KUIPER State Engineer We have reviewed the above referenced exemption application. The wells proposed as the water supply would intercept ground water which is tributary to the Crystal River, an over -appropriated stream. Since new wells would cause injury to senior vested water rights, well permits cannot be issued by this office and we cannot recommend approval of the Cerise Exemption. A single domestic well permit could be issued for the 110 acre lot in accordance with CRS 1973, 37-92-602(3)(b)(II), as amended.
