At your request we have examined Garfield County abstract
of title No. 2468, prepared by the Garfield County Abstract
Company of Glenwood-Spiin9s, Colorado, consisting of 90 entries,
last c6rtified to the-19th day of May, 7972, dt 8:00 o'clock
A.M., pertaining to the title of the following described property:
Lot I and that part of the SW 1/4 NE L/4 of Section
5, Tp. 6 S., R. 91 W., 6th P.M., Iying North of the
Ware and Hinds Ditch, EXCEPT that part conveyed out
by Document Numbers t7260Lt 175207, 205513 , 22'1465,
235782 | 246264, 246653 and 249066 -
From our examination of said abstract of tit]e, We found
that as of the 19ttt day of Malr L972r dE 8:00 o'cIock A.M. that
merchantable title of record to the above described property
was vested in Edward L. Greene and Lorene Greene subject to
the following observations and comments:
1. At various entries appear the Decree creating the
Silt Rural Fire Protection District, Findings and Decree orga-
nizing the Grand River Hospital District, a Certificate of
Addition of said lands to the Book C1iff Soil Conservation
District, and title to the above described property is subject
to all rights and obligations appertaining to the above, including
property taxes, properly levied in connection therewith.
2, At entry No. 76 appears the preliminary map of the
East EIk Roan pliteau pipeline showing the location of said
pipeline filed in compliince with the laws of the State of
Colorado, and title to said property may be or become sUbject
to a right of way and easement of said pipeline or any conflicts
therewith.
3. At entries No, 29 and No. 37 appears a name variance.

out by warranty deed dated foarch L2,1913, in which the grantor's
name appears ai Luesa A. Zanganella, which deed is signed
Luesa Zinganella. Although a aefinite variance aPPears in
the names as indicated, such variance is not deemed sufficient
to render title unmerchantable due to the length of time
the discrepancy has remained of record without any assertion
of adversily based thereon, and because said names are sufficiently
similar to be regarded as the same by the law under the doctrine
of idem sonans, 6specially since the name Louise can be considered
a d6T$at]on of thL name Luesa, which can be considered a
name belonging to a foreign 1an9ua9e. The. rule of idem- s-onans
as it applles to the pronunciation of foreign names would
appear particularly applicable in the present case in view
of the surname Zanganella.

mly be-ffiidered a serious title defect, the same is not
deemed to render title unmerchantable in the instant case
due to the fact that although the description makes reference
to the said SW 1/4 NE L/4, iuch land is subsequently excepted
out by that portion of the description excepting various
tracts by document number, and Edward L. Greene and Lorene
Greene hive no interest other than the mineral inLerests
heretofore stated in said SW 1/4 NE L/4. The land to which
Edward L. and Lorene Greene are vested with surface ownership

BIFLE AREA, COLORADO
66-Torriorthents'Camborthids'Rock outcrop com'
plex, steep. This broadly delined unit consists of ex'
posed sandstone and shale bedrock, loose slones, and
soils that are shallovr to deep over sandstone and shale
bedrock and stony 'basaltic alluvium. This complex
occurs throughout the survey area. The soils and out-
crops are moderatel'/ stoeP to very steep, slope ranges
from 15 to 70 Percent.
Torriorthents make up about 45 percent of the com-
plex, Camborthids ntake up 20 percent, and Rock out-
crop makes up 15 percent. The Torriorthents are on
loothills and mountainsides below Rock outcrop. Trte
moderately steep Camborthids are on lower toe slopes
and concave open areas on foothills and mountainsides.
Toniorthents are shallow to moderately deep. They
are generally clayey to loamy and contain variable
amounts of gravel, cobbles, and stones. The surface is
normally covered with stones weathered lrom the higher-
lying Flock outcrop. tiouth of the Colorado River, basaltic
stones and cobbles are on the surface.
Camborthids are shallow to deep. They are generally
clayey to loamy and have slightly more clay in the sub-
soil than in the surfiace layer. The surlace layer is light
colored. The profile is normally lree of stones, but scat-
tered basalt stones, cobbles, and sandstone fragments
are on the surface.
The Flock outcrop is mainly Mesa Verde sandstone
and Wasatch shale. Some areas are covered with basal'
tic boulders and stones. Small areas of limestone out-
crops and exposed gypsum are in the eastern part of the
survey area.
lncluded in mappinrg are small, isolated areas of llde-
fonso, Lazear, Ansari, Begay, Heldt, and Dollard soils.
These intermittent a,reas make up 10 to 20 percent ol
this map unit.
This complex is used for grazing, wildlile habitat, and
recreation.
The stones on the surface and the steep slopes make
this complex unsuitable for crops. Some areas can be
reseeded to pasture by broadcast seeding. Other plant-
ing methods are marJe difficult by the stones and slopes.
The native vegetation includes wheatgrasses, blue-
grasses, lndian ricegrass, needlegrasses, bitterbrush,
mountainmahogany, sagebrush, and an overstory ol
pinyon and juniper.
The value of grazing is fair. The vegetation should be
managed to maintain wood production and limited graz-
ing. Selectively thinning the pinyon and luniper improves
grazing and provides firewood and posts. Steep slopes,
moderate to severe erosion hazard, and slow regrowth
of trees affect harvesting and management.
Most of this complex is a prime wintering area lor
deer. Flabbits, coyole, and a few elk also find food and
cover on this complex.
Building is limited by steep slopes .and stoniness.
These limitations can be overcome by appropriate
design and construction.
This complex is in capability subclass Vlle, nonirrigat-
ed.Rt' '67-Torriorthents-Rock outcrop complex, steep.
This broadly delined unit consists of exposed sandstone
and shale bedrock and stony soils that are shallow to
moderately deep over sandstone and shale and stony
basaltic alluvium. Areas of this complex occur throughout
the survey area. The soils and oulcrops are moderately
steep to very steep. Slope ranges lrom 15 to 70 percent.
Torriorthents make up about 60 percent of this com-
plex, and Rock outcrop makes up 25 percent. The Tor-
riorthents are on loothills and mountainsides below the
Rock outcrop.
Torriorthents are generally clayey to loamy and con-
tain variable amounts ol gravel, cobbles, and stones.
The surface is normally covered with stones weathered
from the higher-lying Rock outcrop. South of the Colora-
do River, stones and cobbles ol basalt are on the sur-
lace.
The Rock outcrop is mainly Mesa Verde sandstone
and Wasatch shale. Some areas are covered with basal-
tic boulders and stones. Small areas of limestone out-
crops and exposed gypsum are in the eastern part of the
survey area.
lncluded in mapping are small isolated areas ol lldu-"

well drained, gently sloping soil is on mesas, terraces,

Typically, the surface'layer is grayish brown loam
about 12 inches thick. The subsoil is grayish brown and
light gray sandy ctay loam about 21
-inines thick. Ther substratum is light gray gravelly sandy clay loam or very
gravelly sandy loam to a depth of 60 inches.
lncluded with this soil in mapping are small areas of
Heldt, Potts, and Kim soils that have slopes of 3 to 6percent. These areas make up 5 to 15 percent of the
map unit.
Permeability is moderate, and available water capacityis moderate. Effective rooting depth is 60 inches or
more. Surface runoff is slow, and the erosion hazard is
moderate.
This soil is used mainly for irrigated crops and hay.
Alfalfa, small grains, corn for silage, and grass or grasi-' legume mixtures are grown. Small acreages are inJruits,
including apples, peaches, and apricots. lsolated areas
are used lor grazing.
This soil is irigated by furrows and flooding. Sprinklersare also suitable. Drop structures in irrigaiion'ditches
help to control water and prevent excess-ive ditch ero-
sion.

When range condition deteriorates, forbs and shrubs
increase. When the range is in poor condition, undesira-ble weeds and annual plants are numerous. properly
managing grazing maintains and improves range cbndi-
tion.. Reducing brush improves deteriorated ranle. Seed_rng tmproves range in poor condition. Crested wheat_grass, western whe,atgrass, and Russian wildrye are suit-able. for seeding. Preparing a seedbed and drilling theseed are good practices.
Cotlontail rabbit, squirrel, pheasant, and some muledeer find habitat on this soil.
. Community development and recreation are limited bylow strength.
This soil is in capability subclasses llle, irrigated, andlVe, nonirrigated.

more. Surface runoff is medium, and the erosion hazard
is moderate.
This soil is used mainly lor irrigated hay, fruits, andgrazing. Grass-legume mixtures and apples, peaches,
and apricots are grown.
This soil is irrigated by lurrows and flooding. Sprinklers
are also suitable. Drcp structures in irrigation ditches
help to conlrol water and prevent excessive ditch ero-
sion. Keeping a grass or legume cover on this soil at
least three-fourths of the time controls erosion.
The native vegetation on this soil is mainly wheat-
grass, needleandthread, and sagebrush.
When range condition deteriorates, forbs and shrubs
increase. When the range is in poor condition, undeslra_ble weeds and annual plants are numerous. properly
managing grazing maintains and improves range conOi
tion. Reducing brush improves the range. SeeOing im-proves range in poor condition. Crested wheatgrass,
western wheatgrass, and Russian wildrye are suitable for
seeding. Preparing a seedbed and drilling the seed aregood practices.
Cottontail rabbit, squirrel, pheasant, and some mule
deer find habitat on this soil.
Community development and recreation are limited by
steep slopes and low strength.
This soil is in capability subclass lVe, irrigated and
nonirrigated.
S2-Parachute loam, 25 to 65 percent slopes. This
moderately deep, well drained, hilly to very steep soil ison north- and east-facing mountainsides. Elevation
ranges from 7,500 to 8,700 feet. This soil lormed in
residuum from sandstone. The average annual precipita_
tion is 20 inches, the average annual air temperatuie is
about 40 degrees F, and the average frost-free period is
less than 75 days.
Typically, the surface layer is grayish brown loam
about 5 inches thick. The upper part of the subsoil isvery dark grayish brown and brown loam about 13
inches thick, and the lower part is light yellowish brown
extremely channery loam about 11 inches thick. Hard,
fractured sandstone bedrock is at a depth of 29 inches.
lncluded with this soil in mapping are small areas ofRhone and lrigul soils. The Rhone loils are in concavepositions. These areas make up 10 to 15 percent ol the
map unit. lrigul soils are on ridge crests.
Permeability is moderate, and available water capacity
is low. Effective rooting depth is 20 to 40 inches. Surfacerunoff is medium, and the erosion hazard is moderate.
This soil is used mainly for witdlife habitat and timited
grazing.
