.RESOLUTION TO SENATE BiLL 35

REAS, Beverly J. Christiansen formerly known as Beverly J. Curry,
has petitioned the Board of County Commissioners of Garfield County, Coiorado,
for an exemption under C.R.S. .l06-2-33(3)(d)(1963 as amended) for the
division of.7831 acre tract into 2 tracts of approxima.te'Iy.3915 acres, more
or less, and more particularly described as fol'lows:
The North 14'1.75 feet, measured along the West boundary
Iine of deeded 1ane, of that tract situate in Lot 2,
Sec. 2, Tp. 6 S.,,R89W. of the 6th P.M., said tract being
more fully described as follows:
Beginning at a point on the West line of said Lot 2,
whence the Southwest corner of said Lot 2 bears S.
0o 55' l{l. 99.46 feet; thence S. 880 27', E. ?32.5 feet,
to deed 'lane; thence N. l4o 13' E. 281.75 feet along
Westerly line of deeded lane; thence N. B8o 27' I,J.
222.5 feet to center of No-Name Creek; thence S. 29o2l' E. 4.l.5 feet along center of No-Name Creek; thence
S. 360 13' hl. 156.3 feet along center of No-Name
Creek to the intersection with West line of said Lot
2; thence S.0o 55't^l. .l.l0.5 feet along West line of
said Lot 2, to the point of beginning
EXCEPT that part deeded out by Document No. 218210,
recorded on Ju'ly 18, 1962, in Book 343 at Page 159
of the Records of the Garfield County Clerk and
Recorder.
Said property to be divided in half in an East-Wester
manner with approximate'ly 70' frontage on the East,
78' on the West and approxinntely 228' on each of the
North and South boundaries. (See attached p'lat.)
iIHEREAS, the Petitioners have shown to the satisfaction of the Board of
County Commissioners of Garfield County, Colorado, that they desire said
exemption for the purpose of re-saIe into single-family residential acreage,
and
IIHEREAS, Petitioher has demonstrated to the satisfaction of the Board that
there is domestic water supplied by No-Name Water Association on each of
said.3915 acre tracts, that there is adequate ingress and egress to said
tracts, that the Ioca.tion of septic tanks is permitted by the Colorado Department
of Health, that the requested division is in accordance with the general
purposes and intent of the subdivision regu'lations of the State of Colorado and
the County of Garfield and that sa'id division will actually restrict the density

of housing within said area and should therefore, be exempted from the
definition of the terms "subdivision" and "subdivided land" as set forth in
C.R.S. I06-2-33(3)(d)(1963 as amended);
NOl.l, THEREF0RE, upon the motion of
and seconded by ,Hr,ron. /LZ/, said .7831 acre tract of
,/land, hereby now occupied by lega'l non-conforming uses, is exempted from the
requirements of the subdivision regulations, provided that the granting of this
exemption is specifica'tly conditioned upon the granting by the Garfield County
Bbard of Adjustment of a variance from the minimum lot size for the construction
of an individual sewage treatment system, transfer of said tract may be made
by division into 2 tracts of.3'195 acres, more or less, all as is more
fully described in the petition pertaining hereto, A copy of the instrument
or instruments of conveyance when recorded shall be filed with this Resolution.
