BACKGROUND AND DESCRIPTION OF THE PROPOSAL This is an amended and corrected plat application for an approximately 165 acre common ownership parcel which includes eight (8) Antlers Orchard Development (AOD) tracts and two parcels created through the Garfield County Exemption process in 1990 (Barrie Exemption). The intent of this application is to correct mistakes in the legal description in the 1990 Exemption Plat, to add AOD Tract property lines and to adjust a couple AOD tract property lines. The Exemption Plat as recorded in 1990 has both an error in the legal description and does not include the AOD tracts which are legally sellable parcels despite the approval of the Barrie Exemption Plat. As such, the Applicant has presented this request in three applications, as follows: 1. Correct the aforementioned deficiencies within the recorded Exemption Plat of 1990; 2. Conduct a Boundary Line Adjustment; and, 3. Amend the AOD subdivision tracts 11B and 23B. Although these three applications are presented here as one, it is procedurally necessary to approve the correction application prior to the amendment of the AOD tracts or completion of the Boundary Line Adjustment. Since this application was deemed technically complete prior to January 1, 2009, the applications were reviewed for compliance with the Zoning Resolution of 1978, as amended. STAFF RECOMMENDATION Corrected Plat (ACP11008) The Applicant has provided all required documentation and has satisfied the applicable standards for this corrected plat. Therefore, Staff recommends the Board of County Commissioners APPROVE this corrected plat request with the following conditions: 1. That all representations of the Applicant, either within the application or stated at the meeting before the Board, shall be considered conditions of approval. 2. Within 90 days of approval, the Amended Final Plat shall be reviewed (paper copy), then signed and dated (mylar copy) by the County Surveyor, then signed and dated by the Chairman of the Board and recorded in the Clerk and Recorder's Office of Garfield County. The Corrected Final Plat shall meet the minimum CRS standards for land survey plats, as required by Colorado state law, and approved by the County Surveyor and shall include, at a minimum, the information outlined in §5:22 and the pertinent certifications as outlined in §14 of the Garfield County Subdivision Regulations. Identify Parcel A including acreage on Corrected Plat. Amended Plat (ACP11108) The Applicant has provided all required documentation and has satisfied the applicable standards for this plat amendment. Therefore, Staff recommends the Board of County Commissioners APPROVE this amended plat request with the following conditions: 1.
