Pursuant to C.R.S. (1973) Section 30-28-101 (10)
(a)-(d) as amended, and the Subdivision Regulations of
Garfield Countlz, Colorado, adopted September 1, lg72 and
amended AprJ-I i- 4, L975, and January 2, lg7g, Section l.O2.L7
(d) and 3.02.01, DAVID IdALLER DANGLER, by his attorneys,
Delaney and Balcomb, respectfully petitions the Board of
County Comrnissioners of Garfield County, Colorado, to exem.pt
by resolution the divisi-on of a 32.33 acre tract of land
into four (4) parcels of approximately eight (B) acres each
and which tract to be subdivided is more particularly described
as follows:

Regulations, fo:: the reasons stated belowz
1. The entire 32.33 acre tract is now being
utilized as a residence by Wayne Kilg and Dorothy King, the
true owners of the land, the petitioner herein being a
nominee on1y.
2. The subject land is capable of accomodating
many resid.ential units, horvever, a division of the land into
four (4) parcels only is being requested.
3. The use of each parcel will be for single family
residential use only.
4. Electrical and telephone se'rvices are available
and pubtic access will be provided frorn County Road LJz.
In support of this petition, the petitioner also
submits the following:
(a) Map drawn to scale showing approximate lot
subdivision and accessi
(b) coPY of deeds i
(c) Vicinity l"lap;
(d) Statement on source of domestic water;

Attached to and forming a part of Petition for Exemption,
David Wa1ler Dangler, Petitioner
STATEMENT ON SOURCE OF DOMESTIC WATER
Parcels I and 2 will be served by King Well No. L,
which well has been approved by the State Engineer of the Stateof Colorado and has been assigned Permit Number 32390 for L2
gallons of water per minute. This rvell presently serves the
residence located on Fa::cel 2.
Parcels 3 and 4 will be served by King lalell No. 2,
which well has been in existence since L967, however, through
mistake and oversight of the well driller, a permit was not
obtained from the Colorado State Engineer. An applicationfor a late registration for said vrell- was filed on August 3I,
L979 and a weJ-l permit number is expected to be assigned inthe near future- The well produces in excess of 15 gallonsof water per minute.
Upon receipt of the well permit for King trteI} No. 2,
a petition for adjudication of both wells wiLl be fited inthe Water Court for Vlater Division No. 5.
STATBMENT ON METHOD OF SEWAGE DISPOSAL
Sewage disposal will be by septic tank or some like
method of sewage disposal which will receive approval from thelocal and State health departments. The present method of
serrage dJ-sposal for the residence located on Parce1 2 isseptic tank and the same has perfo::med without malfunction sincethe date of construction of the residence in 1968.
