At a regular meeting of the Board of County Commissioners for Garfield County,
Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood
Springs on , Monday , the 4th day of OctoberA.D. 19 99 , there were present:

when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 9 9 -1 o
A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT
APPLICATION TO ALLOW CREATION OF A DUPLEX IN THE A/R/RD ZONE DISTRICT.
WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has
received an application from Dan Weigner, for a special use permit to allow for approval of a
duplex to be constructed in the A/R/RD zone district; and
WHEREAS, the Board of County Commissioners of Garfield County, Colorado, held a
public hearing on the 14`x' day of June, 1999, upon the question of whether the above described
duplex should be granted or denied, at which hearing the public and interested persons were
given the opportunity to express their opinions concerning the approval of said special use
permit; and
WHEREAS, the Board of County Commissioners of Garfield County, Colorado, on the
basis of substantial competent evidence produced at the aforementioned hearing, has made the
following determination of fact as listed below:
1. That proper public notice was provided as required for the hearing before the
Board of County Commissioners;

2. That the hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that meeting;
3. That for the above stated and other reasons, the proposed special use permit is in
the best interest of the health, safety, morals, convenience, order, prosperity and
welfare of the citizens of Garfield County.
4. That the application is in conformance with the Garfield County Zoning
Resolution of 1978, as amended;
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that the Weigner Special Use Permit for a Duplex is hereby approved
subject to compliance with all of the following specific conditions:
A. All items indicated in the staff report, recommended by the Board of County
Commissioners, and included by the Board of County Commissioners at the public
hearing as itemized below:
1. That all representations of the applicant, either within the application or stated at
the hearing before the Board of County Commissioners, shall be considered
conditions of approval.
2. The special use permit shall be issued when all conditions are met, and shall
expire 180 days after issuance unless the structure has been constructed.
Extensions can be granted by the Board of County Commissioners.
3. That all proposed structures are built and remain in place, as indicated on the site
plan and application without modification for any reason. Any alteration or
modification shall make the special use permit null and void.
4. That no further expansion of any structure on the site as indicated in the
application shall be allowed.
5. That the duplex units shall never be permitted to be held in separate ownership
interests.
