Box 422 Glenwood Springs CO 81601 RE: Notice of Violation Dear Mr. Capp and Mr.Danner: Certified # Z 294 186 252 This Notice of Violation is the result of conditions observed and documented at the South Canyon Landfill during an inspection made on December 2, 1997. Donna Stoner of the Hazardous Materials and Waste Management Division (the Division) of the Colorado Department of Public Health and Environment visited your facility located approximately six miles west of Glenwood Springs and south of 1-70 in Garfield County. The purpose of this inspection was to evaluate a complaint of uncontrolled leachate entering South Canyon Creek and assess the status of the facility with respect to compliance with the Solid Waste Disposal Sites and Facilities Act, Title 30, Article 20, Part 1, C.R.S. as amended and with the regulations promulgated thereunder 6 CCR 1007-2 (the Regulations). As a result of the inspection the Division has determined that the South Canyon Landfill facility is in violation of the following: Notice of Violation Mr. Capp and Mr. Danner December 26, 1997 Page 2 1) Leachate from both the historical and current landfills continues to flow uncontrolled into South Canyon Creek. The Notice of Violation dated March 26, 1997 and field notes from a site visit May 9, 1997 documents the leachate flow as an on-going problem at the facility. This is a violation of subsections 2.1.4 and 2.1.6 of the regulations. My inspection letter of August 4, 1993 :informed you of the need for a discharge permit from the State's Water Quality Control Division. 2) Both the demolition debris and municipal trash piles were very large and uncovered. The operator stated that the trash is not always covered at the end of each working day. Failure to cover trash daily is a violation of subsection 2.1.10. The same observation was noted in inspection letters dated September 22, 1992, August 4, 1993 and in the Notice of Violation dated March 26, 1997. 3) Windblown trash was observed on a nearby hillside as well as in a number of ditches near the municipal landfill area. This is in violation of subsections 2.1.3 and 2.1.11 of the Regulations. 4) The septage impoundments exceed the two feet freeboard limit and are near the overflow point. This is a violation of subsection 9.5.4. This was also documented in the Notice of Violation dated March 26, 1997 and the field notes from a site visit May 9, 1997. 5) The facility did not have a Certificate of Designation (CD) on the day of inspection as is required in section 1.6. It is understood that the (CD) was issued December 15, 1997 by Garfield County. Please provide a copy of the (CD) and the County's Resolution to the Department. 6) In addition to the above items noticed during the December 2, 1997 inspection, as of December 22, 1997 there has not been a financial assurance instrument with associated closure and post -closure costs filed with the Department, which is in violation with section 1.8 of the regulations. Notice of Violation Mr. Capp and Mr. Danner December 26, 1997 Page 3 This NOTICE OF VIOLATION fulfills the Division's requirements to notify the facility operator and the governing body having jurisdiction of the determination of violations per section 1.9.3 of the Regulations. Per section 1.9.5 of the Regulations, Tadco Disposal Systems Inc. and the City of Glenwood Springs has thirty (30) days to respond in writing to this NOTICE OF VIOLATION. Failure to do so may subject both Tadco Disposal Systems Inc. and the City of Glenwood Springs to remedies as provided in the Act and the Regulations. The Division appreciates the fact that you are making efforts to address many of these issues. The proposed leachate collection and containment system as well as the plan to eliminate the septage impoundments should improve operations. However, we are dismayed at the current state of the facility with regard to daily operations and the lack of temporary leachate containment in order to maintain compliance at the facility. BOX 422 k Aa�a -5375 GLEN 00D SPRINGS, CO 8160 D 317 JAN 14 1998 Donna Stoner Solid Waste Unit, °Compliance Program State of Colorado 222 South 6th Street, Room 232 Grand Junction, Colorado 81501-2768 Re: Notice of Violation letter dated 12/26/97 Dear Mrs. Stoner: In reply to the 1) Leachate violation: January 9, 1998 GARFIElD COUNTY COMMISSIONERS The plan to cure this violation has been approved by the State of Colorado Health Department in written form and work to remedy this problem is scheduled to begin Spring of 1998 and to be completed by October 1, 1998. 2) Open face of Construction Demolition and Municipal Waste pile too large: The Municipal Waste pile has been covered with minimal working face open. The Construction Demolition pile is being covered to the point where only the face in actual use will be exposed. 3) Wind blown trash: Rubbish that has blown into ditches is being cleaned up. We feel by covering the municipal piles more speedily and thoroughly this will help to ease the problem. 4) Septage impoundment near overflow: To cure this, a drudging machine will be brought in this month to start drudging the ponds. The sewage will be also used in the composting operation. All ponds are to be emptied and reclaimed to natural ground. TADCO DISPOSAL SYSTEMS, INC. dba SOUTH CANYON LANDFILL •- P.O. BOX 422 �:a=�• 4"T; GLENWOOD SPRINGS, CO 81602 ~ 4:- PH. 945-5375 Page 2 5) No Certificate of Designation: As of December 15, 1997 the Garfield County commissioners have issued a Certificate of Designation for South Canyon Landfill with all improvements to be completed by October 1998. 6) No financial Assurance Program in place: This Trust account was opened April 7, 1997, with copies sent to Glen Mallory, Sub Title D Trust Fun Deposits; Colorado Department of Health and Environment; 4300 Cherry Creek Drive South Denver, CO 80222-1530. Deposits have been made as required on a quarterly basis. Enclosed you will find copies of Tadco's Financial Assurance Trust Fund with the Bank of Cherry Creek in Denver.
