HomeMy WebLinkAbout2.0 BOCC Staff Report 03.10.2006• BOCC 3/10/86 PROJECT INFORMATION AND STAFF COMMENTS REQUEST: For Exemption from the Definition of Subdivision APPLICANT: Glen and Dorothy Chambers LOCATION: A tract of land located in the W 1/2 SW 1/4, NW 1/4 SE 1/4, NE 1/4 SE 1/4, NE 1/4 SW 1/4, Lots 1, 2 and 3 Section 11, and Lot 1 Section 14, Township 6 South, Range 93 West; approximately 2.5 miles east of Rifle off of State Highway 6 & 24. SITE DATA: The site consists of approximately 175.7 acres. WATER: Existing well Existing individual sewage disposal system. SEWER: ACCESS: EXISTING ZONING: ADJACENT ZONING: Existing access off of State Highway 6 & 24. A/I North: A/I, PUD, R/G/SD South: A/I East: A/I West: A/I I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located in District B, Subdivisions/Rural Serviceable Areas 0 to 1/2 mile radius, based on its proximity to the proposed East View Industrial Park PUD. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site consists of relatively level, low lying ground between State Hwy. 6 & 24 and the Colorado River. Land uses on the site are agricultural and industrial. Improvements include the Casey Concrete facilities, active and abandoned gravel pits and a single residence with related agricultural facilities. B. Project Description: The applicant proposes to divide the 175.7 acre tract into 2 lots of 3.4 acres and 172.3 acres. The 3.4 acre lot contains the existing dwelling with well and septic system. C. History: Since January 1973, a single lot greater than 35 acres has been split out of the tract. • • III.MAJOR ISSUES AND CONCERNS A. Adjacent Property Owners Comments: 1. Terry Gallagher of the Gasamat Oil Corporation has registered their support of the Chambers application. (See letter, page 7 ). B. Staff Comments: 1. The existing well serves the 3.4 acre parcel while the remainder of the larger tract should qualify for additional well permits based on the acreage involved. In addition, each parcel should receive a proportional share of irrigation rights associated with the property. 2. Soils information on the site indicates that a large part of the tract is subject to high water table and occasional flooding. However, the 3.4 acre lot is located adjacent to Hwy. 6 & 24 in an area with only moderate constraints to development due to low strength soils. 3. The applicant should establish the legality of the existing access across the Denver and Rio Grande Western R. R. tracks. IV. SUGGESTED FINDINGS 1. That proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, with the following conditions: 1. That the following plat note be included on the exemption plat: That all irrigation ditch easements be recognized and maintained as existing and in place. 2. Each parcel shall receive a deeded, proportional share of all irrigation ditch rights associated with the property. / 3.) The applicant shall establish the legality of existing access _,/ points for both parcels. 4. Gasamat Oil Corp. of Colorado, a property owner near the parcel to be divided, wishes to respond to the notice we received_2-19-86 and go on record that Gasamat supports surrounding property owners and Glen and°Dorothy Chambers in particular, in their efforts to divide said parcel of land. A representative of Gasamat will not be present for the hearing, set the 10th day of March, 1986, at 11:00 A.M. in Glenwood Springs, Colorado; however, Gasamat does not object to this exemption. This property is within the boundaries of the Rifle Fire Protection District and is served by the District for Fire Protection and Ambulance Service. Their wish is to divide their 212 acre ranch into 3 large parcels and one small parcel, the three large parcels will contain in excess of 35 acres and the one small parcel will contain 3.3 acres which encompasses the ranch residence at which they are currently residing. The existing access is currently to U. S. Highway 6 & 24 in which they cross the Denver and Rio Grande Railroad to get to. The subject property is serviced by a water well, and the sewage system is contained by a septic tank and leech field. The three large parcels are undergoing definition at this time, and are not complete except for a 36.32 acre tract conveyed to their sons. In order for them to complete conveying their land to their children, the 3.3 acre parcel needs to be approved for exemption. Your thoughtful consideration of this application is appreciated.
