According to regulations and prior to any final approval, in" uppti.unt woulJ be required to drill and pump-test the well' supply a written opinion from the p.*on *ho "onducted the test that the well is capable of supplying water for the p.ofor"a usgs, ]rave. the water tested for nitrate/ nitrite and fecal coliform bacteria content, and draft a shared well declaration' Soils/Sewer: The method of wastewater treatment would be the use of individual sewage disposal systems (ISDS). According to the Soil conservation Service' soils Sm. A. B C D b J U o on-site where the development is proposed, consist of two (2) types, the Heldt clay loam and the Olney loam. When used for building site development and the placement of ISD systems, the Heldt soil is considered to have moderate to severe tonstraints due to high clay content, shrink-swell potential and slow percolation. The Olney loam is considered to have slight constraints to building site development and moderate constraints to ISD systems due to slow percolation. Due to the severe constraint designation, staff recommends a plat note stating that engineered septic systems and building foundations may be required at time of building permit submittal. Additionally, the Grand River Ditch is unlined and seepage from the ditch may create problems if a homesite is developed below the ditch on lot 3, especially if developed with a basement. Staff recommends the applicant consider placing a building envelope on lot 3, above the ditch, or restrict development to a structure without a basement. E. Access: All proposed lots would be accessed by County Road 210, which borders the southern and eastern portions of the tract. County Road 210 is a chip-seal surfaced road with a platform of approxim ately 20 feet. Lots I and 2 would be accessed by a shared driveway, west of the curve in CR 210 and Lot 3 would be developed with an individual driveway, north of the curye. Staffhas visited the site and contemplates no significant issues concerning the access and recommends the applicant consult with the County Road and Bridge Department and receive any driveway permits, if required by the Department, prior to final approval. F. Fire Protection: The Rifle Fire Protection District has submitted a letter stating the District has no specific requirements for this type of subdivision. However, the District does recommend that the applicant attempt to identify a year-round water supply for fire fighting purposes, post addresses in a conspicuou.s manner and provide adequate access for emergency vehicles. See letter, page'/J - Staffsuggests the inclusion of the standard plat note addressing wildfire protection. G. Easements: A-ll required easements for access, utilities, water supply, irrigation, etc.,will be required to be shown on an exemption plat. H. School Site Acquisition Fees: The applicant would be required to pay the $200.00 school site acquisition fee, per lot, for the creation of the exemption parcels, a total of$600 00 i. Comment from Carol Gentry. States she has no objections with the proposal as long as the applicant honors provisions of the Antlers Orchard Development plat and "installs a public roadway" to provide-access to adjacent, northern properties. As an adjacent property owner I would like to make the foilowng response. I have attempted to negotiate wrth Mr. Craw directly but he is not wrlling to discuss my concerns regarding the easement and right of way of record that is on my property. There is also an existing fence inside my property line, vrfrich he is not willing to move. Attached please find the information regarding the recorded easement and right of way. There is approximately 25 feet I have had to give up because of the existing fence line. This property is r,rorthiess to Mr. Craw as there is no water to irrigate that portion, nor is there any pasture for his animals. That 25 feet has real value to me in the fact that it is included in the legal description of my property, plus I have already had to give up another 25' lo the inside of that existing easement and fence line to create another easement for our new neighbors for access to their property. I am not in favor of the exemption, unless: Mr. Craw wouid complete the road that J Gentry started wlrich is the first existing easement recorded in 1909 to the Yeakel property vath appropriate road materrals and move the existing fence to the surveyed property line on the east side.
