When Chuck took on this project as the owner representative he and I had a meeting about safety concerns in the building and we discussed the type of fire alarm system set-up I mention in my attached email. Peter I gave you a har d copy of this email at this afternoons inspection. I will be out of my office after today until Monday November 3rd and unavailable to address any questi ons on this matter. The reason you do not need to add a fire sprinkler system to the units is because the units' use in theory have not increased or changed over the years. The occupancy or use of the units as per the building code is Residential R-2 apartment houses where the occupants are primarily permanent in nature. The plans show a mix of one and two bedroom apartments. Any change to this to include the conversion of living rooms, closets or other areas to bedrooms, or increasing the number of tenants would require a new building permit to change the occupancy to R-1 boarding 1 house. Fire sprinkler systems and land use permits would need to be obtained with this increased use of the structures and units. Based on recent inspections, it would appear some areas not list as bedrooms are being used as bedrooms. Having refrigerators or microwaves in addition to kitchens in the apartments is not allowed for these areas. Having mixed families or non-family members in the same apartment is not allowed . Increasing the density of occupants is a violation of the building code, will tax your already limited sewage, jeopardize your agreement for tap fees with the city for sewage and also require a new building permit to change the occupancy to R-1 outlined above. In the past and hopefully not in the future, there has been an issue of public health associated with these units. Should this happen again, you as the owner of the property will be held accountable for all public health issues. Bed bugs, roaches, failing septic, overcrowding conditions, accumulation of trash all can generate a public health claim from the county. Please note, we will do periodic Inspections of the property. Any complaints by tenants or neighbors will generate a thorough investigation. The county does appreciate the volume of work you have done to upgrade the electrical and structural deficiencies, clean up the general property and removal of the various lock off sleeping areas. We are very glad you have a partial hook up for sewage with the city. This will help with final transfer of all the septic requirements for the property to be achieved by the central city system sometime in the future. I believe all that is left to cover are the items listed above and a final letter from the structural engineer. We can discuss any questions you might have and some minor items of concern from our last inspection next time you are in the valley. Thanks for your cooperation with the ongoing process. What type of smoke detection was installed in the units? By code the 4 p1ex would be requi red to be sprinklered per section 903.2.8 of the International Fire Code but that is not going to happen. In place of sprinklering we are r equ iring the next best option to have a fire detection system installed in the building that under specific fire conditions in one unit the systems in all the units would be activated to notify those tenants. About a month ago I called and left you a message about this requirement. The system I found that can be installed to operate as I described is a wireless system which also eliminates running wire to each detector. The one contract t hat I am aware of that can install this system is Vision Security, 945-4019. Also a few weeks ago I gave Ed Johnson from Vision your contact information and he said he also left you a message and did not hear back from you. Before you leave town please get this get this part of the project moving forward. As you know, I have been involved in this property as a liason between the property owner, Peter Cantrup, and the Garfield County Building Department. This arrangement has had it's ups and downs and the progress that I expected has not occurred. While this has become a tedious task I have as of late seen some encouraging changes instigated by the owner. Mr. Cantrup when confronted with a new deadline by the County came to Glenwood from his home in New Mexico and spearheaded considerable work. This mainly involved the cleanup of the property, but also included his contacts with Brian Kurtz as a structural engineer for the project, a sewer engineer, arrangements to remove file:///C:/U sers/dbartholomew/ AppData/Local/Microsoft/Windowsff emporary%20Intern. .. 12/18/2014 both of the trailers from the property (I've been told one will be removed this week and the other next week), and the reintroduction of George Zelenka as the electrical contractor willing to make the necessary improvements to make the property safer. While Mr. Cantrup has not been willing to vacant the tenants from the buildings as I have advised, he has made efforts to make the property safer. I have been told that all necessary smoke and carbon monoxide detectors have been installed, the pumping of the septic tanks (2) has been completed, the sewer cleanout has been installed and the damaged water heater flue piping has been replaced. Many of you know that I will be going out of town for a full month starting this weekend (April 11 ). I will be in the Grand Canyon without phone or internet access. I will be returning May 11th. I want all parties to realize that I cannot be responsible for any activities that occur while I am gone. Peter Cantrup has asked that I pass on to you his contact information. He will be the party solely responsible for communication, inspections and any construction activity from this point on. When I return we will reevaluate the need for my position, but it should not be assumed that I will continue in my role with this project. Again, I want to make it very clear that I feel this property should be vacated until all parties feel confident that any occupants are safe. But it is not my position to dictate to anyone how to proceed with the corrections required by the County. Mr. Cantrup informed me that he planned to call for an inspection of the property early next week. At that time he expects to have met all of the County Building Departments latest requirements. I was happy in meeting both of you in person the other week in your offices. I have delayed in responding to your letter dated March 29th until I had as much information and progress to share with you as possible regarding 1573 County Road 154, Glenwood Springs. Regarding the Health and Safety issues section of your letter; Item a. I have engaged Carla Ostberg to assist with the Septic engineering report. I believe she may have made contact with your office directly. She is an expert in her field and so far she has been in contact with B & R Septic Service as a beginning. I am attaching two invoices from B & R. These reflect that they pumped out both septic tanks, one on May of2013, and recently the other, at the end of March, 2014. In talking with Roger at the site, he indicated that there was nothing out of the ordinary that he could see or detect, and everything was at the right levels and seemed in good working order. The odor that was smelled was caused by ... what we thought. .. was a faulty septic lid that was ajar and only covered with two inches of gravel. Roger repaired that -with some gasketing material and then plastic covering over the lid. I myself smelled an odor while I was there .. after Rogers' repairs 2 weeks ago. I followed my nose and .. definitely believe it was not coming from my property, but from somewhere next door at Riverside cottages. In any case Carla will continue her work towards a report for the county. Item b. I have engaged Mr. Brian Kurtz from Kurtz Engineering to prepare a report on the alterations and additions to the structural elements. Brian met with me 2 weeks ago and he did a complete onsite inspection of the various elements of your concerns. He expressed to me that there was not any life safety worries that he could see, and that he would begin work on a report detailing that. He may have contacted your office directly as well. As of today I do not believe he has been able to start working on this project 100%, ... because of other commitments he had to finish, but I did speak with him last week and he was close to starting. Building 'A', Unit 2A: Unit 2A is located at the south end of the main level of the subject building. Brian Kurtz, P.E. of our office performed a structural inspection of this unit on July 01, 2014. The purpose of the inspection was to review two (2) interior conditions: 1. There is an interior partition constructed on top of the carpet and pad. The partition does not appear to be a load bearing wall, so this does not appear to be a structural issue. A 9'-2" long section of interior wall has been removed and replaced with a wood sawn, double (2) - 2 x 12 header. A structural inspection verified that both of these two (2) interior partitions were not load bearing and provide no structural function . An inspection of the attic revealed that the roof system is constructed with pre- manufactured roof trusses spaced at 24" on center, and clear spanning 24 '-0" east-to- west. The trusses bear on the east and west exterior walls of the unit. Building 'B', Crawl Space Foundation: Our office issued construction documents for the repair of the foundation (Construction documents dated 07/01/14). Brian Kurtz, P.E. performed two (2) inspections during the course of the foundation repairs to verify that footing sizes, soil bearing conditions, and concrete reinforcement were in accordance with the construction documents. With some luck with the exception of the septic lift station, Peter should be done this week with the permit related items. Ron wanted to go with us to do his walk through. Ron had a renter in his office this week with an issue on the alarms. Since the alarms are wired in together, someone burning toast in one unit triggers the entire building. There may be an option to isolate the alarms unit to unit worth looking at. We set up the inspection for 2:00 Thursday. Phone (970) 945 6305 Fax (970) 945 1093 Oct. 17, 2014 4'-0" Awning Roofs at Building 'A' and Building 'B': A majority of the awning roofs which project 4' -0" from the face of the respective buildings were constructed level. Our office issued, as part of a set of structural repairs, a timber knee brace detail to reinforce those roofs . See Sheet S-1 of structural drawings dated 06/30/2014 . At this time all the flat roofs have either been removed or reinforced in accordance with the structural drawings . The sloping 4' -0" awning roof above the exterior stair on the north side of Unit 2A, Building 'A' was addressed in a different manner. A total of three (3), 90 degree, structural steel brackets were installed at 3 '-2,, on center along the stair . The welded brackets are constructed with a steel angle (L 4 x 4 x 1/4) and a 1/4" x 4" steel plate. The horizontal leg of the bracket bolts to a double 2 x 6 rafter, and the vertical leg attaches to the building with lag screws as per the timber knee braces . I inspected and approved a mock-up of the brace on 08/12/2014 (prior to erection), and I inspected the three (3) installed braces on 10/03/14. As installed, the three (3) structural steel brackets significantly improve the strength of the awning roof above the stair. It is my professional opinion that the sloped awning roof is now structurally adequate to resist a design snow load of 40 PSF. Building 'B', Crawl Space Foundation: Our office issued construction documents for the repair of the foundation (Construction documents dated 07/01/14). To follow is a description of status and what is ahead. STRUCTURAL We are diligently working on the tasks we need to complete for final inspection, and we have made very 1 good progress so far. My biggest problem has been waiting for the professional people tha t we need to stamp designs an d drawings, .. are busy with a lot of projects. for example Brian Kurtz -Structural Engineer. He is a very good choice I think for this type of work we have. I am in almost daily co ntact with him over the las t mon th s. explaining my deadline to him. He has p romised over and over again each week to give me drawings and instructions ... bu t something always gets in the way. He is short handed for one thing ... and also his Mother recently became ill and unfortunate ly passed away. Just yesterday July 2, I finally received a draw ing on the design of the concrete work to be done in the basement of Building B. I immed iately set out to get bids from a couple of contractors, however I am at the mercy of their sched ules ... and right now i t is an unknqwn as to when th is work can begin, but I am pushing as hard as I can. Also from Brian we received some d rawings on the awning supports, which I have not seen yet. As of th is morn ing, he has not sent it yet via PDF. According to Hans, it looks to him like the carpenter could mass p roduce these knee braces and get them installed ... but without my own eyes on it, I reserve judgement on this. Regarding the carpenter, since we had a slowdown of waiting, he went and took on other work. We lost some time getting him back in action ... but are movi ng again now. There is still some work to be done on doors and passageways. We have not received Brian•s recommendations for the stair support addi t ions to the outside stairwell of building B. He keeps saying he will have that r eady soon. That is the majority of Brian's scope of work, but as I explain, .. I need time to get the ac t ual wo rk done once he delivers his plans. FYI, he did take an analysis of the structural beam (Item 14) on p lans and he feels it is structurally sound as it exists. He will put that d own in writi ng I am sure when we get everything completed and turned in to yo u for the file. ELECTRICAL Regarding the Electrical work, I believe that is almost com p lete. I am working hard on the septic. It is real problematic with the setbacks. She has been working hard trying to make things fit, but it is just too much it looks like under the new regs. The physical work appears to almost be completed . The Use of the structures still needs some major changes In order to provide for the minimum requirements for health and life safety. How the occupants are using the structure and number of people using the structures has been discussed several times in the past months. This needs to be addressed again and corrected before we can close out the permit. Presently, rooms not designated as bedrooms are being used as bedrooms. In addition, rooms designated as bedrooms have refrigerators, cooking appliances and wet bars. Based on yesterday's inspection, bedrooms within designated one or two bedroom apartments are being locked off and used as boarding rooms. The net result of all this Is overcrowding of the structures with people, appliances and general clutter. This greatly affects emergency egress out of the apartments and the ability of emergency personnel to access the structures If there Is a fire or ambulance call. This Increased use Is also against the building code. Based on recent tenant complaints to the fire district, smoke detectors are tripping all the time. It has become evident that the various hot plates, toaster ovens, and microwaves being used In bedrooms are generating whole structure alarms to sound. These alarms are actually doing what they are designed to do, and the use of the bedrooms for cooking Is the problem . At some point In time, tenants will Ignore the fire alarms or could disable them out of the frustration of hearing them go off. Do to the above Items, the size of the various rooms and units, and the use of the various rooms, the following requirements need to be met before we can close out this permit: • Occupancy per bedroom or apartment Is limited to one person per bedroom unless the bedroom Is occupied by two people. Not all bedrooms wlll have 2 two people. • All cooking is limited to kitchens. Microwaves, hot plates, toaster ovens and refrigerators are not allowed In bedrooms, living rooms, or storage areas. • Living rooms and storage areas cannot be used as bedrooms. • The units are one and 2 bedroom apartments. Rental of individual rooms as efficiency apartments ls not allowed without a new building pennlt to change the use and layout of the buildings •. • Units must have all clutter removed from egress paths at all times. • Fire district must sign off on smoke alarm systems. These Items need to be addressed Immediately and corrected within 30 days from the date of this letter. Failure Jn compliance will result In legal action by Garfield County.
