Reference: W illiams Production RMT Company GV 82 -5 and PA 41-9
Dear Ms. Lane ;
As you are aware, the Board of County Commissioners (BOCC) held a Takings Determination at a Public
Meeting on August 17, 2009 . The direction provided by the BOCC included a requirement for W illiams
Production RMT Company to submit Technically Complete (TC) applications for Special Use Permits
related to Extraction and Processing of Natural Resources for the above reference well pads withi n 60
days (by October 17, 2009). Land Use Permits are required pursuant to Resolution 82-121 which
contains the Battlement Mesa PUD zoning .
A Pre-Application Conference Summary Form was provided which lists t he review p rocess and general
submittal requirements necessary to determine TC. We had discussed staff providing you a "laundry list"
of plans and reports necessary for TC review of operations , impacts and perm its related to each of the
well pads. The following list is an attempt to provide you with that comprehensive li st of requ irements
which come from 5.03, 5.03.07, 5 .03 .08, 9.03:
• Application Form , attachments (agreement to pay form , recorded statement of authority) and fee
• Operational info rmation regarding the activities (in detail), including trac ing , produced water
storage and disposal, etc.
• Permits associated with the COGCC
• Permits from Road and Bridge
• Permits from CDPHE or other local , state, or federal agencies (exist ing and pend ing )
• Floodplain/wetlands issues related to GV 82-5
• Deed
• Surface Use Agreements
• Legal description of subject site and individual sites
• Narrative of the nature and character of the use requested
• Hours of operation
• Number and type of vehicles accessing the site
• Size and location of existing or proposed structures related to the proposed use
• Utility provision for electric power

• Water usage and wastewater treatment (both potable and produced) including amount of water
and type of wastewater treatment. Information regarding the legal water supply should be
included
• A site plan drawn to scale that indicates the property boundaries, existing and proposed
structures, and all County or State roads within 1 mile of the site
• A vicinity map showing slope and topography
• A copy of the Assessor map indicating the subject site and all public and private landowners
within 200 feet of the property boundaries -please include parcel numbers on the map
• Provide a list of names and mailing addresses of owners of property included on the above map,
please indicate parcel number for each name and address
• Provide names and mailing addresses of mineral interest owners as identified in the Clerk and
Recorders records
• Utilities adequate to provide water and sanitation service (hauler affidavits)
• Street improvements to accommodate traffic volume generated and provide safe, convenient
access (in order to determine 'accommodation of traffic volume' there will need to be some traffic
analysis)
• Site access
• Design of use minimized impact on and from adjacent uses (any landscaping, screening)
• Site lighting
• Neighborhood character (to determine potential impacts to that character)
• Existing lawful use of water
• Noise study
• Air permits related to the site and the equipment
• Fugitive dust plan
• Wildlife and domestic animal impacts and proposed mitigation (necessity of bear-proof trash
cans, fencing, etc)
• Traffic study
• Sufficient separation from adjacent uses
• Reclamation Plan and security information related to COGCC
• Storage areas (tanks, vehicles and equipment, etc)
• Water pollution and hazards -stormwater control, secondary containment issues, etc
• Haul/access routes for all aspects of the use (trucking out produced water, bringing in the drill rig,
etc)
• Potential school impact -bus routes, etc. A Jetter from the District would alleviate necessity to
send a referral
• Temporary housing issues
o Maximum number of inhabitants
o Letter from Fire District
o Letter from Sheriff
o ISDS Permit
o Hauler affidavits
o Site information including location of unit(s), water tanks, sanitation, trash receptacles on
the pad
o Unit information
o Sprinkler/fire extinguisher information
Hopefully this list can aid you in putting together your submittals, please be aware that it may not be all-
encompassing and additional information may be required once the submittal is reviewed.
I have attached additional documents for your review, including a draft referral form indicating agency
preference for CD or paper copy and a draft public notice form. Publication in the Rifle Citizen Telegram
MUST occur in the Thursday, October 15, 2009 edition -deadline to request publication on that date is
Friday October 9th at noon. The single publication on October 15th will satisfy the publication notice
requirements for both hearing as It occurs at least 30 days but not more than 60 days prior to each
hearing date.
The Planning Commission hearing date has (tentatively) been set for November 18th, we just have to get
approval from the Commission to set a date which deviates from their regular schedule.
