[!t r! #.r tL I IJ LUILH r Z ot 4 R o.oo D o.oo GnRFri[d-cbunrv co STATE OF COLORADO County of Garfield At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners'Meeting Room, Garfield County Courthouse, in Gienwood Springs on Mondav , the-_ 9t_h_ day of Auqust A.D 19 t9 , there were present: John Martin , Commissioner Chairman , Commissioner Larrv McCown , Commissioner Don DeFord , County Attorney , Clerk of the Board , County Administrator when the following proceedings, among others were had and done, to-wit: RESOLUTION NO. 99-082 A RESOLUTION CONCERNED WITH Tt{E APPROVAL OF A SPECIAL USE PERMITAPPLICATION FOR TRANSCOLORADO GAS TRANSMISSION COMPANY WHEREAS, the Board of County Commissioners of Garfield County, Colorado, hur '' received application from TransColorado Gas Transmission Company for a Special Use permit to allow for the placement of a liquified petroleum products pipeline from the site identified in the application: WHEREAS, the Board held a public hearing on the 22nd day of June 1998, upon the question of whether the above-described Special Use Permit should be granted or denied, atwhich hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special use permit; and ) )ss ) L [lUI tu,|; t! H] t|l l[il'! lSlLUL U ttlllll! | 3 of 4 R O.OO D O.OO GRRFIELD COUNTY CO WHEREAS, the Board on the basis of substantial competent evidence produced at theaforementioned hearing, has made the following determination of fact: 1' That proper publication and public notice was provided as required by law for thehearing before the Board of County Commissioners. 2' That the hearing before the Board of County Commissioners was extensive andcomplete, that all pertinent facts, matters and issues were submitted and that allinterested parties were heard at that hearing. 3 ' That the application is in compliance with the Garfield County ZoningResolutionof 1978, as amended. 4 For the above stated and other reasons, the proposed use is in the best interest ofthe health, safety, morals, convenience, order, prosperity and werfare of thecitizens of Garfield County. NOW, TImREFORE, BE IT RESOLVED by the Board of County Commissioners ofGarfield county, colorado, that the Special use Permit be and hereby is aiproved to allow for theplacement and operation of a natural gas pipeline, upon the followinjspecific conditions: l' All proposals of the applicant shall be considered conditions of approval unless statedotherwise by the Board of County Commissioners. 2 The applicant shall have 120 days from the date of the Resolution of conditional Approval tomeet all conditions set forth in the Resolution. The Special Use permit shall be issued whenall conditions are met and shall expire 120 days after issuance, unless construction or use havecommenced. AII revegetation shall be in accordance with the revegetation agreements approved uy .u.t,property owner. AII revegetation shall be conducted with certified week-free geed.TransColorado Gas Transmission Company shall be responsible for weed control inaccordance with State and County regulations Prior to construction, the applicant shall obtain approval of the.proposed crossings of CountyRoads from the o"{.,,.d county Road and Bridgl supervisor, incruding appropriatenotification of the public oinecessary closing daJes and times. Additionally, apre-construction survey of road conditions will be developed with the Roai and Bridgedepartment' overweight vehicle permits shall be u.qri."o uy the applicant or subcontractors.
