RELATIONSHIP TO THE COMPREHENSIVE PLAN: The site falls within districts C & D of the ecenpvirhensive plan. These are rural areas with minor and moderate constraints. Site__Descriptio_n: The site is approximately 3.61 acres in size and has several existing uses. There is one residence and a roofing company currently on the 3.6 acre site. B. MAJOR ISSUES AND CONCERNS The applicants have an agreement with Austin Heuschkel to supply a sewer tap limited to one 4" tap, delivering one household or domestic type waste, or it's equivalent, for the 1.6 acre parcel. The proposal for the 1.6 acre parcel is to build mini -storage units. A letter from Mr. Heuschkel stating that the mini -storage units will demand the equivalent to one household or domestic type waste should be obtained. 2. The applicants have an absolute decree for .022 cubic feet per second of water. They wish to serve both parcels with water from the one existing well. Previous approval of the commercial park approved the use of the well for the same uses that are proposed now. 3. The previous approval of the commercial park limited the parcel to a residence, mini -storage units and a general service establishment. If this 5.13.35 exemption is granted it will be necessary to firmly establish that the newly created 1.6 acre parcel will only be allowed to establish either a use by right in the C/L zone district or the mini -storage units as were approved in the commercial park Special Use Permit. An additional residence and a general service establishment would not be allowed on the 1.6 acre parcel. The intention of the commercial park Special Use Permit, when it was granted in 1981, was that only one residencek('existing), one general service establishment (existing roofing company) and mini -storage units would be allowed on the 3.6 acre site. 4. The commercial park Special Use Permit had as condition #5 (see Resolution #81_367, Pageja_h j ) that the mini -storage shall be limited to 3 buildings and approximately 254 units. According to the Special Use Permit file, approximately 80 of the 254 mini -storage units approved are on the proposed parcel #1 and the rest are on proposed parcel #2. Condition #6 states that the parking area for the mini -storage shall be graveled. The Planning office has various surveys of the site that are confusing. The actual acreages of the parcels are not clear according to the surveys on file in the Department of Development office. To keep a clear picture of the property, it is necessary that a survey providing the correct boundaries and acreages of each parcel be submitted to the Department of Development Planning office and that a plat of the property be recorded in the Clerk & Recorder's office. 1. 7 6. Resolution #80-151 states that no further exemptions shall be allowed for parcels A & B. The boundary lines of the applicant's property has since changed however, if this exemption is approved, technically, Parcel B of the original exemption will be granted an additional exemption. 4. That for the above stated and other reasons, the proposed zoning is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. RECOMMENDATION Approval of the S.B.35 exemption with the following conditions: 1 That the use of the tract of land comply with all present and future regulations of Garfield County relating to the zone district in which the property is now or may later be located. 2. All proposals of the applicant shall be considered conditions of approval unless stated otherwise by the Board of County Commissioners. 3. The applicant shall submit a letter from Austin Heuschkel to the Planning Division prior to final approval stating that the mini -storage units to be placed on the 1.6 acres lot will have the equivalent to a domenstic or household type waste associated with them and that the sewer tap agreement with the applicants will be honored for that use. 4. That the commercial park Special Use Permit (Resolution # 81-367) phall apply to both parcels created however the 1.6 acre parcel shall only be used for the proposed mini -storage units. If the mini -storage units are not built, the 1.6 acre parcel shall only be used for uses by right in that zone district. 5. If Parcel #2 (the 1.6 acre parcel) is not used for mini -storage units, Parcel #1 (the 2 acre parcel) shall only be allowed to have approximately 80 mini -storage units. 6.
