for Garfield County, Colorado, held at the Commissioners'
at the Garfield County Courthouse in Glenwood Springs on
day of November A.D. 19 87 , there were present:

when the following proceedings, among
others were had and done,
RESOLUTION NO. 87-119
to -wit:
A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT
APPLICATION BY WALTER H. STRONG.
WHEREAS, the Board of County Commissioners of Garfield County,
Colorado, has received application from Walter H. Strong for a Special Use
Permit for a Guest House on the following described tract of land:
See Exhibit "A"
(in the State of Colorado and the County of Garfield); and
WHEREAS, pursuant to required public notice, the Board held a public
hearing on the 9nd day of November, 1987, upon the question of whether the
above-described Special Use Permit should be granted or denied, at which
hearing the public and interested persons were given the opportunity to
express their opinions regarding the issuance of said Special Use Permit;
and
WHEREAS, the Board on the basis of substantial competent evidence
produced at the aforementioned hearing, has made the following
determination of fact:
1. That proper publication and public notice was provided as
required by law for the hearing before the Board of County
Commissioners.
2. That the hearing before the Board of County Commissioners was
extensive and complete, that all pertinent facts, matters and
issues were submitted and that all interested parties were heard
at that hearing.
3. For the above stated and other reasons, the proposed use is in
the best interest of the health, safety, morals, convenience,
order, prosperity and welfare of the citizens of Garfield County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Garfield County, Colorado, that the Special Use Permit be and hereby is
authorized permitting the use of the above described tract of land for a
Guest House, upon the following specific conditions:
1. All proposals of the applicant shall be considered conditions of
approval unless stated otherwise by the Board of County
Commissioners.

2. That the proposed Guest House be no larger than 1,000 sq. ft. in
habitable floor area, and that it shall not be used as a rental
unit.
3. That prior to issuance of the Special Use Permit, the applicant
complete the boundary line adjustment with the adjoining property
to create a parcel of 3.0 acres in size.
4. That prior to issuance of the building permit, the applicant
receives either approval to utilize the existing individual
sewage disposal system for the Guest House, or takes out an
application to expand the existing system, or to build a separate
system for the Guest House.
5. The applicant shall have 120 days from the date of the Resolution
of Conditional Approval to meet all conditions set forth in the
Resolution. The Special Use Permit shall be issued when all
conditions are met and shall expire after 120 days unless
construction or use has commenced within this period.

constructed and in place and northerly of the southerly line of
said Lot 11; said parcel of land is described as follows:
Beginning at a point whence the East Quarter Corner of
Section 29, Tp. 7S., R. 88 West of the 6th P.M. bears: N.
22°43'30" W. 6710.20 feet; thence N. 89°55'00" E. 372.53 feet to
a point on the westerly line of said county road; thence S.
23°30'00" E. 190.83 feet along the westerly line of said county
road; thence S. 54°39'00" E. 185.16 feet along the westerly line
of said road; thence N. 89°26'00" W. 113.57 feet to a point on
the southerly line of said Lot 11; thence S. 89°28'00" W. 480.52
feet along the southerly line of said Lot 11; thence N. 01°07'00
W. 284.97 feet to the point of beginning, together with all
improvements thereon and all fixtures of a permanent nature,
currently on the premises except as hereinafter provided in their
present condition, ordinary wear and tear excepted, known as No.
2091 106 Road, Carbondale, Colorado, and hereinafter called the
Property.
