RESOLUTION
WHEREAS, C. A. BETZ has petitioned the Board of County Commissioners
of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section
30-28-101 (10)(a) -(d) as amended, and the Subdivision Regulations of
Garfield County, Colorado, adopted September 1, 1972 and amended April
14, 1975, Sections 1.02.17 (d) and 3.02.01, for the division of a ten
(10) acre tract into two (2) parcels of approximately 0.46 and 9.54 acres,
more or less, and more particularly described as follows:
A parcel of land situated in Lot 4 of Section 6, Township
6 South, Range 89 West of the Sixth Principal Meridian,
County of Garfield, State of Colorado, lying Westerly of
the center of County Road No. 132, said parcel of land
is described as follows:
Beginning at a point in said County Road whence an iron
post with a brass cap found in place and properly marked
for the Southwest Corner of Section 34, Township 5 South,
Range 89 West of the Sixth Principal Meridian bears:
N. 46° 45' 51" W. 863.23 feet; thence S. 02° 16' 00" E.
78.22 feet along said road; thence S. 29° 29' 00" W.
113.54 feet along said road; thence S. 890 50' 00" W.
7.46 feet; thence N. 31° 26' 17" W. 174.51 feet; thence
N. 79° 27' 54" E. 153.86 feet, more or less to the point
of beginning.
The above described parcel of land contains 0.46 acres,
more or less.
WHEREAS, the Petitioner has shown to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that he
desires said exemption for the purpose of re -sale into single-family
residential acreage; and
WHEREAS, the Petitioner has demonstrated to the satisfaction
of the Board that said parcel is served by central water and sewer
facilities, that there is adequate ingress and egress to said tract,
that the requested division is in accordance with the general purposes
and intent of the Subdivision Regulations of the State of Colorado and
County of Garfield and, therefore, should be exempted from the definition
of the terms "subdivision" and "subdivided land" as set forth in C.R.S.
(1973) Section 30-28-101 (10) (a) -(d) as amended.

NOW, THEREFORE, upon motion of

and unanimously carried
said ten (10) acre tract of land is hereby exempted from such definition
and transfer of said tract may be made by division into two (2) tracts
of 0.46 and 9.54 acres, more or less, all as is more fully described in
the Petition pertaining hereto. A copy of the instrument or instruments
of conveyance when recorded shall be filed with this Resolution.
