At a regular • meeting of the Board of County
Commissioners for Garfield County, Colorado, held at the Commissioners'
Meeting Room at the Garfield County Courthouse in Glenwood Springs on
the 1st day of December A.D. 1986 , there were present:
Larry Schmueser , Commissioner Chairman
Robert Richardson , Commissioner
Flaven J. Cerise , Commissioner
Don DeFord , County Attorney
Mildred Alsdorf , Clerk of the Board
Chuck Deschenes , County Administrator
when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 86_13
A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT AND
CONDITIONAL USE PERMIT APPLICATIONS BY JOHN POWERS.
WHEREAS, the Board of County Commissioners of Garfield County,
Colorado, has received application from John Powers for a Special Use
permit for a studio for the conduct of arts and crafts and Conditional Use
permits for a church, community building, day nursery or school and home
occupation on the following described tract of land
See Exhibit A.
(in the State of Colorado and the County of Garfield); and
WHEREAS, the Board held a public hearing on the 30th day of June,
1986, upon the question of whether the above-described Special Use permit
and Conditional Use permits should be granted or denied, at which hearing
the public and interested persons were given the opportunity to express
their opinions regarding the issuance of said Special and Conditional Use
permits; and
WHEREAS, the Board on the .basis of substantial competent evidence
produced at the aforementioned hearing, has made the following
determination of fact:
1. That proper publication and public notice was provided as
required by law for the hearing before the Board of County
Commissioners.
2. That the hearing before the Board of County Commissioners was
extensive and complete, that all pertinent facts, matters and'
issues were submitted and that all interested parties were heard
at that hearing.
3- For the above stated and other reasons, the proposed uses are in
the best interest of the health, safety, morals, convenience,
order, prosperity and welfare of the citizens of Garfield County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Garfield County, Colorado that the Special Use permit and Conditional
Use permits be and hereby are authorized permitting the use of the above
described tract of land for a studio for the conduct of arts and crafts,
or a church, community building, day school or nursery, or home. occupation
upon the following specific conditions:

1. All representations of the applicant, either within the
application or stated at the hearing before the Board of County
Commissioners shall be considered conditions of approval.
2. That the use of the tract of land comply with all regulations of
Garfield County relating to the proposed Special and Conditional
Uses, including but not limited to Sections 5.03 and 2.02 of the
Garfield County Zoning Resolution of 1978, as amended.
3. That the proposed uses are limited to use of the existing
building and improvements. Any expansion of the facilities in
conjunction with any one of the permitted uses will require
additional land use permit application and review by the County.
Only one use is allowed on the site at any one time.
4. The applicant has 3 years from the date of the Resolution of
Approval to meet all conditions set forth in the Resolution of
Approval and commence activity on the site as authorized by the
Resolution.
5. At such time as the applicant commences activity or changes the
use on the site, notification to the County shall be required in
order that verification of compliance with the conditions of
approval and County regulations can be established. The
appropriate Special or Conditional Use permits shall be issued
only following such verification.

LEGAL DESCRIPTIONS

A parcel of land in the S 1/2 of Section 16, Township 6 South,
Range 93 West of the 6th Principal Meridian described as follows:
Beginning at the South 1/4 corner of said Section 16, thence
North a distance of 16.50 feet the true point of beginning;
thence West a distance of 133.62 feet; thence North a distance of
196.63 feet; thence East a distance of 103.20 feet; thence South
a distance of 108.98 feet; thence East a distance of 92.50 feet;
thence North 79° 50' 00" East a distance of 108.00 feet to a
point on the westerly right-of-way of County Road No. 320; thence
along said right-of-way South 08° 51' 00" East a distance of
108.00 feet; thence leaving said right-of-way and along the
northerly side of an existing access road West a distance of
185.00 feet to the true point of beginning. Said parcel contains
0.909 acres more or less.
