We anticipate the area to be mined wil-I be about 36 acres and the process area will be about 25 acres. A total- of about 1,600,000 tons of gravel wil-1 be yielded and we expect the life of the operatlon to be the l-ife of the pit whtich is estinrated to be about / years, depending on the n'erket dennnds. (a) The operation will in no way polute the river sjnce the existing ground waters wil-l be pun'ped into the ri-ver nnking sure no debris or waste material- will flow into the river. Any forei-gn objects will be haul-ed off the premlses. (b) Dust, smoke, noise and vibrations wil-l- be controlled by use of bag houses, scrubbers and the equipnrent will be designed so that vibrations will be absorbed by springs, etc. (c) Ttrere should be no significant i-npaet on wildlife, since the flow of the ri-ver will not be changed, etc. T?uck and outomobile traffic to and from the operation should not inpeede or disrupt nornral operations fol-l-owj-ng the proposed hlaul- road as shovm on the drawings. Lessees agree to diligently proceed to apply to Garfield county, Colorado for a permit to use the Leased Premises for the extraction of sand and gravel and for the operat'ion of an asphalt hot plant and concrete batch piant. TERM OF LEASE. 2.1 The effective date of th'is Lease shall be the date of issuance of a gravel permit relating to the leased premises by the Colorado Mined Land Reclamation Board. This Lease shall extend for a term of five (5) years thereafter. 3. OPTION TO RENEW. 3..l Conditional upon the faithful performance by Lessees of its covenant.s herein recited, Lessees are hereby granted options to renew this Lease Agreement for five (5) additional years upon the terms and conditic,ns as herein contained. 3.2 The terms of the Lease shall be negotiated between Lessor and Lessees. Lessees shall have first right of refusal on any terms offered by a thi rd party. 3.31 The rights of Lessees hereunder shall be exclusive in the sense that the Lessors, their heirs, successors and assigns, w'i1l not grant to anyone e,lse the privilege of removing sand and gravel from said tract of land during the period hereof. ,', 4. Upon such compli- ance with said terms, Lessees shall remove all such personal property and improvements from the Leased Premises unless Lessees shall have received the wrjtten consent of Lessors to the non-removal of any improvements. In the event Lessee shall fail to remove such persona'l property and improvements within sixty (60) days after Lessees are entitled to remove the same, Lessors shall, at their election, become the owners of said personal property or improvements or Lessors may have the same removed from the Leased Premises at Lessees' expense. 6. PAYMENT OF TAXES. 6.1 Lessees shall pay all taxes levied and assessed on the improve- ments and personal property placed upon the Leased Premises by Lessees. In addition, if the ad valorem real property taxes shall be increased by reason of the mining activities of Lessees, the amount of such increase shall be paid by Lessees to Lessors during the term hereof. 6.2 All severance, occupation or other taxes assessed, levied on or measured by production and/or income from Lessees' operations under this Lease shall be paid by Lessees. 6.3 All payment of taxes shall be made before the respective taxes become de1 inquent. 7. Lessees shall also compiy with a1'l other applicable state' federal, and local laws and the rules and regu'lations of al1 federal, state, and local administrative bodies asserting iurisdiction over the Leased Premises or Lessees' operations thereon. 8. INDEMNITY AND INSURANCE. 8. Critical habitats/vegetative communities,lmpacted: The affected lands consist primarily of native forbs and grasses with a fringe of cottonwoods and willows adjacent to the river. The largest pit is located on an island wh'ich has previously been under agricultural use and contains sparse vegetation. An overflow channel containing valuable aquatic habitat exists on the southern boundary of the large pit. Assessment of impact: Impacts to wildlife can be minimized by adhering to the recommendations found below. Mine Reclamation reconrnendations (include key species/habitats for which restoration ls designed). 1) Berms of 75'should separate both pits from the river. 2) Locate the processing plant as far south of the river as possible. 3) The overflow channel should not be disturbed. 4) Pit bottoms and shorel ines should be imegu'lar, peninsulas would be beneficial . 5) Cottonwood trees should be planted at the eastern end and western end of the island and along the northern boundary of the small pit. 6) Revegetate remaining disturbed areas with native shrubs and grasses. The land is located in the SW f, of Sec. 33 and SE f of Sec. 32 R 3 2W T 75. There are two pit sites and one area to be used" for gravel processing. the pits are ad.jacent to the Colorado River and are presently in irrigatedpasture. According to the soils mapped on the area, the island is Atrnl. This is a soil t;pe and has a wid.e range of materials laid doi,rn by theriver. Tkre other pit is on the south side of the river and was too smallto be cut out in the soil survey. It appears to be shallow soil over gravel. When the gravel operation begins, the top soil should be stoclrpiled and used to overlay the land and be used for reseeding. Reseeding should start with grading the slopes to 3 to I or less. Crested Wheatgrass at the rate of LO# of pure 1i-ve seed per acre should be usedif the site is to remain non-irrigated. Brome grass (I4anchar) at the rateof 13# of pure live seed per acre should be used. if the site is to be irri-gated. The area to be used for gravel processing should be graded and a cleanfirm seedbed prepared. This site should be seeded to Crested Wheatgrassat a rate of 70# of pure live seed per acre. No grazing should be allowed the first year after the grass is established. The recommendation is that the county have the applicant address said concerns in a respons"ible manner. N0TE: Ralph Freedman, Parachute Town Administrator, will attend the public hearing before the County Board of Conrnissioners on March 29, 1982 to voice his concern.
