water mains to the area. In addition, it is questionable if water service extension would be available at this time. In the mean time, Spangler's Auto Salvage appears to have recognized this problem and have made efforts to have the equipment available to utilize the water from the irrigation ditch running through die property for fire protection use. His business operations included retrieving abandoned or junked vehicles, usually with a wrecker; storing them temporarily on premises; stripping vehicles of useable parts; then arranging for crushing and hauling away of the remaining vehicle shells and unusable parts. 6]. At times he would lease and use additional land in the vicinity of the salvage yard, as an adjunct to and part of his salvage yard operations. He understands this additional land is no longer available to the present owners of Spangler's Salvage Yard. 7]. The entirety of the land area of the 9 -acre tract was used in the storage, crushing and parts inventorying aspects of his business operations, as the scope and amount of business warranted, except for the irrigation -created swampland to the far west end prior to fill-in. He intended to be able to use as needed the entirety of his land in his salvage yard business. He in fact would use fill dirt from near the area mentioned in 16 above, to fill in the swamp areas to make more useable ground, as his operations expanded and moved westerly across his property. 8]. We have enclosed an Annual Report form, a Discharge Monitoring Report (DMR) form, a list of the parameters for which you need to sample, and a guidance document on sampling. Permit Certification If you refer to your permit certification, you will note that at the end of the first page it specifies your coverage by monitoring requirements, and refers to a section of the permit. Your certification should state that monitoring requirements apply as outlined in Part I.D.1.a - Automobile Recyclers. Sampling Requirements The sampling requirements themselves are spelled out in the permit as referenced. Also, Part I.D.2, page 12, lists some additional sampling requirements in terms of how to sample, what type of storm event must be used, and what measurements of the storm event itself must be taken. These are also explained in the enclosed sampling guidance document. The fust round of samples should be taken between now and 9/30/98*, and reported to our office with your next Annual Report. Given that the weather does not always cooperate, it may not always be possible to get a sample during business hours. This will not be considered an adequate excuse for not having sampled. This expansion would be towards the entrance wav of our oark.which may eventually border it. It would take away the vegetation which now gives us some natural blocking from it. Also,effecting the bird life many of us enjoy. We moved our childrens bus stop off the county road to below our guest parking area for safety reasons.now if this goes through they will be picked uo behind a salvage area which could turn into a breeding ground for mice and bee's nest.be- sides being an eye sore of old rusty material which we all would have to put up with. Would any other community up and down this valley allow something like this to go through. To devalue our homes and the wav others see our family's. Visitors or other family members coming to visit us would turn into a place which we don't believe thev would refer as a salvage area.they may think of it as something else. The management and families of Cottonwood have put an enormous amount of effort into making this place much more nicer to live. We are happy also to meet with the planning department prior to the P&Z meeting next week if you think it would be expeditious to discuss terms and conditions of granting special use approval for the Salvage yard. As expressed at the previous hearing, some of your suggested conditions appeared redundant, others unnecessary, and most acceptable to Spangler. We understand of course it is up to the Board of Commissioners to make a final decision on appropriate conditions to be imposed if approval is granted. At the suggestion of the county attorneys' staff, and we thought with thessing of Mr. Bean, county planner, the application covers all the unoccupied land of Spangler's Auto Salvage, and not just the 1 acre covered by a previous §404 Army Corps of Engineers permit. The thought here is that it is unpredictable to determine when additional space is needed; and it is a more efficient use of human and tinancial resources to address permitting for the entire acreage, In the pending application, instead of requiting piecemeal submittals. Of course, all other required permits must be in place, and other county regulations would apply, as expansion occurs. To reiterate our reaction to your recommendations, items 1,3 and 5 are fine; item 2 needs rewording; the county does not need to be involved in items 4 and 8, which are otherwise acceptable to applicant; item 6 is already addressed in the application; and the fencing matter, item 7, we cover in detail in the enclosed ADDITIONAL MITIGATION PROPOSALS. Spangler ADDITIONAL MITIGATION PROPOSALS, SPANGLER'S AUTO SALVAGE SPECIAL USE PERMIT APPLICATION FENCING / SCREENING Starting on the West end of filled in area we would put an 8' board fence up going from South to North stopping at the grand river ditch. The West end fence would be constructed so eventually it could be moved to the West end next to the roadway leading into Cottonwood, as we are able to expand into the west area of our property. In the spring we would plant trees along the Cottonwood Springs road going into the mobil home park on the East side of the road, West end of our property. All of these activities are subject to meeting any permitting requirements from Army Corps of engineers, and the practicalityjplanting trees in wetland areas. See attached letter of December 24, 1998. As time goes on we would remove portions of the existing tin fence on the South side of our property and replace it with an all wood fence until it is all wood along Hwy 6 & 24. For safety and security purposes, we prefer no additional fence in front of the office and driveway, or around the residence and impound yard (which has an existing chain link fence). Any fence replacement work near the North side of our property should be done by Cottonwood Springs Mobile Home Park, which installed the existing 6' wooden fence a few feet N3tth of the ditch (the physical boundary separating the two ownership tracts). An extension of their wooden fence provides a visual buffer separating the mobile homes in Cottonwood Springs from the Cottonwood Springs sewage treatment lagoons and facilities. Any replacement fencing should be put where the existing fence is located, so that any maintenance on the ditch can be done from the South side of the ditch as Spangler's Auto Salvage has done in the past. It will take approximately 675'of fencing to replace the tin fence. The board fence on the West end will be approximately 425'long. It will take 1 1/2 boards per foot plus a number of new cross bars and a number of new posts. 1x8x8 boards cost $2.55 each. lx8x10 cost $3.29 each. HAZARDOUS SUBSTANCES AND SAFETY EOUIPMENT We have an antifreeze recycling system. We drain the antifreeze from salvage vehicles, upgrade it, and sell it to the public. We also have a freon recovery system: two machines to evacuate and one to put it back into the cars. We sellthefreon to shops. This equipment is for environmental protection. We also have a computer wheel balancer and a brake lath for vehicle safety. It cost us several thousand dollars to install these recovery systems. Kenneth G. Spangler, owner of Spangler's Auto Salvage, and his son who works there, are both fully trained and licensed to operate the evacuation and recovery procedures. RECYCLING OF SALVAGE MATERIALS The price of metal has dropped $34.00 a ton since we last crushed in August 1998. We were going to have a crusher brought in this winter but it was going to cost $1200.00 plus the fuel. The crushing company is the one that pays the freight to bring it in usually, but since we were going to crush and let the crushed material sit until the price went up we would have to pay the freight to get it here and back. We decided that we could buy a lot of boards with the money. As always we will crush at optimum market times and when necessary to prevent unreasonable accumulations. For the crusher to come in so it is financially feasible we have to have approximately 200 cars plus all the other salvage. When we acquired the computer for the yard in October of 1996, we put all incoming cars in the computer. We found that we could not put into the computer every car that came in, because of computer space. We began putting in only the ones that we plan on using for stripping and salvage. Many other abandoned vehicles are not included in the computer, but we haul them to Spangler's Auto Salvage and they go directly to the crush area.The number of cars that we have taken in for 1998 is a lot more than what the computer shows. We have taken in 311 according to the computer. For the past years we estimate we average one new vehicle per calendar day into Spangler's Auto Salvage. Everything that is 1980 and older is going straight to the crusher unless it is a vintage type car. SUGGESTED CONDITIONS OF APPROVAL - SPANGLER'S AUTO SALVAGE 1. All representations of the applicant, either within the application or stated at the meeting before the Planning Commission, shall be considered conditions of approval. 2. The Special Use Permit shall be issued only by approval of the Board of County Commissioners, subject to conditions being met in a timely fashion, and shall expire 180 days after issuance unless the operation has begun. Extensions can be granted by the Board of County Commissioners. 3. Applicant shall obtain approval and periodic inspection by the Rifle Fire Protection District for compliance with any applicable regulation regarding the storage of combustible material. 4 Applicant shall provide proof of adequate emergency water for the purposes of fire suppression to the satisfaction of the Rifle Fire Protection District. 5. Applicant shall remain in compliance with any state or federally mandated requirements regarding the storage, discharge or release of known toxic or nontoxic materials which may be associated with the use. 6. Applicant shall undertake the fencing/screening plan outlined in the ADDITIONAL MITIGATION PROPOSALS presented to the Planning Commission; and shall pursue completion of same acting diligently under the weather conditions, financial capabilities and permitting conditions which exist over the course of implementation of the plan. 7. Applicant shall provide as required the Annual Report and DMR form to the State Water Quality Control Division.
