\\.HEREAS, THEODORE W. AND KATHEzuNE S CIIzuSTIE petitioned rhe Board of Counry
Commissioners of Garfield County, Colorado, for an exemprion from the detrnirion of the rerms
"sub'division'' and 'subdivided land" under C.R.S. 1973,30-28-101 (10) (a)-(d), as amended, and rhe
Subdivision Reeuiations of Garfleld Counry, Colorado, adopted Aprii 23, 198.1, Secrion 8:00 through
8.60 and for the ciivision of a 37.533 acre tracr as described in Book -120 ar Pase 236, as flled in the
Offices of the Clerk and Recorder of Gartield County, Colorado, into t,,vo (2) tracrs of approximateiy

WHEREAS. the Petirioners have demonstrated to the satisfaction of the Board of County
Commissioners of Garfield Counry, Coiorado, that the proposeC divisron does not fal1 withrn the purposes
of Pan 1, Article 28, Tirle 30, Colorado Revised Starutes 1973. as amended, tor the reason that the
division does not warrant funher subdivrsion revierv, and

WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of Counry
Commissioners of Garheld Counry, Colorado, that there is a reasonable probabiiiry of locaring domestic
water on each of said parcels, that there is existing ingress and egress to said parcels, that the locarion
of septic unks will be permined by the Colorado Deparu-nent of Healttr, thar the requested division is nor
pan of an existing or larger development and does not fall within the general purposes and inrenr of rhe
Subdivision Regulations of the State of Colorado and the Counrll of Garfield, and shouid, therefore, be
exempted from the definition of the terms "subdivision" and "subdivided land" as set forrh in C.R.S.
1913,30-28-101 (10) (a)-(d), as amended; and
NOW THEREFORE, BE IT RESOLVED that the division of the above described 37.533 acre
parcel is hereby exempted from such def,rnicions and may be conveyed il the form of rhe Lor '1 and Lot
"2" as are more ful1y described above and that a copy of the insrrument or inslrumenrs of convevance
when recorded shall be fi1ed r,virh this Resolution.

RE: Christie SB-35, Subdivision Exemption
Dear Mr. & Mrs. Christie,
This letter is to inform you that your request for a subdivision exemption as described in Section
8:00 of the Garfield County Subdivision Regulations of 1984, as amended, was approved by the
Board of County Commissioners at their October 12,1998 hearing The following conditions will
apply to the submission and acceptance of the exemption plat:
That all representations of the applicant, either within the application or stated at
the meeting before the Board of County Commissioners, shall be considered
conditions of approval.
A Final Exemption Plat shall be submitted, indicating the legal description of the
property, dimension and area of the proposed lot,25 ft. wide access to a public
right-of-way, and any proposed easements for setbacks, drainage, irrigation, access
or utilities.
That the applicant shall have 120 days to present aplat to the Commissioners for
signature from the date of approval of the exemption.
That the applicant shall submit $200.00 in School Site Acquisition Fees for the
creation of the exemption parcel.
5. That the following plat note shall appear on the Final Exemption Plat:
"Control of noxious weeds is the responsibility of the property owner."
"One (1) dog will be allowed for each residential unit within a subdivision and
the dog shall be required to be confined within the owners property
boundaries. "
"No open hearth solid-fuel fireplaces will be allowed anywhere within an
exemption. One (1) new solid-fuel burning stove as defied by C.R.S. 25-7-401,

seq., and the regulations promulgated thereunder, will be allowed in any
ling unit. All dwelling units will be allowed an unrestricted number of
gas burning stoves and appliances"
All exterior lighting be the minimum amount necessary and that all exterior
ighting be directed inward, towards the interior of the subdivision, except that
isions may be made to allow for safety lighting that goes beyond the
boundaries"
to the approval of an exemption plat, the applicant will demonstrate that the
will meet the following:
That a four (4) hour pump test be performed on the well to be
used;
A well completion report demonstrating the depth of the well, the
characteristics of the aquifer and the static water level;
The results of the four (4) hour pump test indicating the pumping
rate in gallons per minute and information showing drawdown
and recharge;
A written opinion of the person conducting the well test that this
well should be adequate to supply water to the number of
proposed lots;
An assumption of an average or no less than 3.5 people per
dwelling unit, using 100 gallons of water per person, per day;
The water quality be tested by an approved testing laboratory and
meet State guidelines concerning bacteria and nitrates, solids, and
mineral content including alkalinity.
If the well is to be shared, a water sharing agreement will be
filed with the exemption plat that defines the rights of the
property owners to water from the well.
A water quality test ensuring potability for human and animal
consumption.

Any future property owners of said property agtee to, as
condition of future continued approval of the special use permit, that if, in the
event that the property described by this special use permit, has the
le ability to connect with any municipal or centralized water and/or
system, the subject property owners shall be required to connect to said
ice and remove any existing residential well head(s) and individual sewage
isposal systems(s) which may be located on said property, within one year of
