A copy of Assessor's map showing property; and a listing of all adjoining property owners and property owners within 200 feet of said property. Notice containing information described under paragraph 5 shall be mailed to all owners of record of these lots at least 5 days prior to the hearing by certified return receipt mail. 6. Notice including the name of the applicant, description of the subject lot, a description of the proposed special use and the time and place for the hearing shall be given in the newspaper of general circulation in that portion of the County at least fifteen (15) days prior to such hearing time. Prior to construction Northwest Pipeline has used rubber tired vehicles to initially survey and flag the compressor site, using existing access of disturbance as much as possible. (e.g. county roads, access roads, pipeline rights of way). Contact is hereby made with your office to determine any possible land use conflicts. a. Northwest Pipeline Corporation is authorized to operate in the State of Colorado. b. Northwest Pipeline Corporation has demonstrated its financial and technical capabilities as is required and evidenced by the continued progress throughout the western states, particularily Colorado. c. All safety measures have been considered, Northwest Pipeline will have inspectors present during all phases of construction. d. All necessary clearance and reports will be completed and submitted to the county on or before the day of the granting. 2. Construction. a. Notification - if required, the County Highway Department will be notified 24 hours prior to initiation of construction unless a pre -construction meeting will be required. In that case, arrangements will be made in the form of a written request five (5) days prior to the construction date. F. Site Preparation: The site will be prepared utilizing the necessary construction equipment. Care will be taken to disturb as little of the surface as possible to lessen any erosion from wind or water. Culverts and/or sufficient drainage will be installed as deemed necessary to protect the site and surrounding lands. G. Construction: 1. All construction and design will conform to the Pipeline Safety Regulations, under parts 192 issued by the U.S. Department of Transportation. (See Attached Exhibit B). 2. The compressor site will be fenced utilizing cFiain link design. H. SPECIAL CONSIDERATION 1. If monitoring of the project is required, a qualified archaeologist will be present. A copy of the findings and report will be forwarded to the county for acceptance. • • PLAN OF OPERATIONS Page -3- Northwest Pipeline, herein referred to as the grantee, shall comply with the applicable Federal and State laws and regulations concerning the use of pesticides (i.e., insecticides, herebicides, fungicides, rodenticides, and other similar substances) in all activities/ operations under this grant. The grantee shall obtain from the Authorized Officer approval of a written plan prior to the use of such substances. The plan must provide the type and quantity of material to be used; the pest, insect, fungus, etc., to be controlled; the method of application; the location for storage and disposal of containers; and other information that the Authorized Officer may require. The plan should be submitted no later than December 1, of any calendar year that covers the proposed activities for the next fiscal year (i.e., December 1, 1979, deadline for a fiscal year 1981 action). Emergency use of pesticides may occur. The use of substances on or near the right of way shall be in accordance with the approved plan. A pesticide shall not be used if the Secretary of the Interior and prohibited its use. A pesticide shall be used only in accordance with its registered uses and within other limitations if the Secretary has imposed limitations. Pesticides shall not be permanently stored on public lands authorized for use under this grant. This project will not have a significant adverse effect upon any of the following: a. The existing lawful use of water through depletion or pol- lution of surface run-off, stream flow or ground water. b. Use of adjacent land through generation of vapor, dust smoke, noise, glare or vibration, or other emanations. c. Wildlife and domestic animals through creation of hazardous attractions, alteration of existing native vegetation, blockage of migration routes, use patterns or other disruptions. The compressor site will be fenced with chain link design (Galvanized Chain Link Security Fence). Fence height will be eight (8) feet in height with an addition one (1) foot of security barbed wire. Total height of fence will be nine (9) feet. There will be two (2) exit gates both opening outward for safety. The purchase price is $5,000.00 cash, of which Purchaser has paid to Seller$500.00 as part of such purchase price as earnest money to bind this Agreement, the receipt of which is hereby acknowledged by Seller. In the event of failure of Seller to furnish good marketable title, the earnest money hereby receipted for is to be returned to Purchaser upon the cancella- tion and return of this contract, or Purchaser may waive such objections and enforce specified performance. Should Purchaser present no written objections to title, or if written objections to title are made and such objections cured within the time above specified, or waived by Purchase Seller shall, within five days following the expiration of the time when objections were to be made, or within five days following the curing or waiver of such objections, as the case may be, tender to Purchaser a good and sufficient general warranty deed, with appropriate stamps affixed, if applicable, conveying fee simple title to such property to Purchaser, subject to no liens or encumbrances other than those specified herein or to which Purchaser has otherwise agreed. Upond delivery to Seller of the balance of said purchase price Seller shall deliver said deed to Purchaser and shall also delivery to Purchaser a policy of title insurance insuring Purchaser's title to the premises conveyed subject to no exceptions other than the usual printed exceptions of the title insurance company and exceptions for liens or encumbrances specified herein or to which Purchaser may have agreed. If Seller does so tender said deed to Purchaser and Purchaser fails, within said five-day period, to pay the balance of the purchase price, Seller shall retain the earnest money hereby receipted for as liquidated damages and as his only remedy, and all parties will be released from all obligations hereunder. Seller hereby grants to Purchaser the right and privilege to go upon the hereinafter described tract of land for the purpose of surveying, grading and actual installation work hereon, as well as the right and privilege to move machinery and equipment on said land. Provided, however, that any and all such work done upon said land and the movement of machinery and equipment thereon shall be at Purchaser's risk and if this Option Agreement and Earnest Money Contract is not exercised and the purchase completed, Purchaser shall remove from said land any and all equipment and machin Pry placed thereon, likewise at its sole cost and expense, and shall restore said land without unnecessary delay to as nearly as practicable the condition prior to beginning Purchaser's work.
