HomeMy WebLinkAbout5.0 Resolution 2000-991 111111 11111 111111 11111 11111 1131 11111 111 11111 1111 1111 573815 12/19/2000 11:05A B1222 P905 M ALSDORF 1 of 2 R 0.00 D 0.00 GARFIELD COUNTY CO STATE OF COLORADO )ss County of Garfield At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on Monday , the 18th day of :December 2000, there were present: John Martin Larry McCown Walt Stowe Don DeFord Mildred Alsdorf Ed Green , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board , County Administrator when the following proceedings, among others were had and done, to -wit: RESOLUTION NO.0200© — 9 A RESOLUTION CONCERNED WITH THE RESCISSION AND REPEAL OF A SPECIAL USE PERMIT APPLICATION FOR WESTERN SLOPE AGGREGATE APPROVED BY RESOLUTION NO. 2000-62 WHEREAS, the Board of County Commissioners of Garfield County, Colorado, received application from Western Slope Aggregate concerned with a Special Use Permit to allow for natural resource extraction (sand and gravel mining) and processing (concrete batch plant) and mining in a flood plain; WHEREAS, the Board held a public hearing on the 20th day of June 2000 upon the question of whether the above-described Special Use Permits should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use Permits; and WHEREAS, the Board conditionally approved the above described Special Use Permits by Resolution No. 2000-62, but did not issue the Special Use Permit. WHEREAS, pursuant to the settlement of Case No. 00CV203-A, Western Slope Aggregate has agreed to request rescission and repeal of Resolution 2000-62. 1 11 1111. That the Special Use Permits conditionally approved by Resolution No. 2000-62 for natural resource extraction (sand and gravel mining), processing (concrete batch plant), and a floodplain permit for mining, be rescinded and repealed. 2. That the action taken herein was done without public notice, pursuant to an agreement with the Town of Silt and Western Slope Aggregate. / Dated this 4, day of � rn �'� , A.D. 2000.
