D. 19 B.Q... , there were present: , Commissioner Chairman Tria Y Ve.)..a.S.gve.a , Commissioner , Commissioner Jx.. , County Attorney ]v17.a SSG... �� Sf�lar.f , Clerk of the Board when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 80-279 RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY SUBDIVISION REGULATIONS FOR SEBASTIAN BRUNGS WHEREAS, Sebastian Brungs has petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of a 96.3 acre tract described as follows: That parcel of land as described in Document No. 244831 as filed in the Office of the Clerk and Recorder of Garfield County, Colorado, into 2 tracts of approximately 17.5 and 78.8 acres each, more or less, which proposed divided tracts are more particularly described as follows: A portion of Lot 7 and the SE1 SW4 of Section 6 and Lot 1 and the NE4NW4 of Section 7, Township 5 South Range 90 West of the Sixth Principal Meridian, more particularly described as follows: Commencing at an iron post and brass cap properly marked and found in place for the Witness Corner to the Southwest Corner of said Section 6; thence N. 00°55'59" East 66.00 feet to the true Southwest Corner of said Section 6; thence along the West Line of said Section 6 North 00°26'04" East 1117.47 feet to the True Point of Beginning; thence South 56°23'34" East 2062.29 feet to a point in the centerline of East Elk Creek; thence along said centerline South 53°57'02" West 189.51 feet; thence along said centerline South 69°20'28" West 61.85 feet; thence along said centerline South 77°33'18" West 203.09 feet; thence along said centerline South 71°41'16" West 35.40 feet; thence along said centerline South 40°13'48" West 103.82 feet; thence along said centerline South 16°40'45" East 171.06 feet; thence leaving said centerline North 44°13'53" West 1804.48 feet to the West Line of said Section 6; thence along said West Line North 00°26'04" East 279.88 feet to the True Point of Beginning; containing 17.50 acres, more or less. (in the State of Colorado and County of Garfield); and WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the proposed division does not fall within the purposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that the impact created is not large enough to proceed through the full subdivision review, and WHEREAS, the Petitioner has demonstrated Board of County Commissioners of Garfield County, reasonable probability of locating domestic water that there is adequate ingress and egress to said of septic tanks will be permitted by the Colorado the requested division is not part of an existing or larger development and does not fall within the general purposes and intent of the subdivision reg- ulations of the State of Colorado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and to the satisfaction of the Colorado, that there is a on each of said tracts, tract, that the location Department of Health, that BOOK 560 P'ct748 "subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended; NOW, THEREFORE, BE IT RESOLVED that the division of the above described tract "A", from the above described 96.3 acre tract is hereby exempted from such definitions and said tract may be divided into tract "A", all as is more fully described above, and said divided tract may be conveyed in the form of such smaller tracts without further compliance with the aforesaid subdivision statutes and regulations; provided, however, that this exemption is granted on the condition and with the express understanding and agreement of the Petitioner that no further exemptions be allowed on said tract "A", nor on the remaining 78.8 acre tract, and that a copy of the instrument or instruments of conveyance when recorded shall be filed with this Resolution.
