HomeMy WebLinkAbout2.0 Resolution 77-25RESOLUTION --11-2S WHEREAS, EARL and DONNA DAWSON have petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the division of a 29.15 acre tract into three (3) parcels of approximately 10, 10, and 9.15 acres, more or less, and more particularly described as follows: That part of H.E.S. No. 53 situated in Sections 26 and 35, Township 4 South, Range 91 West of the Sixth Principal "Meridian, being described as follows: Beginning at Corner No. 1 of said H.E.S. No.53; thence N. 16° 41' 41" E. 1735.37 feet to Corner No. 2 of said N.E.S. No. 53; thence N. 520 22' 43" E. 303.44 feet; thence S. 33° 23' 29" E. 289.69 feet to Corner No. 8 of said H.E.S. No. 53; thence S. 01° 47' 27" E. 1855.58 feet to Corner No. 9 of said H.E.S. No. 53; thence N. 75° 24' 00" W. 988.20 feet to Corner No. 1 of said H.E.S. No. 53 the point of beginning. The above described parcel of land contains 29.15,acres, more or less. WHEREAS, the Petitioners have shown to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that they desire said exemption for the purpose of re -sale into single-family residential acreage, and; WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield and that said division will actually restrict the density of housing within said area, and should therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended; 1.6 NOW THEREFORE, upon motion of Fletu -. rs e_ , seconded by , and carried, said 29.15 acre tract of land is hereby exempted from such definition and transfer of said tract may be made by division into three (3) tracts of 10, 10, and 9.15 acres, more or less, all as is more fully described above pertaining hereto, further that a proper legal description will be prepared prior to conveyance of any parcel. A copy of the instrument or instruments of conveyance when recorded shall be filed with this Resolution. Dated this 21st day of March, A.D. 1977.
