APPLICANT: Howard and Margo Stapleton LOCATION: A parcel of land located in the SW 1/4 NE 1/4, Section 6, T6S, R91W; approximately 3 1/2 miles west of New Castle off of County Road 214. SITE DATA: The site consists of approximately 4.0 acres. WATER: Existing well SEWER: Proposed Individual Sewage Disposal System. ACCESS: Existing access off of County Rd. 214 EXISTING ZONING: A/R/RD ADJACENT ZONING: A/R/RD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located in District C, Rural Areas with Minor Environmental Constraints as indicated on the Comprehensive Plan's Management Districts Map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located in a rural, residential portion of the County with adjacent land uses including ranching and single family residences. Existing improvements on the site include a single family residence, a studio, and an accessory building with sleeping quarters. All are pre-existing to zoning. B. Project Description: The applicant proposes to construct an approximately 500 sq. ft. guest home at a new location on the site. III.MAJOR ISSUES AND CONCERNS 1. The applicant proposes to utilize an existing well, to be supplemented with an additional acre foot of water through augmentation arrangements with the West Divide Conservancy District. 2. The applicants' proposals are in accordance with Section 5.03.02 of the Zoning Resolution requiring a 3 acre minimum lot size in the A/R/RD zone district and limiting guest houses to a maximum of 1,000 sq. ft. IV. SUGGESTED FINDINGS 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at the hearing. 3. That for the above stated and other reasons, the proposed Special Use permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, with the following conditions: 1. All representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval, unless stated otherwise by the Board. 2. The gross floor area of the guest house used for residential occupancy shall be limited to a maximum of 1000 sq. ft., with the lot size maintained at a minimum of 3 acres. 3. The applicant shall submit documentations of augmentation agreements with the West Divide Water Conservancy District allowing for the use of the existing well to serve an additional dwelling unit. 4. The applicants shall have 120 days from the date of the Resolution of Approval to meet all conditions set forth in the Resolution. The Special Use permit shall be issued when all conditions are met and shall expire 120 days after issuance unless construction or use has commenced.
