Mackley Elmer (Buckey) Arbaney Marian I. Smith Don DeFord Mildred Alsdorf Chuck Deschenes , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board , County Administrator when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 95-062 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION FOR UMETCO MINERALS CORPORATION. WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from UMETCO MINERALS CORPORATION for a Special Use Peimit to allow for the Extraction of Natural Resources in the A/I Zone District (Sand and Gravel), at the following location: Part of Lot 9 (SE1/4,SW1/4) and part of Lot 10 (SW1/4,SW1/4), Section 18, T.6 S., R.93 W. of the 6th P.M. WHEREAS, the Board held a public hearing on the 10th day of July of 1995, upon the question of whether the above-described Special Use Permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use Permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. *4f31781 B-949 P-827 08/95 10:16A PG 2 OF 2 3. The proposed use is compatible with the existing and permitted uses in the A/R/RD Zone District, provided that certain hereinafter conditions be complied with. 4. That neither the impact on traffic volumes and safety, or any other impact of the special use will be injurious to the established neighborhood or zone district in which the special use is to be located, provided that certain conditions be complied with. 5. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Special Use Permit be and hereby is authorized permitting the Extraction of Natural Resources (Sand and Gravel), subject to the following specific conditions: 1. All representations of the applicant, either within the application or stated before the Board of County Commissioners shall be considered conditions of approval unless stated otherwise by the Board. 2. Water will be used as a dust suppressant in the pit area and the haul road on a regular basis to mitigate any adverse impact from dust emissions extending beyond the immediate project area.
