CHAPMAN - WHEREAS, Homer E. Chapman has petitioned the Board of County Commissioners , of the` terms ofGarfieJd`-County; Colorado, for. an exemption.from the definition.. _ "subdivision" and subdivided land" under CRS 1973, 30-28-101(10), as amended, and the -Subdivision _ Regulations of Garfield County, Colorado, for the division of a tract of land comprising approximately 0.24 acres described as follows: A tract of land located in Lot 2, Section 14; Township 7 South, Rance 88 West of the 6th Principal Meridian, described ss follows: Beginning at a point whence the West 4' Corner of said Section 14 bears S.84 06'41"W. 1398.87 fest; thence N.00 03'30"W. 31.38 feet; thence N. 72°52'46"E. 309.$9 feet; thence N.00 03130"W. 7.$1 feet; thence S. 55°18'11"E. 36.46 feet, thence S.00 03'30"E. 9.19 feet; thence S.72 52146"W. 340.81 feet to the point of beginning from other lands owned by said Homer E. Chapman, and WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the proposed division does not fall within -the purposes of Part.1, Article 28, Title 30, Colorado Revised. Statutes 1973, as amended, for the reason that the land which is the subject of the requested exemption is to be used for the purpose of maintaining an existing road providing access to existing tracts, and WHEREAS, the Petitioner has demonstrated to the satisfaction of the :. Board of County Commissioners of Garfield County, Colorado, that the requested division:. is not.a part of an existing or larger development and does not fall within the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in CRS 1973, 30-28-101(10), as amended; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Garfield County,. Colorado, that the division of the above-described tract of land from other lands owned by the Petitioner is hereby exempted from such definitions and said tract may be divided from other lands owned by the Petitioner as is more fully set forth above, and said divided tract may be conveyed in the form of such smaller tract without further compliance with the aforesaid subdivision statutes and regulations;: provided-, however, that this exemption is granted on the condition that no further exemptions be allowed on said tract and that said tract be used only for roadway purposes and that a copy of the instrument or instrumants.. of conveyance when recorded shall be filed with this Resolution.
