Koss, Deputy , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 81-106 WHEREAS, Bob Bradley has petitioned Garfield County, Colorado, for an exemption "subdivision" and "subdivided land" under C. amended, and the Suhdivision Regulations of January 2, 1979, Sections 2.02.21 (d) and 3. described as follows: the Board of County Commissioners of from the definition of the terms R.S. 1973, 30-28-101 (10) (a) -(d), as Garfield County, Colorado, adopted 02.01 for the division of a 6 acre tract In document #273466 filed in the Office of the Clerk and Recorder of Garfield County, Colorado into three tracts of approximately 2 acres each, more or less, which proposed divided tracts are more particularly described as follows: Tract A: A parcel of land situate in the NW 1/4 of the SW 1/4 of Section 25, Township 5 South, Range 92 West of the 6th Principal Meridian, being more particularly described as follows: Beginning at a point whence the East 1/4 Corner of said Section 25 hears N77°41'49"E 4618.08 feet; thence S89°12'30"W 171.52 feet; thence S00°47'30"F 370.55 feet; thence N89°12'30"E 250.60 feet to a point on the Westerly boundary line of a parcel of land more particularly described as Document #290249 of the records of the Clerk and Recorder's office of Garfield County, Colorado; thence N00°47'30"W 300.00 feet along said Westerly boundary line of Document #290249; thence S89°12'30"W 83.58 feet; thence NO2°51'38"E 70.70 feet to the point of beginning, containing 2.00 acres more or less. Tract B: A parcel of land situate in the NW 1/4 of the SW 1/4 of. Section 25, Township 5 South, Range 92 West of the 6th Principal Meridian, being more particularly described as follows: Beginning at a point whence the East 1/4 Corner of said Section 25 bears N77°41'49"E 4618.08 feet; thence NO2°51'38"E 195.69 feet; thence N27°32'38"E 245.67 feet; thence S89°12'30"W 300.60 feet; thence S00°47'30"F. 411.63 feet; thence N89°12'30"E 171.52 feet to the point of beginning, containing 2.00 acres more or less. Tract C: A parcel of land situate in the N6'? 1/4 of the SW 1/4 of Section 25, Township 5 South, Range 92 West of the 6th Principal Meridian, being more particularly described as follows: Beginning at a point whence the East 1/4 Corner of said Section 25 bears N77°41'49"E 4618.08 feet; thence NO2°51'38E 195.79 feet; thence N27°32'38"E 245.67 feet; thence N89°12'30"E 94.40 feet to a point on the Westerly boundary line of a parcel of land more particularly described as Document 4263198 of the records of the Clerk and Recorder's office of Garfield County, Colorado; thence along said Vesterly boundary line of Document 4263198 on a course bearing S00°47'30"E 458.18 feet to a point on the Nbrtherly line of a 24.00 foot road easement; thence S00°47'30"E 24.01 feet to a point on the Northerly boundary line of a parcel of land more particularly described in Document #290249 of said Garfield County Records; thence S89°12'30"W 144.40 feet along said Northerly boundary line of Document #290249; thence S89°12'30"W 83.58 feet; thence NO2°51'38"E 70.70 feet to the point of beginning, containing 2.10 acres more or less. (in the State of Colorado and County of Garfield); and WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the proposed division does not fall within the purposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that the impact created does not warrant a full subdivision review, and BOOK 570 PAGE 82 WHF,REAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is not part of an existing or larger development and does not fall within the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended; NOW, THEREFORE, BE IT RESOLVED that the division of the above described tracts "A", "B", and "C" from the above described six acre tract is hereby exempted from such definitions and said tract may be divided into tracts "A", "B", and "C", all as is more fully described above, and said divided tract may be conveyed in the form of such smaller tracts without further compliance with the aforesaid subdivision statutes and regulations; provided, however, that this exemption is granted on the condition and with the express understanding and agreement of the Petitioner that no further exemptions be allowed on said tracts "A", "B", and "C", and that a copy of the instrument or instruments of conveyance when recorded shall be filed with this Resolution.
