At a regular meeting of the Board of County Commissioners for Garfield County,
Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood
Springs on Monday , the 2nd of May A.D. 19 94 , there were present:

when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 94-069
A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE
GARFIELD COUNTY SUBDIVISION REGULATIONS FOR GREGORY BEVER.
WHEREAS, GREGORY BEVER petitioned the Board of County Commissioners of Garfield
County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided
land" under C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended, and the Subdivision Regulations of
Garfield County, Colorado, adopted April 23, 1984, Section 8:00 through 8:60 and for the division of
a 25.8 acre tract as described in Reception #446504 as filed in the Offices of the Clerk and Recorder
of Garfield County, Colorado, into three (3) parcels of approximately 9.751, 9.751 and 6.296 acres in
size, more or less, with the exemption parcels more practically as follows:

(in the State of Colorado and the County of Garfield); and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County
Commissioners of Garfield County, Colorado, that the proposed division does not fall within the
purposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason
that the division does not warrant further subdivision review; and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County
Commissioners of Garfield County, Colorado, that there is a reasonable probability of locating
domestic water on each of said parcels, that there is existing ingress and egress to said parcels, that the
location of septic tanks will be permitted by the Colorado Department of Health, that the requested
division is not part of an existing or larger development and does not fall within the general purposes
and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield, and
should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land"
as set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended; and

NOW THEREFORE, BE IT RESOLVED that the division of the above described lots 1, 2,
and 3 from the 25.8 acre tract is hereby exempted from such definitions and may be conveyed in the
form of such lots "1", "2", and "3" as is more fully described above and that a copy of the instrument
or instruments of conveyance when recorded shall be filed with this Resolution.

A tract of land situate in Lot 4, Section 30, Township 5 South, Range 91 West
of the 6th Principal Meridian being more particularly described as follows:
Beginning at a point whence the west 1/4 corner of said Section 30 bears
N 23728'28"W 1867.63 feet; thence S 85'21'03" E 471.66 feet along the
south line of a tract of land described in Book 725 at Page 961 of the records
of the Clerk and Recorder of Garfield County, Colorado, to the westerly right
—of—way fence of Ingersoll Lane; thence S 06'31'57" W 196.05 feet along said
fence; thence S 00'16'07" W 665.19 feet along said fence to the north
right—of—way line described described in Book 20 at Page 573 of the records of
the Clerk and Recorder of Garfield County, Colorado; thence N 89'59'12" W
369.34 feet along said north right—of—way line; thence N 04'47'43" W 901.27
feet to the point of beginning, said parcel contains 6.296 acres more or less.
DESCRIPTION LOT 2
A tract of land situate in Lot 4, Section 30, Township 5 South, Range 91 West
of the 6th Principal Meridian being more particularly described as follows:
Beginning at a point whence the west 1/4 comer of said Section 30 bears
N 00'22'26" W 1312.88 feet; thence N 89'32'48" E 711.05 along the north
line of Lot 4; thence S 0526'03" E 406.57 feet; thence S 04'47'43" E
181.49 feet; thence S 90'00'00" W 746.77 feet to the west line of said Lot
4; thence N 00'22'26" W 581.08 feet along said west line to the point of
beginning, said parcel contains 9.751 acres more or less.
DESCRIPTION LOT 3
A tract of land situate in Lot 4, Section 30, Township 5 South, Range 91 West
of the 6th Principal Meridian being more particularly described as follows:
Beginning at a point whence the west 1/4 comer of said Section 30 bears
N 00'22'26" W 1893.96 feet;, thence N 90'00'00" E 746.77 feet; thence
S 04'47'43" E 719.78 feet; thence N 89'59'12" W 452.26 feet; thence
N 0022'26" W 373.38 feet; thence N 89'59'12" W 350.00 feet; thence
N 00'22'26" W 343.71 feet along the west line of said Section 30 to the
point of beginning, said parcel contains 9.751 acres more or Tess.
