PETITION FOR EXEMPTION
Pursusant to C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as
amended, and the Subdivision Regulations of Garfield County, Colorado,
adopted April 23, 1984 Section 2:20.49, the undersigned Cr_f 2,7i

of County Commissioners of Garfield County, Colorado, to exempt by
Resolution the division of ,M acre tract of land into_ ,2 tracts of
approximately J'9 acres each, more or less, from the definitions of
"subdivision" and subdivided land" as the terms are used and defined in
C.R.S. (1973) Section 30-28-101 (10) (a) - (d) and the Garfield County
Subdivision Regulations for the reasons stated below:

SUBMITTAL REQUIREMENTS:
An application which satisfies the review criteria must be submitted with
all the following information.
A. Sketch map at a minimum scale of 1"=200' showing the legal
description of the property, dimension and area of all lots or
separate interests to be created, access to a public
right-of-way, and any proposed easements for drainage,
irrigation, access or utilities;
B. Vicinity map at a minimum scale of 1"-2000' showing the general
topographic and geographic relation of the proposed exemption to
the surrounding area within two (2) miles, for which a copy of
U.S.G.S. quadrangle map may be used.
C. Copy of the deed showing ownership by the applicant, or a letter
from the property owner(s) if other than the applicant; and
D. Names and addresses of owners of record of land immediately
adjoining and within 200 feet of the proposed exemption, mineral
owners and lessees of mineral owners of record of the property to
be exempted, and tenants of any structure proposed for
conversion; and
E. Evidence of the soil types and characteristics of each type; and
Proof of legal and adequate source of domestic water for each lot
created, method of sewage disposal, and letter of approval of
fire protection plan from appropriate fire district; and
G. If connection to a community or municipal water or sewer system
is proposed, a letter from the governing body stating a
willingness to serve; and
H. Narrative explaining why exemption is being requested; and
I. It shall be demonstrated that the parcel existed as described on
January 1, 1973 or the parcel as it exists presently is one of
not more than three parcels created from a larger parcel as it
existed on January 1, 1973.

Together with the right to enter upon said premises, survey, construct, maintain, operate, repair, replace, control and use
said utility lines and related fixtures and devices, and to remove objects interfering therewith, including the trimming of trees
and bushes, and together with the right to use so much of the adjoining premises of Grantor during surveying, construction,
maintenance, repair, removal or replacement of said utility Ines and related fixtures and devices as may be required to permit the
operation of standard utility construction or repair maclfnery, and the right to permit the installation of the facilities of any
other company. The Grantor reserves the right to use and occupy said premises for any purpose consistent with the right and
privileges above granted and which will not interfere with or endanger any of the said Grantees facilities therein or use thereof.
Such reservation by the Grantor shall in no event include the right to erect or cause to be erected any buildings or structures
upon the utility easement herein granted. In case of the permanent abandonment of said utility easement, all right, privilege and
interest herein granted shall terminate.
Grantor further grants unto the Grantees the right, privilege and authority to permit any form of other communications or
other utility company to occupy and maintain its facilities within and in accordance with the provisions of this utility easement.
The work of installing and maintaining said lines and related fixtures and devices shall be done with care; the surface along
said utility easernent shall be restored substantially to its original level and condition.
Grantor shall include the plural and the feminine.

Enclosed please find copies of documentation of a replacement well being drilled
and a pump put in on our property.
Stoneman Drilling Company drilled the well instead of Collins Drilling Company
as Collins was too busy.
On the location of proposed well I believe the township should read 5 instead of

my initials by that.
The property is in the following names: Clarence f & Betty S. Dawson, Michael &

people but all pertain to the well being drilled and the pump put in and the old
well abandoned.

REQUEST: For a S.B. 35 Exemption Request
OWNER: Robert Bloomfield
LOCATION: NW 1/4 NW 1/4 Section 25, T5S,
R91W; located approximately 2 miles
northwest of New Castle off County
Road 245.
SITE DATA:
The site is 20 acres in size. It
is proposed to divide this into one
10 and two 5 acre parcels.

I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The site lies within District D, Rural areas with moderate
environmental constraints. The suggested density in the Comprehensive
Plan for District D is one dwelling per five acres. The following
statements are taken from various sections of the Comprehensive Plan:
"District D is composed of moderate environmental constraints which
may be mitigated to allow limited but potentially difficult or
hazardous development. It is the policy of the County to consider
this district to have fair suitability for growth when in compliance
with other County policies."
"The County shall require development within District D to utilize
measures which mitigate any constraints found on the site to the
fullest extent practicable in order to ensure the health, safety, and
welfare of existing and future residents."
"Non-agricultural areas and non-productive cropland found within this
District shall be considered best able to absorb growth. Productive
cropland shall be considered least desirable for conversion to other
land uses."
"Road access and conditions shall be used to evaluate the relative
ability of areas within District D to absorb growth. Roads in a
condition unsuitable to support further development and/or areas with
no access shall be considered least able to absorb growth."
"Slopes 25% and over shall be restricted from development."
"No vegetation shall be removed on slopes 25% or over unless otherwise
approved by the County Commissioners."

I. DESCRIPTION OF THE PROPOSAL
A. Site Description: The site currently contains an older log home
and several outbuildings. It is partially in agricultural
production. The two proposed 5 acre lots are vacant and it does
not appear that they are being used for agricultural uses. The
proposed 10 acre site contains the existing home and agricultural
activities.
B. Protect Description: The applicant wishes to divide a 20 cre
parcel into 2 five acre parcels and one 10 acre parcel. The
application states that the newly created parcels are to be
created for purposes of transfering these lots to relatives.
History: The applicants 20 acre tract was divided off of a 40
acre tract in December of 1973. This has been the only division
of the original tract, as recorded, since January 1, 1973. Under
the exemption regulation, the applicant may create 2 new parcels
to create a total of 4 lots. The applicant's proposal is in
conformance with this regulation. It should be noted that this
is the maximum number of lots which, according to the
regulations, can be created through the exemption process out of
the original 40 acre tract. See map page3 .
III.MAJOR ISSUES AND CONCERNS
A. Review Agency Comments
1. A letter was received from the Silt/New Castle Fire District
on May 7, 1934 (see pagen_) stating that they request that a 500
gallon water storage tans: be available for each lot for fire
protection purposes.
B. Staff Comments
1. The proposal is in general compliance with the Comprehensive
Plan with regards to density ( one dwelling unit/five acres).
The proposal also meets the minimum requirements of the Garfield
County Zoning Regulations.
2. The applicant proposes to use an existing domestic well to
serve the three proposed parcels. Thus far, no letter of
response has been received from the Division of Water Resources
regarding this proposal.
3. Each site appears to have serveral possible building site
locations which can meet the required setbacks.
4. The County Environmental Health Officer has noted the
proposed parcels may require individual sewage systems designed
by a registered professional engineer. If this proposal is
approved, a plat note should be placed on the final plat stating
that the two 5 acre parcels may be subject to this requirement.
5. The County Road Supervisor has several concerns regarding the
proposed access for the two 5 acre sites. The applicants propose
to develop a common driveway access directly off County Road 245
for the 5 acre parcels. The area proposed to access onto the
County Road has several blind curves. In addition, the access
drive would have a steep ascent from the parcels to County Road
245. The County Road Supervisor and the applicant are currently
discussing alternatives for access to these sites.
