Charles Ryden A parcel of land located in the SE 1/4, SE 1/4, Section 16, T5S, R91W; more practically described as a parcel located approximately 3 1/2 miles northwest of New Castle off of County Road 245. ACCESS: County Road 245 ZONING: Agricultural/Residential/Rural Density I. PROJECT DESCRIPTION It is proposed to allow the continued storage of oil and gas drilling equipment on the applicant's land for an indefinite period of time. The equipment stored includes 14,000 ft. of 5 inch drill pipe, drawworks, three 600 h.p. diesel engines, two 1000 h.p mud pumps, a rotary table, a 142' mast, generators, lines, various storage tanks and other related drilling equipment. All of the equipment is stored in an area approximately one acre in size just off of County Road 245. The site is partially screened by vegetation adjacent to the road and is not visible except for a short distance when a person drives by the site. Due to the slowdown in oil and drilling activity, the applicant's tenant (Parker Drilling Co.) is uncertain how long the site will be used for storing the equipment. History: In September of 1985, Louisiana Land and Exploration Co. received approval for a natural gas well on a tract of land at the intersection of County Roads 245 and 243. After completing the drilling operation, Parker Drilling Co. moved all of the drilling equipment to the Ryden property for storage. In the process of moving the equipment, substantial damage to County Road 245 occurred as a result of the heavy vehicles moving in and out of the site. Subsequently, Louisiana Land and Exploration reimbursed the County for expenses related to repairing the road. It was also determined that the storage of oil and gas drilling equipment was not an allowed use in the A/R/RD zone district. Subsequently, Resolution No. 86-106 was approved, allowing the storage of oil and gas drilling equipment as a special use in the A/R/RD zone district. II. ISSUES AND CONCERNS 1. In conversations with the Road and Bridge Department, the major concern is related to the impact of the heavy equipment being moved across County roads during certain times of the year. At a minimum, the applicant's tenant should be required to notify the County Road and Bridge Department at least five (5) days prior to the movement of any equipment off of the site. The Road and Bridge Department should have the ability to deny the right to move the equipment if it is determined that the road conditions would not withstand the movement of heavy vehicles at that time. In addition, a bond or some other acceptable form of security be placed with the County in an amount equivalent to $16,000 per mile for cash or $20,000 per mile for surety for the 3.7 miles of chip and seal surface on County Road 245. The amounts would be $59,200 cash or $74,000 surety. Normally, the road security is placed with the County prior to issuance of the Special Use permit. The Parker Drilling Co. would prefer not to place road security with the County at time due to the indefinite time for storage of the equipment. If the Board agrees with this, an agreement should be signed by Parker Drilling Company and the County which defines the terms under which Parker Drilling Co. will be able to move the equipment off of the site and what form of security is acceptable. 2. As noted previously, the storage site is partially screened by vegetation and not visible for long distances along County Road 245. A typical condition of approval would require site obscuring fencing around the site. In this case, the existing vegetation serves this purpose. III.SUGGESTED FINDINGS 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. IV. RECOMMENDATION APPROVAL, subject to the following conditions: 1. That prior to moving any equipment from the site, Parker Drilling Co. will notify the Garfield County Road and Bridge Department five (5) working days in advance of the intended move. Further, that the Road and Bridge Department may delay the moving date if it is determined by the Department that the road could be damaged as a result of the proposed move. 2. That Parker Drilling Co. enter into a written agreement with Garfield County that guarantees that Parker Drilling Co. will be responsible for paying for damage to County roads caused by the moving equipment stored on the Ryden property and that prior to any move, a $59,200 cash bond or $74,000 surety bond will be placed with the County. 3.
