(1973) Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted April 23, 1984 Section 2:20.49, the undersigned /3e t, respectfully petitions the Board of County Commissioners of Garfield County, Colorado, to exempt by Resolution the division of ?°6f`7` acre tract of land into 73-r4 tracts of approximately _ •(-0Y°` 7 /3S acres each, more or less, from the definitions of "subdivision" and "subdivided land" as the terms are used and defined in C.R.S. SUBMITTAL REQUIREMENTS: An application which satisfies the review criteria must be submitted with all the following information: A. Sketch map at a minimum scale of 1"=200' showing the legal description of the property, dimension and area of all lots or separate interests to be created, access to a public right-of-way, and any proposed easements for drainage, irrigation, access or utilities; B. Vicinity neap at a minimum scale of 1 "=2000' showing the general topographic and geographic relation of the proposed exemption to the surrounding area within two (2) miles, for which a copy of U.S.G.S. quadrangle map may be used. C. Copy of the deed showing ownership by the applicant, or a letter from the property owner(s) if other than the applicant; and D. Names and addresses of owners of record of land immediately adjoining and within 200 feet of the proposed exemption, mineral owners and lessees of mineral owners of record of the property to be exempted, and tenants of any structure proposed for conversion; and E. Evidence of the soil types and characteristics of each type; and F. Proof of legal and adequate source of domestic water for each lot created, method of sewage disposal, and letter of approval of fire protection plan from appropriate fire district; and G. if connection to a community of municipal water or sewer system is proposed, a letter from the governing body stating a willingness to serve; and H. Narrative explaining why exemption is being requested; and I. It shall be demonstrated that the parcel existed as described on January 1, 1973 or the parcel as it exists presently is one of not more than three parcels created from a larger parcel as it existed on January 1, 1973. The topsoil 12 - 16" is heavy loam, sub -soil is a orimovrclay from 12" to five or sire ft. sandstone is the under lying rock, covered in places by glacial fill, which has lots of boulders, sandstvie quartzite, granite & limestone, in places the glacial fill is limed together like cement. F.. The lot boarders 132 road on the east side. The city water main is on the east sideof 132 road. Aloperating well is on the larger lot. It will run two rain birds continually. A easment is on the plat to the well. The water from the well has been used for household use,when city water is riley. At this point,I don't know whether well water or city water will be used. G. The West Glenwood Sanitation District will Serve my semkr needs, (a letter is with petition) H. After 35 plus years raising fruit,flowers & raspberries, we need to cut down on the work, we need a one level house with no steps. Our double wide needs lots of roof attention to keep the ice from building up on the eves and we need gas heat so we don't have to haul coal 100 miles. I. The plat dated Sept.21,1957 shows the 10 acres as it was in 1973. Th .46acre exemption joining present exemption to the south was donated to the Holy Cross Lutheran church. Betz. The property at 0355 132 Road is within the boundaries of the Glenwood Springs Rural Fire Protection District and fire and medical response will continue as it now does. Because of the close proximity to 132 road and the availability of water supply from the nearby fire hydrant, I see no problem with granting the exemption. As with all exemptions, the Fire District reserves the right to examine and review any future development to insure that possible fire code requirements are met.
