WI{EREAS, WAL'I-ER AND SONDITA DAUGIIEITTY petitioned the Board of County Commissioners of Garfield County, Coloraclo, lbr an exemption lrom the definition of the terms "subdivision" and "subdivicled land" under C.R.S. 1913,30-28-101 (10) (a)-(d), asamended, and the Subdivision Regulations of Garheld County, Colorado, adopted April 23,1984,Section 8:00 through 8:60 and fbr the division of a 9.801 aore tract as clesoribed in Book 543 aLPage 561 Reception #301551 as filed in the Ollloes of the Clerk and Reoorder of Garlield County, Colorado, into three (3) tracts of approximately 2.687, 2.5M ancl 4.570 aores each, with the exemption parcels more practically as follows: See Attached (in the State of Colorado and the County of Gartield); and WI{EREAS, the Petitioners }rave demonstrated to the satisfaction of the Board of County Comnrissioners of Garfielcl County, Colorado, that the proposed division does not fall within the purposes ol Part l, Artiole 2[i, 'fitle 30, Colorado Revised Statutes l9]3, as amended, lor the reason that the division does not warrant lur[her subdivision review; and WHEREAS, the Petitioners have dernonstrated to the satisfaotion of the Board of County Commissioners of Garfield County, Colorado, that there is a reasonable probability of locating clomestic water on each ol'said paroels, that there is existing ingress and egress to said parcels, that the looation of septio tanks will be perrnitted by the Colorado Department of Health, that the requested division is not part olan existing or larger development and does not lall within the general purposes ancl inlent olthe Subdivision RegLrlations of the State of Colorado and the County of Garfield, and shoukl, therefore, be exempted lrom the definition o1'the terms "subdivision" And "subdivided land" as set forth in C.R.S. 1973,30-28-l0l (10) (a)-(d), as amended; and a 475488 8-934 P-2BB O:)/1,4/gS 02:501) [G 2 OI.. 3 NOW THEREFORE, BE IT RESOLVED that the division of the above described 9.801 acre parcel is hereby exempted from suoh dehnitions and may be conveyed in the form of parcel "1",parcel"2" and parcel "3" as are more fully described above and that a copy of the instrument or instruments of conveyance when recorded shall be filecl with this Resolution.
