The issues we have identified fordiscussion are as follows: '|- 1- Access. Access is not defined crearry according to ,,Map 1 _ wasteTransfer station Generat pran". tt is our understanding that theconcrete pad to be used by Alpine Waste Services is located to theeast of the old Mid-Continent load-out facility. There is one accesspoint directly to the west of the load-oui facility, but this is at a 4soangle along 100 Road and trucks .oring from the Catherine Storearea wiil have difficurty making this turnrng radius. There is an 2. access point to the property further to the west but portions of thisroad system are unpaved. The Town believes that this accesssituation should be properly defined, and that any road surfaces tobe used for the construction waste transfer statioh be paved with ahard surface (chip-and-seal or other appropriate surface). Traffic. The application states that the facility will be able toprocess a maximum of 25 trucks per day (50 trips). Do these tripsinclude the trucking out of the waste or recycled material torecyclers and local landfills? This needs to be oetineo. The Townalso requests that carbondale not be used as a truck route for theconstruction waste transfer station. The Town thinks that it isacceptable for trucks to use the Carbondale street system whenthere is a client of the facility located within the Town limits. Anysuch trucks for Alpine waste services within the Town ofcarbondale should utilize designated truck routes. The Town hasweight limits and designated truck routes and these will beenforced. we ask that all other truck traffic that does not include Carbondale clients not use the Town street system. Blowing debris. The speciar Use permit should include a plan toprevent dust and blowing debris. The facility shouid useappropriate fencing/screening or have a structure to prevent wind- blown debris from becoming a nuisance. Trucks shouid be covered with a tarp or have some appropriate type of cover so that waste orrecycled materials are contained. Hazardous waste. The application indicates that hazardous wastewill not be processed at the site. lt has been stated that Mr.salzman has no intention of ever processing hazardous waste, and that the special Use permit and Federal resirictions would not allowthat type of processing. In rearity, construction sites where thedumpsters are located need to be secure so that there is no illegaldumping of such items as motor oits, paints, etc. The site itsllfwhere the recycling will take place also needs to be secure(perhaps with fencing) and appropriate signage located at thefacility. ln addition, remodeling also includei extensive demolition where asbestos and lead paint and other potential toxic materialsare put in the dumpsters. To help safe guard against potential hazardous waste or contamination, the Town wou-ld suggest thefollowing: 3. 4. 5. o That a containment facility such as a setf-contained concrete chamber be located underneath the pad so that any toxicspilled liquids such as oils, etc. are trapped.. The containment vessel should be constructed in a way thatit can be pumped out if required.o A contingency plan should be developed and provided withthe application which ouflines corrective or remedialprocedures to be taken in the event of the detivery ofunapproved waste or contamination of surface water, andoutline action to be taken if hazardous materials or otherapproved waste products are found or spilled on the site.such contingency plan should include the training ofpersonnel who will operate the facility (carbondale Rurai'andFire Protection District can help in this training). wood recycling. lt has been indicated to the Town by the owner,sRepresentative that there will be no chipping of woo-d products orcomposting on the site. please be aware that some constructionwaste transfer stations use a wood chipper and noise can becomea problem. Appropriate decibel leveis should be inserted as acondition of any approval. some facilities that atso start stricfly astransfer stations eventually start to chip and shred the wood andcompost the material. composting facilities beyond a certain sizerequire a certificate of Designation from the coloraoo Departmentof Public Health and the Environment. (Regulations pertaining to !o]i!_waste Disposal sites and Facitities in t[e state of cotorado -6 CCR 1007-2, Section 14). Fire protection. storage of wood debris can atso become an issuein terms of fire protection. The carbondale and Rural FireProtection District has had some issues with the storage of chippedwood in facilities located within the Town of carbondale. A'Rreprotection plan describing the types of potential of fire hazards onsite and any steps taken to mitigate fire hazard should be ouflined.Fire access and water supply should be shown. Drainage / ground water protection. ln general, storm water run-offcontaining any contaminants leaving the site should be prevented.This can lead to the poltution oi aquifers, ground water, etc.Limiting storm water coming onto the property fiom off site meansshould be taken into account with the plan fbr such a facility. lnaddition, the application should identify ground water quality andsources, existing surface water and sources (there are ditches inthe area), and all efforts should be taken to prevent contamination. 6. 7. I recently received an updated packet for the continued Public Hearing and I believe a few things were omitted. Therefore, I had to make a few assumptions. Please contact me immediately if my assumptions are wrong and I will make appropriate changes in this letter. First of all, it is my understanding that the applicants will now be constructing a building over the "sorting facility". No such plan or sketch was included in my amended packet. Second, the site plans that have been included with this packet do not show the access, which I believe is to be the old coal loading facility access point. lt is also my understanding that Mid Con Realty has contacted the RTA regarding reconfiguration of this intersection (it is currenfly ata 45o angle). Reconstruction of this intersection should be made a condition ofthe approval so it will prevent turnaround at the Hobo Gulch/100 Road intersection and lessen VMT, dangerous turnarounds, etc. Third, Leslie Klusmire's letter of 6120101 indicates that Source lnternational, lnc. will commit to picking up any hazardous material in the event that prohibited materials are placed in any Alpine Waste containers This should not only be made a condition of any approved permit, but a plan should be included in the file which would bea step-by-step procedure for Alpine Waste personnel to follow in case of any hazardous waste spill. I am pleased to see that the application has tried to address some of the concerns of the Town and local residents in the 100 Road area. However, the Town of Carbondale still has a few concerns and comments we would like to make on the record. First, the sump facility as proposed by Greg Lewicki and #*$ Assoc. seems appropriate for containing any storm event and drainage on site. However, a plan needs to be put in black-and-white that will provide for the regular pumping of material if there is a storm or other event. State of Colorado Dept. of Health regulations propose pumping of such detainment basins within 15 days of a major storm event so that full run-off storage capacity is restored. This issue leads us to the Town's second concern, which is the possible contamination of the ground water north of 100 Road that leads to the Town's wells and the Roaring Fork River. One of the Town's primary concerns is contamination of this water source. We would recommend periodic sampling and analysis of ground water monitoring as proposed in Leslie Klusmire's letter. The Town would propose that this be done every 6 months. The Town also strongly feels that a containment facility such as a previously requested self-contained concrete chamber be located underneath the pad to prevent any toxic spilled materials from contaminating the area. Containment of site drainage and possible material from the work process itself are two different situations. Despite Mr. Salzman's claims that they will not sort or pick up hazardous materials, dumping of toxic and inappropriate materials happens up and down the valley. Many construction waste dumpsters in the Town of Carbondale are subject to dumpster stuffing. We believe Mr. Salzman is naive in believing that human nature will not result in inappropriate materials being placed in such dumpsters. We have reviewed the traffic study done by Mark Bancale of Washington lnfrastructure Services, lnc. lt does appear that the facility will not overwhelm the traffic load on County Road 100. However, Mr. Bancale states that the applicant has committed for traffic to only come through Carbondale when there is a client located within the Town limits. The Town insists that this be put as a condition to the Special Use Permit. The Town would also like to comment that while no individual project seems to be overloading County Road 100, the incremental addition of all the projects is starting to add to the traffic burden. We ask you to please take the concerns of local residents on 100 Road into your consideration and perhaps acknowledge that future improvements will be needed soon on 100 Road and the County road capital improvements plan dealt with appropriately. Finally, all driving surfaces should be hard surfaced. The Town also understands that the County has concerns about lighting of the facility. lf you are to require lighting, we ask that the lights be 90o cut-off luminaires and minimal lighting be imposed. The Town recently adopted a lighting ordinance and can provide foot-candle criteria at your request. Finally, the hours of operation are listed from 7:00 a.m. to 6:00 p.m. The applicant's representative has stated that no Sunday operation is expected. This should also be a condition of the permit. The County has the ability to impose appropriate hours of operation and other conditions to protect the surrounding neighborhood as well as general safety health and welfare. The maximum number of trips per day should also be a condition of permit and the number of trips occasionally checked (as In an audit). We would like to thank the County again for giving us the opportunity to comment on this important Special Use Permit. We ask that any approval be conditioned upon construction of a concrete containment chamber, arrangements for pumping of the sump basin, regular ground water monitoring, reconstructed access to the property from County Road 100, specific limits on the number of truck trips per day, hours of operation and a requirement that trucks not proceed through Carbondale unless a client exists within the Town limits. ln general, we believe that the application needs to be tightened up and specific plans approved with a step-by-step outline for easier monitoring in the future. I own the adjoining property where Carbondale Mini Storage is located and I own a personal ranch on Rose Lane, *[itt ir not far away. I am writing to address my main concerns and objections as suggested in your "Public Notice". First I feel very strongly that a "trash depot" or a "trash-processing center" was never envisioned in the original ,oning and would be considered inappropriate fol the current Light Industrial Zone. The-letter sentio adjacent property owners states that Alpine Waste Services picks up full metal dumpsters from construction sites and sorted materials are hauled away on semitraiter trucks. Fuli metal dumpsters and semi-trailer trucks, quite frankly, do not fall into the definition of "light industry". Secondly I have serious concerns about trash blowing over to my properfy, as I am located on the eastern rid.. Th. letter also states that"eventually" the client "hopes" to cover the pad area with a metal roof or building. Regardless of best intentions and hopes, inevitably trash will blow or.. to neighboring property owners. Additionally I do not feel a "trash-processing center" is conducive io the adjoining residential and ranching properties. Last, but certainly not my least objection, is the truck trips and hours of operation. The letter states that there would be approximately 25-50 truck trips per day to the site. Generally estimates tend to be minimal andwhat was supposed to be 50 (maximum) trips per day actually ends up being 100 trips. Before I start, let me point out that I am not a newcomer (Carbondale resident since 1979, neighborhood resident since 1983), and I am not a no growth advocate. I believe in private property rights as long as the growth is done reasonably so as not to be a detriment to others and not adversely affect others. For example, Eubank's Storage facility to the east, is a nice operation and is nicely maintained, clean, etc' As you may know, Mr. Salzman operates a dumpster storage facility on the property already. fhis is located on the west side of the old loadout building along the railroad tracks. This is a fairly large operation at this time with as many as 55 15 cu.yd. dumpsters and 28 40 cu. yd. durnpsteis thire at any given time. It is my opinion that this operation has not been a good neigirbor since he started that business and now he is asking to expand into trash. In May of 2001, I called and left messages about the huge amount of dust generated by the trucks traveling along the railroad tracks (as fast as they can go) from the Nieslanik Property down to the storage u..ultop of Willow Lane extended), with no response. I then called the County. They said, .'call ihe company". I also asked the County if the Alpine operation was truly on the leased property o, *ur it on the railroad right of way (I believe both are true). The County did not too* and expressed little interest. I called Alpine Waste two (2) more times with no response. I have not complained about all the banging and clanging of dumpsters at 5:30 am, about the diesel smoke which fills the entire neighborhood each morning that the wind does not blow or about the general noise from the trucks. Believe me, I lived here when the coal trucks were operating and I had less concern over them (trains included), than I do about this operation' Mainly, b.rurrr. you knew what the coal operation was going to do, these guys (in my opinion) ,r. going to sneak up on us and then, as is always the case, Garfield County will do nothing to nx li Aue to lack of staff, lack of time, lack of ambition or whatever other excuses work at the time. It is a fact, if this operation that is proposed goes in, the entire neighborhood and the 100 Road corridor in general will be stuck with the mess it generates and will have no recourse. Now let's talk about the request from Alpine (copy attached with the underlining added by me)' -2- First of all, a concrete pad to sort waste on is stupid for lack of a more tactful word. If any of you have ever been in that little valley on 100 Road between Carbondale and Catherine's Store, you know how hard the wind blows there. Just how much trash can blow around the neighborhood in the time it takes to dump a 40 cu. yd. dumpster on a concrete pad and then (2 men only) sort it into semi-trucks?? Can you picture this operation as they describe it? I can and it is a joke! Will drywall, paper and plastic blow away from the site while 2 men sort? You bet it will on an ongoing Uaiis. Soon our neighborhood will look like the South Canyon Dump. Similar operations in other areas have certainly had these problems and the same concerns from the neighbors, towns and so on. How will they control this and who will police it if it becomes a problem? The answer is no control as soon as everyone stops watching shortly after they get approvals and certainly, no policing by Garfield County. In paragraph four, while describing the operation, they state that no hazardous waste is allowed in their dumpsters and they have "no intention" of processing hazardous waste. How can they possibly police both hazardous waste and/or house trash from being dumped in their 40 cu.yd. dumpsters without their knowledge and what will they do with it then? Having worked as a mining engineer for 14 years and as the construction coordinator on the Glenwood Canyon (I-70) tunnels for over six years, I do know construction and construction workers. You cannot convince me that workers will not come to job sites and throw their house trash in the dumpsters, throw their lunch waste in the dumpsters and so on. In addition, what will they do when a painting contractor or other contractor decides to throw his half empty can of stain or other hazardous materials into the bottom of the dumpster early in the moming before anyone notices. When Alpine finds it, it will be on their "concrete pad" being sorted by 2 men). What will they do with the house trash then? What will they do if those cans of hazardous waste break open? This type of situation will be the rule......not the exception! They may not have any "intention" of processing this type of waste, but you better believe (unless you are a dreamer), it will happen time and time again. Eventually, Alpine hopes to cover the pad area with a metal roof or building. Eventually? Is that the same as "some day" or "in a perfect world"? Does that mean in my lifetime or someone else's. A roof over the pad will not keep the trash from blowing all over the valley. A building actually would help to reduce the potential wind-blown trash problem. Saturday operation from 7am to 6pm and Sunday operation not "expected"?? Thatsouncis like the same vague explanation that we got for the building in the question above. The Saturday operation doesn't thrill me, but do we have to listen to it on Sunday too? They certainly are leaving the door open for it and will do it if it is profitable. No doubt about it. No radios or loud music is the least of my concern. Are they going to run a chipper for wood products to make mulch? Some other motorized device? At what noise level will this be? How many days/week? Saturdays and Sundays too? These concerns need to be addressed by the applicant. I believe they will control radios because that is easy and does not affect their bottom line, but what about the rest of the questions? The Town of Carbondale does not want the trucks going through Town. Therefore, they will all use 100 Road in and out from the east (Catherine Store) side. I do not believe this is going to be safe. I do not believe that it will be safe for all the truck traffic on 100 Road. The bridge over the Roaring Fork is naffow and when traveling west (even if only pulling a -3- horse trailer, not a semi-truck), a driver nearly has to go into the oncoming lane in order to keep from hitting the side of the bridge. I do not believe the design is safe at that point. In addition, the 100 Road has almost no shoulder on either side, yet is full of bicycle riders nearly every day, in all seasons. How will they be affected by the increased truck traffic and who will get the worst of that conflict? What will be the access points for the truck traffic? As it stands now, the Alpine Waste trucks are not supposed to make the hard (more than 90 degree) left just south of the roping arena into their dumpster yard. In fact there is a sign there that says no left turn. If you think this is what really occurs, think again. How are they going to do this in the future with 50 truck trips per day. Will it be safe? If they go all the way to Nieslanik's turn in as they are supposed to, will all of us in the neighborhood have to choke on all their dust (as they travel along the RR tracks) as we have since they started their dumpster storage operation? We have dirt roads in our neighborhood and we treat them to keep the dust down. They have a paved surface along the tracks that is worse than any dirt road. What will be the total number of truck trips (between the recycle and the dumpster business) making left turns from 100 Road into the property (70, 80, l00X In closing, I would like to say that I am sure there are more questions that I have not thought of. On the surface, this seems like a "no brainer". They are recycling, how can that be bad? Well, if there is this many concerns, no one that will be enforcing the solutions to the problems, and profit is the main ingredient, perhaps the recycling "solution" is worse than the problem at this location, unless the concerns are addressed.
