Special Use Permit request for an "Industrial Support Facility" located at 431 County Road 246. To date, although the I3OCC approved this permit on July 2, 2007, no Special Use Permit (SUP) has been issued for this use. A letter was sent to Williams Production RMT Co. on June 18, 2008 indicating that no response had been received from Williams Production RMT Co. demonstrating that the Applicant was working toward compliance with the required Conditions of Approval and presumed subsequent issuance of the Special Use Permit. No response was received by Planning Staff from the June 18, 2008 letter sent to Williams Production RMT Co. Code Enforcement Staff received the first response shortly after the Notice of Violation was sent on February 20, 2009. Since February 20, 2009, Williams has made several attempts to complete the conditions as outlined in the Resolution of Approval. However, the conditions have not yet been completely fulfilled. The information provided is deficient in responding to the Conditions of Approval for the following reasons: Condition Number 6: The information pertaining to a dust control plan is not adequate. Generally plans address a method, means and timeframe for application. Please see the attached sample dust control plan for guidance. Condition Number 9: The provided materials have been forwarded along to the Garfield County Engineer. Please submit a grading plan as required in Condition 12, Condition Number 11 Pertaining to potable water extracted from the Colorado River, no plan was submitted to demonstrate that the quality of the water is able to meet State standards. As such, no plan has been reviewed by the Garfield County Engineer or Public Health Department as required. Planning Staff cannot forward a Permit to the BOCC without the plan first being accepted by the required parties. This condition is non- negotiable through this permit. if the Applicant wishes not to comply with this condition then a new Land Use Change Permit application will need to be submitted and approved by the BOCC under the Land Use Resolution of 2008. The removal of this condition is at the sole discretion of the BOCC in the format of a new application. Condition Number 12. The submitted Storm Water Management Plan information has been forwarded to the Garfield County Engineer. However, as required by this condition, a grading plan has not been submitted. The Garfield County Engineer is unable to make a determination on the submitted information without a site grading plan. To this end, since the Special Use Permit has not yet been issued for this facility, it is Planning Staffs view that this activity is not currently permitted until these agreed upon Conditions of Approval are met. Best regards, David P- nichaTCP Senior Planner — Long -Range REQUIREMENTS FOR THE CONTROL OF FUGITIVE DUST EMISSIONS PREVENTION Fugitive dust control strategies are composed of a balance of available dust mitigation techniques applied on an as needed basis by site supervision to: • prevent dust from exiting the property, • prevent visible emissions from exceeding opacity regulations, and • prevent public nuisance. This implies the use of adequate measures during the appropriate evolution of each construction and operation activity and may include wird breaks and barriers, frequent water applications, application of soil additives, control of vehicle access, vehicle speed restrictions, covering of piles, use of gravel at site exit points to remove caked on dirt from tires and tracks, washing of equipment at the end of each work day and prior to site removal, wet sweeping of public thoroughfares, and work stoppage. FUGITIVE DUST CONTROL MITIGATION MEASURES All grading operations on a project should be suspended when winds exceed 20 miles per hour or when winds carry dust beyond the property line despite implementation of all feasible dust control measures. Construction and Facility sites shall be watered as necessary to prevent fugitive dust violations and to achieve the following goals: • prevent dust from exiting the property, • prevent visible emissions from exceeding opacity regulations, and • prevent public nuisance. An operational water truck should be onsite at times when fugitive dust is an issue. Apply water to control dust as needed to prevent visible emissions violations and offsite dust impacts. Onsite dirt piles or other stockpiled particulate matter should be covered, wind breaks installed, and water and/or soil stabilizers employed to reduce wind blown dust emissions. Incorporate the use of approved non-toxic soil stabilizers according to manufacturer's specifications to all inactive construction and other facility areas. • All transfer processes involving a free fall of soil or other particulate matter shall be operated in such a manner as to minimize the free fail distance and fugitive dust emissions. Apply approved chemical soil stabilizers according to the manufacturers' specifications, to all - inactive construction areas (previously graded areas that remain inactive for 96 hours) including unpaved roads and employee/equipment parking areas. To prevent track -out, wheel washers should be installed where project vehicles and/or equipment exit onto paved streets from unpaved roads. Vehicles and/or equipment shall be washed prior to each trip. Alternatively, a gravel bed may be installed as appropriate at vehicle/equipment site exit points to effectively remove soil buildup on tires and tracks to prevent/diminish track -out. Paved streets shall be swept frequently (water sweeper with reclaimed water recommended; wet broom) if soil material has been carried onto adjacent paved, public thoroughfares from the project site. Reduce traffic speeds on all unpaved surfaces to 15 miles per hour or less and reduce unnecessary vehicle traffic by restricting access. Provide appropriate training, onsite enforcement, and signage. Reestablish ground cover on the construction and/or facility site as soon as possible and prior to final occupancy, through seeding and watering. Disposal by Burning: Open burning is yet another source of fugitive gas and particulate emissions and shall be prohibited at the project site. No open burning of vegetative waste (natural plant growth wastes) or other legal or illegal bum materials (trash, demolition debris, et. al.) may be conducted at the project site. Vegetative wastes should be chipped or delivered to waste to energy facilities (permitted biomass facilities), mulched, composted, or used for firewood. It is unlawful to haul waste materials offsite for disposal by open burning. The grading permit application is associated with the existing Rulison Industrial Support Facility, Parcel No 2175-292-00-021, located in Section 29, Township 6 South, Range 94 West, 6th P.M., in Garfield County Colorado. The industrial support facility is a field office operated by Williams Production RMT Company and was approved by the Garfield County Board of County Commissioners in Resolution No. 2007-62. Grading activities associated with this permit application include minor fills associated with the placement of gravel in the office parking and storage areas, the installation of a below -ground water cistern and septic tank, water and sewer service lines, and construction of two storm water/erosion control sedimentation ponds and interceptor ditches. Details are provided on the enclosed site map. Soils and drainage reports have not been completed. Site native slopes are less that 25% and no cuts exceed 15 feet. Drainage patterns, with regards to adjacent properties and wetlands/water bodies, are unaffected by grading activities Professional Engineer Certification The documents contained herein associated with the Rulison Industrial Support Facility grading permit application were reviewed and compiled for compliance with Garfield County's grading permit requirements under the constraints and limitations of an as -built or existing facility. The site appears not to be located within a floodplain or within natural and geologic hazard areas as outlined in Section 7-210 of the Garfield County Unified Land Use Code. The site is also in general compliance with the provisions of the International Building Code - Appendix J, as amended by Garfield County, and applicable requirements of the Colorado Department of Public Health's Water Quality Control Commission. sealj David J. Facility Size: The construction activities associated with the proposed "Facility" will disturb approximately 2 acres, the majority of which was disturbed by previous owners during the construction of a home and out buildings in 1999. 3. Site Description: The proposed "Facility" will be constructed on a pre existing home site. The natural terrain surrounding the "Facility" slopes gently to the south and is covered with sage brush, some grasses and sporadic junipers. There is an intermittent stream 200 feet west of the site than drains to the south and slightly lower in elevation than the site. There is also an old "ditch" approximately 50' west of the site that is partially filled in. and well revegatated. 4. Construction Site Characteristics; The existing structures are located approximately at the site of the previous owners' residence. The area was disturbed during the construction of the home site and was further leveled and a minimum of 6" of 3"minus gravel applied prior to the setting of the existing modular unit in 2006. This graveled area is approximately 120 ' X 300'. 5. Construction Activities: The existing modular unit and storage structures will be moved offsite and the site will be enlarged to 200' X 300' using conventional cut and fill earth moving techniques. The site will then be graded so that storm water from the pad will flow to the northern and western edges of the pad. (See Exhibit # A burrow ditch will be constructed along the toe of the pad on both the north and west sides. Runoff will then be collected in the ditches and directed to a setting pond. Potable water is to be supplied to the "Industrial Support Facility" (facility) approved by Garfield County in Resolution No. 2007-62. The facility, denoted as Parcel No 217529200021, is located in located in Section 29, Township 6 south, Range 94 West, 61" P,M near Rulison, Colorado, The industrial support facility appears to be a field office approved by the County for up to 12 individuals stationed at the site. As such, the facility's water supply is exempt from the regulations and permitting requirements of the Water Quality Control Commission's "Colorado Primary Drinking Water Regulations". 5 CCR 1003-1. As defined in the regulations, a "public water system" (PWS) means a system for the provision to the public of water for human consumption through pipes or other constructed conveyances, if such system has at least fifteen service connections or regularly serves an average of at least twenty-five individuals daily at least 60 days out of the year. Although the facility water system does not qualify as a public water supply, the treatment system will be designed by a qualified registered professional engineer to meeting al! of the State's drinking water standards. Utilizing the EPA Process Design Manual, PS -299-711, and CDPHE's criteria, the system will be designed fora minimum of 15 gallons per day (gpd) per employee. Assuming 12 employees, this equates to 180 gpd. Based on our experience with water quality from the Colorado River, the treatment system will need to be capable of removing dissolved solids. To achieve this level of treatment, a reverse osmosis package system is recommended. The treatment process train will include, at a minimum. storage with settling detention, primary filtration, reverse osmosis and chlorination followed by adequate chlorination contact time. Water quality sampling will provide information as to other contaminates residing in the water supply and may require additional treatment equipment. It is anticipated that the water treatment equipment will be housed in a small weather-proof structure located adjacent to the facility office. The water treatment and maintenance plan will include: • Selection of a qualified Colorado registered professional engineer to determine water demand requirements and design the water treatment system. • Collection of water quality data or sampling and testing of Colorado River water. • Preparation of water treatment plans and specifications. • Selection of a contractor to install and construct the water treatment system. Parachute's water supply system is approved and permitted by the Colorado Department of Public Health and Environment (CDPHE), through the Water Quality Control Commission, under Public Water Supply Identification No.123602 (PWSID). The Town's water supply undergoes treatment, disinfection, and monitoring to meet the State's current drinking water standards. The source of this water is the Colorado River and its tributaries. Until such time as the permanent water treatment system is constructed at the facility, potable water from the Town of Parachute will meet the State of Colorado standards for potability. The construction & use of the Rulison Industrial Support facility is a source / activity that could potentially result in fugitive dust emissions. The control plan must enable the source to minimize emissions of fugitive dust to a level that is technologically feasible and economically reasonable. If the control plan is not adequate in minimizing emissions a revised control plan may be required. The control plan will be followed by Williams to meet its obligations under the Garfield County Special Use Permit. PREVENTION The goal of this dust control plan is to: 1. Prevent dust from exiting the property, 2. Prevent visible emissions from exceeding opacity regulations, and 3. Prevent public nuisance. This implies the use of adequate measures during the appropriate evolution of each construction and operation activity. Best Management Practices will be implemented through Stormwater Management Plan in order to decrease potential soil loss through wind or water r erosion. May also include; wind breaks and barriers, frequent watering, application of soil additives, control of vehicle access, vehicle speed restrictions, covering of piles, use of gravel at site exit points to remove caked on dirt from tires and tracks.
