Re: Stowe S.B.35 Exemption
Dear Keith:
This is in response to Hal Simpson's letter dated September 29, 1983. The
Stowes were granted an exemption by the Garfield County Commissioners on
October1, 1983. The exemption is to divide a 3.6 acre parcel into 2
parcels of 1.6 and 2 acres. The existing well will serve both parcels.
The Stowes intend to retain both parcels. The 1.6 acre parcel will be
used only for mini -storage units.

Dear Ms. Houben:
We have reviewed the above referenced proposal to divide 3.61 acres into
two parcels. There is an existing well; Number 34292. This well is decreed
in Water Court Case W-1798.
We believe the adjudication of the well only established a water right for
the historic use which is apparently one dwelling. Nonetheless, we would not
object to this well being shared provided an agreement for joint ownership
operation and maintenance, and easement is developed. Optionally, we could
make a well permit available for household use only. In this case, we would
ask that prospective purchasers be advised that the use of water from this
type well for outside purposes (lawn, livestock, ect.) is prohibited. We
suggest a copy of this letter be given to prospective purchasers and submitted
with the well permit application.
We can recommend approval of this proposal based upon either of the water
supply plans. We ask that a specific plan be chosen and transmitted to this
office since we can allow the applicants either option, but do not intend to
allow both at the same time.

Subject: Stowe Exemption Parking Easement
Hi Tamra and David: I spoke briefly with Walt Stowe and he was a great source of information. He indicated at the time
of the exemption approvals he owned the mini storage jointly with his Dad and the easement was to allow them to park
RV's and boats for storage as part of their business. It was not associated with any parking requirements for the mini
storage. It still seems appropriate for the both lot owners to sign the amended plat. That is the latest. Glenn.
