SITE DATA: 1.78 acres WATER/SEWER: Well/ ISDS ACCESS: C.R. 167 EXISTING AND ADJACENT ZONING: R/L/SD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The property is located in the Low Density Residential (10 and greater ac./du) land use district, as designated on the Garfield County Comprehensive Plan Proposed Land Use Districts, Study Area 1. The designation is due primarily to the Roaring Fork floodplain. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The subject property is a relatively flat parcel along the Roaring Fork river. There is an existing single family dwelling on the property, that is the applicants primary residence. There appears to be a site that was previously occupied by a structure toward the front of lot. B. Development Proposal: The applicants are requesting a Special Use Permit for a guest house. There is no stated purpose for the guest house. The proposed guest house is to be 24' x 24', one bedroom unit. The guest house will utilize the existing ISDS and well. Access will be directly off of CR 167, via an existing driveway. (See site plan pg. q ) III. MAJOR ISSUES AND CONCERNS 1. Section 2.02.285 of the Zoning Resolution defines a guest house as an "Accessory, detached building, which is designed and used to house nonpaying visitors and guests of the occupants of the main building of the site." 2. Section 5.03.025 specified that the "Use of a structure as a guest house must meet the following conditions as well as all other standards applicable to residential use: "(1) The gross floor area or the area used for residential occupancy shall not exceed one thousand (1,000) square feet; "(2) The minimum lot size shall be fifty percent (50%) larger than the minimum required for a residential use in the same zone district; and "(3) The length of stay of a guest shall be limited to thirty (30) days, unless said guests are the grandparents, parents, siblings or children of the occupants of the primary structure." 3. The proposed guest house consists of a one (1) room cottage, having approximately 576 square feet in floor area. 4. The applicants' property is 1.78 ac., which is more than 50% larger than the 20,000 sq. ft. minimum lot size of the R/L/SD zone district. 5. The applicants will have to obtain a Building Permit for the guest house. This permit will have to be obtained, the building inspected and certified for residential occupancy prior to any residential use. 6. The guest house is to be served by an existing septic tank/leach field system. This system was originally designed for a three bedroom mobile home that previously occupied the property. 7. The applicants have a well to serve the property that is permitted f r two single family dwellings and a maximum of 15 gpm. ( See permit pg. ) This is sufficient to serve both residences. IV. SUGGESTED FINDINGS 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at the hearing. 3. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. 4. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, subject to the following conditions: 1. All proposals of the applicant shall be considered conditions of approval unless stated otherwise by the Board of County Commissioners. 2. The applicant shall have 180 days from the date of the Resolution of Conditional Approval to meet all conditions set forth in the Resolution. 3. The length of stay of a guest shall be limited to thirty (30) days unless said guests are the grandparents, parents, siblings or children of the occupants of the primary structure. The residence cannot be used for rental purposes. 4. The issuance of the permit does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested water right from seeking relief in a civil court action. 2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors in accordance with Rule 18. 3) This well is recorded, and permit approved, in accordance with CRS 37-92-602(5) for historic use as indicated herein and described in CRS 37-92-602(1)(b), being a well producing 15 GPM and used for ordinary household purposes inside one (2) two single family dwellings, and NO OUTSIDE USES other than fire protection. 4) The date of first beneficial use, as claimed by the applicant is Summer 1964.
