RESOLUTION
WHEREAS, SEBASTIAN J. BRLINGS, has petitioned the Board of County
Commissioners of Garfield County, Colorado, for an exemption under C. R. S.
(1973) Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision
Regulations of Garfield County, Colorado, adopted September 1, 1972 and
amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the division
of a 154 acre tract of land into two tracts of 2 and 152 acres, more or less,
and said 154 acre tract is more particularly described as follows:
Section 6, Lot 7 (40.46 Ac), that pt. of SESW lying
North and East of East Elk Creek. Section 7, Pt. of
Lot 1 and NENW, Lot 2 (38.92 Ac) Except a tract
containing 1.45 acres in the S2 of Lot 2 described
as Beginning at the SW Corner of Lot 2, thence North
87° 27' E. 277.2 feet thence North 73° 43' East 195
feet, thence N. 64° 03' East 81.5 feet, thence North
820 34' East 54.3 feet, thence South 70° 14' East
32.4 feet, thence South 86° 48' East 445.4 feet,
thence South 70 23' East 75 feet, thence North
89° 58' West 1076 feet to the point of beginning.
Total 153.37 acres.
WHEREAS, the Petitioner has demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that he desires
said exemption for the purpose of re -sale into single-family residential
acreage; and,
WHEREAS, the Petitioner has demonstrated to the satisfaction of the
Board of County Commissioners that there is a reasonable probability of
locating domestic water on each of said tracts, that there is adequate ingress
and egress to said tracts, that the location of septic tanks will be permitted
by the Colorado Department of Health, that the requested divistn is in
accordance with the general purposes and intent of the Subdivision Regulations
of the State of Colorado and the County of Garfield and should, therefore,
be exempted from the definition of the terms "subdivision" and "subdivided
land" as set forth in C. R. S. (1973) Section 30-28-101 (10) (a) - (d) as
amended;

is hereby exempted from such definition and transfer of said tract may be
made by division into two tracts of 152 and 2 acres, more or less, all as
is more fully described above, and further, that said exemption is conditioned
upon the Petitioner obtaining a proper legal description of said tracts prior
to any conveyance thereof. A copy of the instrument(s) of conveyance when
recorded shall be filed with this Resolution.
