R E S O L U T I O N ++S4
IIHEREAS, ATLANTiC RICI-IFIELD C0MPANY has petitioned the Board of County
Commissioners of Garfield County, Colorado, for an exemption under C.R.S.
(tSZ:1 Section 30-28-l0l (tOi (a) - (A) as amended, and the Subdivision Regu'lations
of Garfield County, Colorado, adopted September 1,1972 and amended April '14,
1975, Sections 1.02.17 (d) and 3.02.0.l, for the exemption of a .l3.76 acre tract
of land out of a larger parce'l of land, and more part'icu1arly described as
fol ,lows:
A parcel of land situated in Lot 9 of Section 6, and in the SEk
SW% of Section 6, also in Lot 2 of Section 7, and in the N% of
Section 7, all in Township 7 South, Range 95 blest of the Sixth
Principa'l Meridian, lying Northwesterly of a sub-channel of the
Colorado R'iver, said parcel of land is descrjbed as follols:
Beginning at a point whence the Quarter Corner common to said
Sect'ions 6 and 7 bears: S. 0lo 13' 08" l^l. 293.87 feet; thences. 49o 46', 00" E. 955.38 feet to a point in the center of said
river; thence S. 360 l0' 00" l^J. .l69..l4 feet a'long the center of
said river; thence S.490 00'00" t^l.475.00 feet along the
center of said river; thence N. 49o 46' 00" hl. 895.72 feet;
thence N. 400 lB' 00" E. 638.17 feet to the point of beginning.
The above described parcel of land contains .l3.76 acres, more
or I ess.
WHEREAS, the Petitioner has shown to the satisfaction of the Board of
County Commissioners of Garfield County, Colorado, that he desires said
exemption for the purpose of re-saje to facilitate the construction of a water
diversion facility out of the Colorado River;
WHEREAS, the Petitioner has demonstrated that said water diversion facilfties
would be allowed under the conditional use pr.ovisions of the applicable zoning
on said 13.76 acre parcel, that there is adequate ingress and egress to said
tract, that the requested division is in accordance with the general purposes
and intent of the Subdivision Regulations of the State of Colorado and the
County of Garfield and shoujd, therefore, be exempted from the definition of
the terms "subdivision" and "subdivided land" as set forth in C.R.S. (.I973)
Section 30-28-l0l (10) (a) - (d) as amended;
