Box 370 Parachute, CO 81635-0370 970/285-9377 970/285-9573 fax RECEIVED APR 01 2009 GARFIELD COUNTY BUILDING & PLANNING Re: Notice of Violation dated February 20, 2009 ("Notice of Violation" Ladies and Gentlemen: Williams Production RMT Company ("Williams") is in receipt of the captioned Notice of Violation regarding the Special Use Permit for an "Industrial Support Facility" located at 431 County Road 246 (the "Rulison Facility SUP"); as well as the follow up Notice of Violation issued on March 23, 2009. Please be advised that Williams has vacated the Industrial Support Facility until such time that Williams receives confirmation of an approved Special Use Permit. from Garfield County. The Notice of Violation states that the Rulison Facility SUP was approved subject to certain conditions, and Williams has not yet submitted the information requested in condition numbers 4, 6, 8, and 11-14 of Garfield County Resolution No. 2007-62. Last year, on August 22, 2008,1 sent to Garfield County Building & Planning Department a letter with attachments; which Williams believed was responsive to the requested information for each of these conditions. 1 have attached, as Exhibit A, a copy of my August 22, 2008 with the original. attachments. On March 121h, 2009 we submitted an email with all supporting documentation to address the counties concerns to Mr. Chappelle, Mr. Anthony, Mr. Pesnichak, and Mr. Jarman. I have attached a copy of this email, as Exhibit B. In addition; 1 will further address each of these outstanding conditions below. 1. Condition #4: The Applicant shall provide a Revegetation and Rehabilitation Plan that has been reviewed and accepted the County Vegetation Department prior to approval of the Special Use Permit. Williams provided a Revegetation and Rehabilitation Nan to Mr. Steve Anthony in the Garfield County Vegetation Department on March 10, 2009. This plan was extracted from section 5.03.07 2(A) of the original SUP submitted to Garfield County dated February 2006. In addition. I spoke with Mr. Anthony on March 9, 2009 and again on March 10, 2009, with two additional - Williams employees, Mr. Mike Shoemaker and Ms. Dasa Bryan on the call. On March 12, 2009, via email, Williams provided to Chris Chappelle, Steven Anthony, Dave Pesnichak and Fred Jarman, a copy of -our Rehabilitation Plan. See attached Exhibit C; copies of email correspondence dated March 10th 2009 to Mr. Anthony are attached hereto as Exhibit D. 2. Condition #6: The Applicant shall provide a dust control plan to be reviewed and accepted by County Staff prior to the issuance of the Special Use Permit. Should dust become and issue from thelti age area, a dust control agent shall be applied toij C? the area. On March 12, 2009, via a '1, Williams provided to Chris Chappelle, Steven Anthony, Dave Pesnichak and Fred J an, a copy of Williams' Rulison Industrial Support Facility Dust Control Plan. - Attac d is a copy of this Dust Control Plan noted as Exhibit E. In addition, as stated in the eh 12 email, Williams has had for a number of years a blanket bond with Garfield ounty Road & Bridge Dept that covers all maintenance and repairs on roads in Garfield County. -On an annual basis Williams treats the road with magnesium chloride and waters all roads, especially if requested by contiguous landowners, If needed, Williams will provide a copy of our bond with the Road & Bridge Dept to you. 3. Condition #8: A 2500 gallon water storage tank shall be installed at the proposed facility for initial fire suppression purposes. A plan including the 2500 gallon water storage tank for initial fire suppression shall be reviewed and accepted by the relevant fire protection district prior to issuance of the Special Use Permit. Williams installed a 2500 gallon water storage tank on October 10th, 2007. A Williams' employee, Mr. Brain Covington, met with the Rifle Fire Protection District at the Industrial Support. Facility for an onsite inspection and Rifle Fire Protection District approved the tank on March 10, 2009. The March 12, 2009 email provided to Chris Chappelle, Steven Anthony, Dave Pesnichak and Fred Jarman a copy of the Rifle Fire Protection District Safety Survey Form dated March 10, 2009 approving the tank. Another copy of the Rifle Fire Protection District Safety Survey Form dated March 10, 2009 is attached hereto as Exhibit F. Mr. Kevin Whalen of the Rifle Fire Dept is not requesting Williams to submit a fire suppression plan for this modular office. c' � r `) 4. Condition #9: The barrow ditches and settling pond ihauo�e placed down gradient from the development area in order to collect storm water runoff from the development. An illustrative storm water management plan shall be submitted to the Garfield County Planning Department and reviewed by the Garfield County Engineer prior to issuance of the Special Use Permit. On March 12, 2009, via email, Williams provided to Chris Chappelle, Steven Anthony, Dave Pesnichak and Fred Jarman, a copy of the illustrative stormwater management diagrams for the Rulison Industrial Support Facility. These diagrams are from the Williams Construction Field Wide Stormwater Management Plan for the Rulison Field. The plan was developed to cover activities occurring under CDPHE. CDPS General Permit COR -030000 Certification Number CQR038543. A barrow ditch and settling pond have been installed below the Southwest and the Southeast portions of the pad in order to control Stormwater runoff while not interfering with the existing septic system. Attached diagrams labeled Exhibits G, H and I these exhibits show the placement of the Stormwater BMPs. The diagrams were previously sent in February, 2009 and depict the location of the two (2) barrow ditches and the ponds for our storm water control. 5. Condition #11: The Applicant shall submit plans to treat and maintain the treatment system for all water to be used from the Colorado River to meet the State of Colorado standards for potability. These plans shall be reviewed and accepted by the Garfield County Engineer and Garfield County Public Health Department prior to issuance of the Special Use Permit. Williams is not using, nor has any plans to use water from the Colorado River. All potable water used at this facility is trucked by Anchor Drilling Fluids/Toby's Vacuum Services. See Exhibit J- This letter was also provided in the March 12, 2009 email. 6. Condition#12: the Applicant shall submit and approved Storm Water Management Plan from the State of Colorado prior to issuance of the Special use Permit. In addition the Applicant shall submit a site grading plan to be reviewed and accepted by the Garfield County Engineer prior to issuance o e Special Use Permit. • • • Williams' Certification to Discharge under COPS general permit COR -03000 is attached hereto as Exhibit K. This information was previously provided in the March 12th email along with the Rulison Support. Facility Site Rehabilitation Plan, attached as Exhibit L. 7. Condition #I3: The Applicant shall provide a security for revegetation in the amount of $8,000 to cover the estimated 2 acres to be disturbed prior to issuance of the Special Use Permit (using a rate of $4,000 per acres for a facility that may be in place for 20 years). The security shall be held by Garfield County until vegetation has been successfully reestablished according to the Reclamation Standards in the Garfield. County Vegetation Management Plan. The revegetation Bond, #6577827 was sent via federal express, to Garfield County Building and Planning Department. Our records indicate Garfield County received this bond on March 23"d, 2009. A copy of this bond is also attached hereto as Exhibit M. 8. Condition #14: The Applicant shall provide a current inventory and map of County listed noxious weeds and weed management plan for any inventoried weeds prior to issuance of the Special Use Permit. These documents shall be reviewed and accepted by the Garfield County Vegetation Management Department prior to issuance of Special Use Permit. A copy of the Williams Noxious Weed Management. Program is attached as Exhibit N. At the end of this program is a site specific provision for the Rulison Industrial Facility, as follows: Site Specific Weed Control Plans for the Industrial Support Facility The industrial support facility will receive an annual bare ground treatment on the graveled area to suppress weedy species growth. The non graveled area surrounding the facility will be monitored annually for noxious weed species and they will be chemically treated at appropriate times. In addition, attached as Exhibit 0 is a one page diagram that sets forth the Noxious Weed Inventory. Williams is anxious to resolve this issue with Garfield County and would appreciate being advised as to whom in Building and Planning Department has been assigned to this matter. Sincerely, Williams Production RMT Company Sandy Hotard CPL Field Land Manager Attachments • Williams Noxious Weed Management Program Noxious weed infestations may occur on lands that fall within Williams Production (Williams) lease boundaries. These areas include well pads, lease roads, disturbed sites, reclaimed sites, and some undisturbed areas. In order to minimize impacts that may result from the presence of noxious weeds, improve reclamation success, and ensure good land stewardship, Williams had adopted the following Integrated Noxious Weed Management Plan. The Weed management plan is designed to bring Williams into compliance with the Colorado Noxious Weed Act (C.R.S. Title 35, Article 5.5), Colorado ©i1 & Gas Conservation Act, and the Garfield County Noxious Weed Management Plan. Weed Management activities will primarily focus on the Garfield County Noxious Weed List. Williams' Integrated weed management plan will focus on four components of weed management. • Prevention • Inventory and Mapping • Weed Control • Monitoring Prevention - Prevention is a key component of the Williams weed management program. Williams addresses prevention in the planning, development, and operations phases of field development. Williams tries to avoid or limit ground disturbance activities when practical. If ground disturbing activities cannot be avoided, Williarns tries to plan development that will avoid identified weed infestation or areas where weed establishment may be more optimal if this is practical to operations. If ground disturbing activities do occur, Williams uses temporary or permanent seed mixes that help to develop healthy stands of vegetation that can be self sustaining and deter the establishment of invasive species. Inventory and Mapping — Williams uses various means to inventory noxious weeds that fall within its lease boundaries. First, members of Williams Environmental staff are competent in weed identification and note noxious weed occurrences when they are completing field work. Second, the environmental staff works to educate field operations staff to identify weed infestations so that they can also document infestations and inform environmental staff where they are located. If operations personnel are unsure of a suspected infestation, they contact the Environmental staff. The suspected infestation is then investigated before it is documented as an infestation. Third, Williams hires a Certified Weed Applicator to do its bare ground and noxious weed spraying. While the Applicator is conducting their annual spraying activities they document infestations they find. Lastly, many of the lands that Williams operates on are also used for livestock grazing or agricultural purposes and Williams works with the lessees to document weed infestations that the lessees may identify. Weed Control — Williams uses an Integrated Weed Management Approach for the control of identified noxious weed infestations. This is made up of four control methods. These include Cultural, Mechanical, Biological, and Chemical. • • • • Cultural - Cultural control is the use of management practices that will help to favor the growth of desirable species over undesirable species. This establishment is accomplished by using appropriate seed mixes that reflect the surrounding area or species that have been developed and are approved for rapid stabilization of a site. Purchased seed and mulch are certified weed free to decrease the opportunity for noxious weed species to be introduced into disturbed sites. • Mechanical - Mechanical controls methods most often used by Williams include the following. Mowing, tillage, and hand pulling. However, because mechanical methods tend to be fairly labor intensive and cost prohibitive, it is not typically a preferred method but can be used in sensitive areas or areas where topography or other environmental factors may be considered prohibitive. • Biological - Biological Control Methods are the release of organisms that are know to be effective in controlling specific weed species. This method may be chosen if there is a heavy infestation of a specific species on a site. Williams will consult with the Colorado Department of Agriculture Insectary located in Palisade, Colorado when exploring control options. • Chemical - Chemical control is the use of herbicides to control weed populations. This is the primary weed control method used by Williams. Williams annually contracts a Certified Commercial applicator to apply herbicides on lease acreage. Both bare ground and noxious weed applications occur throughout spring, summer, and fall. Williams encourages the use of spot spray application on lease land to ensure vegetation diversity components are maintained. Broadcast applications are only used if a weed infestation is extremely heavy and has created a monoculture in the infested area. The use of appropriate PPE, pesticide storage, pesticide handling, spray mixtures and application rates will occur on Williams lease acreage. Monitoring - Areas where noxious weed infestations are identified and treated will be inspected over time to ensure that control methods are working to reduce and suppress the identified infestation. The sites will be monitored until the infestations are eliminated or reduced to acceptable levels. These inspections will be used to prioritize future weed. control efforts. A site rehabilitation plan was provided in the requirements of paragraph 8 section 5.03.07 2(A) of the SUP date revised 02/2006. The road and facility pad have both been graveled. The road was also treated with mag chloride earlier this spring and watered as needed. This will continue to occur on an annual basis. 8. A 200 barrel water tank has been placed at the facility for fire suppression activities. 9. An illustrative map with installed Stormwater BMP's can be seen on the figure: Site Specific Stormwater Inspection Map. The original SWMP (Exhibit 11) #5 discusses use of burrow ditches and a settling pond in the Northwest corner of the pad. In addition to these BMP's an additional burrow ditch and settling pond have been installed below the Southwest end of the pad. These BMP's were necessary to ensure that the southern portion of the facility had proper Storm water controls. Due to the placement of the septic tank and leech field the originally prescribed burrow ditch and settling pond in the Northwest Corner of the pad could not serve the entire facility area. 11. A plan to treat and maintain the treatment system for all water to be used from the Colorado River was discussed in Requirements of Paragraph 2 A. of the SLAP date revised 02/2006. This facility has been included in the following State of Colorado Storm Water Management Plan (Rulison Field Permit (COR -038543). 13. At the original time of submittal for this project Williams was not made aware of this requirement. In turn this project has been completed and Williams does not feel that a security for vegetation is required. A weed inventory map has been provided on the figure: Site Specific Noxious Weed Map. In addition a copy of Williams Noxious Weed Management Program has been provided. The graveled area of the facility will be sprayed with a bareground treatment annually. The noxious weed populations located on the figure: Site Specific Noxious Weed Map and the native area surrounding the facility will be monitored annually and treated as needed. • • • Exhibit C Rulison Industria! Support SUP The adjacent uses include vacant land, residential, and natural gas extraction. All of the surrounding properties are zoned Resource Lands. 5.03.07 2 (A) Site Rehabilitation Plan The site rehabilitation will be minimal for the foreseeable future as it will be used by Williams or its successors to support the production from the natural gas wells in the immediate area which will likely produce for another 20-30 years_ At the time the existing and or proposed structures are removed from the site, the ground will be recontoured to the natural surroundings, water runoff control measures implemented, and the entire disturbed area reseeded with an appropriate seed mix. 1? Thank you for your business. • 2 • • Exhibit N Rulison Industrial Support SUP Williams Noxious Weed Management Program Noxious weed infestations may occur on lands that fall within Williams Production (Williams) lease boundaries. These areas include well pads, lease roads, disturbed sites, reclaimed sites, and some undisturbed areas. In order to minimize impacts that may result from the presence of noxious weeds, improve reclamation success, and ensure good land stewardship, Williams had adopted the following Integrated Noxious Weed Management Plan. The Weed management plan is designed to bring Williams into compliance with the Colorado Noxious Weed Act (C.R.S. Title 35, Article 5.5), Colorado Oil & Gas Conservation Act, and the Garfield County Noxious Weed Management Plan. Weed Management activities will primarily focus on the Garfield County Noxious Weed List. Williams' Integrated weed management plan will focus on four components of weed management. • Prevention • Inventory and Mapping • Weed Control • Monitoring Prevention - Prevention is a key component of the Williams weed management program. Williams addresses prevention in the planning, development, and operations phases of field development. Williams tries to avoid or limit ground disturbance activities when practical. If ground disturbing activities cannot be avoided, Williams tries to plan development that will avoid identified weed infestation or areas where weed establishment may be more optimal if this is practical to operations. If ground disturbing activities do occur, Williams uses temporary or permanent seed mixes that help to develop healthy stands of vegetation that can be self sustaining and deter the establishment of invasive species. Inventory and Mapping — Williams uses various means to inventory noxious weeds that fall within its lease boundaries. First, members of Williams Environmental staff are competent in weed identification and note noxious weed occurrences when they are completing field work. Second, the environmental staff works to educate field operations staff to identify weed infestations so that they can also document infestations and inform environmental staff where they are located. If operations personnel are unsure of a suspected infestation, they contact the Environmental staff The suspected infestation is then investigated before it is documented as an infestation. Third, Williams hires a Certified Weed Applicator to do its bare ground and noxious weed spraying. While the Applicator is conducting their annual spraying activities they document infestations they find. Lastly, many of the lands that Williams operates on are also used for livestock grazing or agricultural purposes and Williams works with the lessees to document weed infestations that the lessees may identify. Weed Control — Williams uses an Integrated Weed Management Approach for the control of identified noxious weed infestations. This is made up of four control methods. These 411 include Cultural, Mechanical, Biological, and Chemical. • • • • Cultural — Cultural control is the use of management practices that will help to favor the growth of desirable species over undesirable species. This establishment is accomplished by using appropriate seed mixes that reflect the surrounding area or species that have been developed and are approved for rapid stabilization of a site. Purchased seed and mulch are certified weed free to decrease the opportunity for noxious weed species to be introduced into disturbed sites. • Mechanical Mechanical controls methods most often used by Williams include the following. Mowing, tillage, and hand pulling. However, because mechanical methods tend to be fairly labor intensive and cost prohibitive, it is not typically a preferred method but can be used in sensitive areas or areas where topography or other environmental factors may be considered prohibitive. • Biological - Biological Control Methods are the release of organisms that are know to be effective in controlling specific weed species. This method may be chosen if there is a heavy infestation of a specific species on a site. Williams will consult with the Colorado Department of Agriculture Insectary located in Palisade, Colorado when exploring control options. ▪ Chemical — Chemical control is the use of herbicides to control weed populations. This is the primary weed control method used by Williams. Williams annually contracts a Certified Commercial applicator to apply herbicides on lease acreage. Both bare ground and noxious weed applications occur throughout spring, summer, and fall. Williams encourages the use of spot spray application on lease land to ensure vegetation diversity components are maintained. Broadcast applications are only used if a weed infestation is extremely heavy and has created a monoculture in the infested area. The use of appropriate PPE, pesticide storage, pesticide handling, spray mixtures and application rates will occur on Williams lease acreage. Monitoring -- Areas where noxious weed infestations are identified and treated will be inspected over time to ensure that control methods are working to reduce and suppress the identified infestation. The sites will be monitored until the infestations are eliminated or reduced to acceptable levels. These inspections will be used to prioritize future weed control efforts. Site Specific Weed Control Plans for the Industrial Support Facility The industrial support facility will receive an annual bare ground treatment on the graveled area to suppress weedy species growth. The non graveled area surrounding the facility will be monitored annually for noxious weed species and they will be chemically treated at appropriate times.
