The proposal will affect approximate'ly 61 acres, 36 acres to be. mined (including the island) and a 25 acre processing s'ite. The applicant proposes to construct a grave'lled haul road from the mine site to County Road 309. Traffic would then access onto County Road 301 and into the Town of Parachute, or remain within the Battlement Mesa Development area. A/R/RD (Agricul tural-Residential -Rural Density) North: So uth: Eas t: Wes t: R/t- (Resource Lands-Across I-70 and Colorado River) A/R/RD A/R/ RD A/R/RD MAJOR CONCERNS AND ISSUES: 1) The applicant has indicated that the aggregate's low shale content would allow'its use fbi concrete. However, pdSt information has indicated that aggreqate extracted west of Webster Hill (near Rifle) has a shale content too high for use in concrete manufacturing. Staff would request addit'ional information on sample aggregate shale content. 2) The appl'icant proposes to access the mine area by use of County Roads 301 & 309.' Counti'Road 30i is a four-1ane paved road which accesses certain residential sections of gattlement Mesa P.U.D. This four lane narrows to a two lane road and bridge going into Parachute. Also, at this time, County Road 309 has a gravel surface. Certain improvements and on-going maintenance to 309 Road should be provided by the appl icant to serve the proiect. 3) As mentioned briefly above, a major transportation route that the applicant proposes to use, County Road 301, serves a residential area of Battlement Mesa. Heavy truck traffic could have a disruptive effect on the future residents in this area. 4) County Road 309 is utilized by the Parachute school bus system. Truck hau'ling shoula Ue timited to those times of the day which would not conflict with morning school pickups or afternoon buses (generally, from 7:45 A.M.-8:15 A-M- and 3:30 P.M.-4:15 P.M.) 5) The County Compnehensive Plan encourages industrial expansion where similar development' already existi in appropriate areas. The Plan also speaks at length to the issues of compatibility of proposed and existing uses, and the possible adverse impacts that a proposed industrial use could have on surrounding land uses of lesser intensity. Because of the topographic separation of the mining and processing site from aajoining residential uses, the basic problem of incompatibility and adverse impacts of t[e pro[osa1 cou]d be mitigated. Therefore,the Planning staff recommends apirroval of the Schmidt-Tiago/Corn Construction Special Use Permit with the following condi ti ons : 1) All proposals of the applicant shall be cons'idered conditions of approval unless stated othenv'ise by the County Board of Commissioners; 2) Crushing and.mining operat.ions shall be limited from 6 n.n. to 6 p.M., *yj (" days per week) exdq)1nc1 !,-.-'d6rp, 3) The applicant shall reclaim the site to Divis'ion of tl.lildlife standards (items 1-6 on DOI^I letter); 4) The applicant shall provide the Plann'ing Department with a copy of the'ir approved Mined Land Reclamation Board (MLRB) permit for extract'ive operationsprior to issuance of the Special Use Permit; 5) The applicant shall screen the batch plants from I-70 as much as possible. All proposals of the appl'icant shall be considered conditions of approval unless stated otherwise by the Board; 2. Crushing and mining operations shall be limited from 6 A.M. to6 P.M., 6 days per week, excluding Sundays; 3. The applicant shall reclaim the site to Div'ision of Wildlife standards(items 1 - 6 on DOW letter); 4. The app'licant shall provide the Planning Department with a copyof their approved Mined Land Reclamation Board (MLRB) permit forextractive operations nrior to issuance of the Special Use permit; 5. The applicant shall screen the batch plants from I-20 as much as possible. This may be accompl ished through the use of stockp'i'led material s or vegetation; 6. The stockpiled materials and processing piants shall be placed outside the 100 year floodplain; 7. The app'licant shall w'iden their access onto County Road 309, according to the County Road Supervisor's requirements; B. The applicant shall widen county Road 309 at the entrance of theproject area, to provide modified accel-decel lanes for truck traffic, accordi ng to the County Road Supervi sor' s requ'ir.ements ; 9. The applicant shall provide on-going maintenance (grading, gravelling, dust.suppressant, etc) and necessary improvements (widening,-reilignmenti, etc. ) to County Road 309 from project s'ite to its interseciion w'iti County Road 301, accord'ing to County Road Supervisor requirements; 10. The appficant shall not proceed with hauling activities between the hours of 7:45 A.M. - 8:15 A.M. and 3:30 P.M. - 4:15 p.M. weekdays,if County Road 3ll9 is used as an active school bus route, so as to protect school children and school busing operations during these hours; 11. The applicant shall not haul east on the county roads from the mine site, or north on county Road 309 through the Rulison area, ona through route basis; 72.
