Jim Simmons A tract of land located in Lot 2, Section 10, T8S, R88W; located approximately 1/2 mile south of Carbondale at 0165 County Rd. 118. The site consists of a 14.5 acre parcel. WATER: City of Carbondale SEWER: Individual Sewage Disposal System ACCESS: Existing access drive EXISTING ZONING: A/R/RD ADJACENT ZONING: A/R/RD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located in the Carbondale Urban Area of Influence as designated on the Comprehensive Plan Management District Map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located in a rural area with primarily single family residences and ranching. Topography is fairly level and location is above and adjacent to the Crystal River. B. Project Description: The applicant proposes to develop a fitness ranch on the site for 5 to 12 guests. The proposal will utilize existing facilities on the site which currently include a pool, large residence, several guest houses and garages. III.MAJOR ISSUES AND CONCERNS 1. The Town of Carbondale has registered no comments at this time. 2. Due to the residential/ranching nature of the surrounding area, the proposal should be limited to the proposed 12 guest capacity. Expansion beyond this size should receive additional review by the County. 3. The existing water and sanitary facilities should be reviewed for determination as to their adequacy to serve the proposed use. IV. SUGGESTED FINDINGS 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. —.3— • • 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at the hearing. 3. That for the above stated and other reasons, the proposed Special Use permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, with the following conditions: 1. All representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval, unless stated otherwise by the Board. 2. That the proposed fitness ranch -resort shall be limited to the proposed 12 guest capacity. That a letter from the Town of Carbondale be submitted indicating that they will serve, or currently serve, the site with adequate domestic water for the proposed use. 4. That the existing individual sewage disposal system be review by the County Building and Sanitation Department, or information submitted, satisfactory to establish it's adequacy to serve the proposed resort usage. 5. The applicants shall have 120 days from the date of the Resolution of Approval to meet all conditions set forth in the Resolution. The Special Use permit shall be issued when all conditions are met and shall expire 120 days after issuance \\,...______ unless construction or use has commenced. 3 ..)
