the Subdivision Regulations of Garfield County, Colorado, adopted September 1,
1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the under-

Mr. Flaven Cerise Petition to Create 2 -two acre parcels from a 114
acre tract

Based on the information received by this office and past experience with
sewage disposal facilities in the immediate area of the proposed exemption, it
has been determined by this office on -lot sewage disposal facilities are both
feasible and practical, commensurate with both County and State regulations,
provided proper permits are obtained prior to construction.
It should be further noted that due to the known conditions, only the follow-
ing types of on -lot sewage disposal systems would be acceptable:
x Approved septic tank and absorption area
x Approved septic tank and dry well
x Approved aerated treatment unit and absorption area
Approved aerated treatment unit and sealed sub -surface
evapotranspiration system

Re: Cerise Exemption

We have reviewed the above referenced exemption application. The
wells proposed as the water supply would intercept ground water which is
tributary to the Crystal River, an over -appropriated stream. Since new
wells would cause injury to senior vested water rights, well permits cannot
be issued by this office and we cannot recommend approval of the Cerise
Exemption.
A single domestic well permit could be issued for the 110 acre lot
in accordance with CRS 1973, 37-92-602(3)(b)(II), as amended.
