APPLICANT: John Runyan LOCATION: Section 18, T6S, R93W; located approximately 1/8 mile west of Rifle off County Rd. 264. WATER: N/A SEWER: N/A ACCESS: Existing ZONING: R/L (Lower valley and gentle slopes) ADJACENT ZONING: North - R/L South - C/G amd City East - R/L West - PUD I. COMPREHENSIVE PLAN The site falls within District C of the Comprehensive Plan. Rural areas with minor environmental constraints. II. PROJECT DESCRIPTION A. Site Description: The site is approximately 3.3 acres in size and is vacant land which has been encroached upon by gravel operations. B. Description of the Proposal: The applicants propose to reclaim the original Loy gravel pit adjacent to the subject parcel. The encroached upon 3.31 acre parcel will be recontoured using a portion of the soils to facilitate the reclamation of the original Loy pit. III.MAJOR ISSUES AND CONCERNS 1. The operation is exclusively for the rehabilitation and titrreclamation of the gravel pit. 2. The applicant has m de the proper application with the MLRB for rehabilitation and reclamation. 3. The application refers to the amended application for Mining and Reclamation which states that use shall be designed and operated in compliance with all applicable laws and regulations of the County, State and Federal government and will not have significant adverse affects on water or wildlife; nor will there be effects from vapor, dust, smoke, noise or truck traffic. • • IV. FINDINGS: 1. That the proof of publication and public notice was provided as required by law for the hearing before thezl_anR g� - - 2. That the hearing before the Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. That for the above stated and other reasons, the proposed zoning is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION: Approval of the Special Use Permit to extract a natural resource with the following conditions: 1. That the use of the tract of land comply with all present and future regulations of Garfield County relating to industrial operations in the zone district in which the property is now or may later be located. 2. All proposals of the applicant shall be considered conditions of approval unless stated otherwise by the Board of County Commissioners. 3. That all conditions must be met within 120 days and that the said Special Use Permit shall be taken out within one year of the date of issuance of the resolution approving the Special Use Permit. 4. That prior to the issuance of the Special Use Permit, the applicant shall submit, to the Department of Development, all other permits from other government agencies. 4s 1910. app -14- -P
